Atlantic CharterDEFERED Article I: The Citizenry Bullet I: The Composition of the Citizenry The Citizenry shall be composed of all nations abiding in the region Atlantia for purposes of residency. Bullet II: Rights and Responsibilities The Citizenry is free to act within their own nations as they please. All duties and rights not given to the government are reserved for the Citizenry to carryout, acknowledge, respect, and protect. The Citizenry is responsible for the election of governmental and Ministry and the affairs of the region not governed by the elected officials. Article II: The Ministry Bullet I: Organization The Ministry shall be a group of three people elected by the Citizenry to run the region. Their titles shall be Minister of War, Minister of Internal Affairs, and Minister of Foreign Affairs. They shall be elected by the Senate once every five and a half months. Bullet II: Their Responsibilities The Minister of War shall be responsible for all intelligence and military efforts. The Minister of Internal Affairs for the general growth and prosperity of the region. The Minister of Foreign Affairs for all diplomacy. These Ministers shall be responsible for the running of the region in relation to actual NS events and realities. Article III: The Government Bullet I: The Senate The Government shall be composed of a representative body to be named the Senate. The Senate shall be comprised of the entire citizenry, apart from the Ministry. The Senate shall be headed by the Secretary General. The Senate shall be responsible for running the region according to their will as a whole. The Senate may create executive departments as necessary to run the region. The Secretary General shall be a nonvoting member of the Senate except in the case of a tie. Bullet II: The Secretary General The Secretary General shall be a nonvoting member of the Senate, whose purpose is to lead the discussion of the senate. Every bill put forward by any member of the senate must be verified by the Secretary General. It is the duty of the Secretary General to formally announce the passing and vetoing of every bill. Bullet III: The Limitations of Government Government may not impede the in the affairs of individual nations, nor take actions contrary to the wishes of the Citizenry. Bullet IV: Removal from Office Any Minister may be removed from office if found guilty of treason or any crime against Atlantia. If the member should be in the Senate, a majority of that body must call for him or her to be temporarily banned from voting for a period of four weeks, unless the punishment for the crime is removal from office, in which case he or she shall receive the ban automatically. In the event of removal of a Minister, the Senate shall appoint one of their own body to act in his/her stead until the end of that Minister’s term should arrive. Article IV: The Conduction of Elections Bullet I: General Elections shall be conducted by forum poll. The poll will remain open for five days. A thread with a poll shall be created to facilitate voting. Discussion in the thread will be kept to a minimum, and all other electoral discussion shall occur in other assigned threads. After voting, the individual must create a post in the forum indicating that they have voted. Failure to do so voids their vote. Bullet II: Eligibility Only nations within the region for 48 hours before the elections start may vote. The Senate may in conjunction with the Ministers bar a nation from voting. Article V: Amendment of the Charter Bullet I: General The Charter may be amended at any time provided a majority of both the Ministers and Senate. No amendment shall impede upon the right of representation of any member region for any purpose whatsoever. __________________________________ THE ATLANTIAN CHARTER _____________________ CITIZENRY Bullet I: The Composition of the Citizenry The Citizenry shall be composed of all nations abiding in the region Atlantia for the purpose of residency. Bullet II: Rights and Responsibilities The Citizenry is free to act within their own nations as they please. All citizens have the right to propose and debate laws in Parliament*. The Citizenry is also responsible for the election of the President. * = providing they have been members for over 7 days _____________________ PARLIAMENT Bullet I: The Composition of Parliament All members of the citizenry who have been present in Atlantia for over 7 days have the right to attend and become a member of Parliament (MP). Bullet II: The Role of Parliament Parliament is the main body in Atlantia which has the legislative power to create, amend and ratify laws. Bullet III: Voting Polls on bills/laws will be stopped with the results counted after 7 days. No other votes will be counted after this point. Only bills with 3 or more yes votes will be passed. The President has the right to veto a bill but can be overruled by a supermajority (66%). Bullet IV: Parliamentary Chairperson The Chairperson is to be elected by the Parliament for a term of two months, their task being to moderate Parliament's section of the forum and post polls for Parliamentary votes. The Chairperson has no additional executive or legislative powers to any other MP. _____________________ PRESIDENCY Bullet I: The Role of the President The President acts as the head of state of Atlantia. He/she has the responsibility of choosing the ministry. The President has the same rights as MPs in parliament, but has a special veto power, and can veto a bill in certain circumstances (see B3 @ Parliament). Bullet II: Appointment The President is formally appointed by Parliament every month via election. There are no term limits for Presidents, however elections must take place (every month). Bullet III: Removal The President may be impeached if a supermajority (66%) of MPs agree to do so and providing that the President has broken Atlantian Law. _____________________ MINISTRY Bullet I: The Composition The Ministry consists of several ministers who each have a specific job relating to the management of Atlantia. Bullet II: Appointment The government is appointed by the President. The President has the right to choose the amount of ministers (and the responsibilities they undertake) where he/she sees fit. Each minister chosen must be a member of parliament. _____________________ FORUM Bullet I: Admin The President has the responsibility of administration of Atlantia's forum and as such is the only admin (excluding SO, the forum leader). This is to stop abuse of administrative powers by non-elected bodies. Bullet II: Moderators All ministerial forums will be moderated by their appropriate minister and any nominated deputies. The Parliamentary forum as mentioned will be moderated solely by the Parliamentary Chairperson. Non-governmental organisations may be given forum areas but have no influence over parliament or government moderation. _____________________ AMENDMENTS Bullet I: Amendments Amendments may be made to the constitution by vote of parliament. They must achieve supermajority (66%) and at least 5 "Yes" votes. _______________________________ Atlantic Territory Law.DEFERED Article I: Atlantic Map. §1 Atlantia exists of a chain of isles based on the RL Antillian Islands and surrounding isles. §2 In total Atlantia contains 122 isles, all sawn on the Atlantic Map. §3 The region of Atlantia provides a map, which can only be changed by Senate, in a forum compartment called Atlantic Society & State. §4 The map need to conducted so that there are more map-related options possible in the future. §5 Territory is a basic good of a state. Therefor the Atlantic map will be used as regional surplus. The amount of surface of the Atlantic Homeland can only be changed by 2/3 of the Senate and can only be radicaly replaced by 3/4 of the Senate and an immediately alternative version. To abandon a map and in the meanwhile territory there will be needed 3/4 of the Senate and unanimity of the government. _____________________________ Atlantic Fiscal Law.DEFERED Art I: The Atlantic Currency. §1: All Atlantian currency is produced and distributed by the Atlantic Government. §2: The official currency of Atlantia is the Reichkrone. §3: The Ministry of Internal Affairs is responsible for the official currency. Art II: The Reichkrone. §1: The Reickrone has a diameter of 2 cm, with in the middle a hole with diameter 5 mm. The coin is 1 mm thick. §2: The Reichkrone is made of 100% Silver. §3: The frontside contains the number 1 (in Arabic) and the abbreviation RK (in Latin). §4: The backside contains the word Atlantia in a bow arround the middle. _______________________ Atlantic Colonial Law. Article I: The definition of a Colony. §1 The colony is a region on NS in hands of Atlantia. This peculiar region is Atlantic territory. §2 The nations with residence in a colony are called colonials by Atlantic Law. §3 Colonials have no vote, nor have they the right to take Atlantic Jobs. §4 Colonies will not have their own laws, nor have their own institutions. §5 Colonies are foreign territories and therefor under the ruling of the minister of foreign affairs. §6 Military, Diplomatic Puppet Nations should be staying in a colony or protectorate region. Unless they are from other regions than Atlantia herself. §7 Colonies can be used for any purpose, including military training. §8 Regions become Atlantic colonies when: they give there ruling power to the region, the power is taken over with military action, the region died and is refounded with colonial purposes. Althought allways the permission off the Senate is needed to gain territory. Article II: The definition of a Protectorate. §1 Each Colony can become a Protectorate. §2 The nations with residence in a protectorate are called Protectorative Atlantics by Atlantic Law. §3 Protectorative Atlantics have all Atlantic Civil and Political rights given by Senate. §4 Protectorates will not have their own laws, nor have their own institutions. §5 Protectorates are foreign territories and therefor under the ruling of the minister of foreign affairs and Senate. §6 Protectorates can be used for any purpose, excluding military training. §7 Regions become Atlantic colonies when: they give there ruling power to the region or the Senate says so. Article III: The definition of a Status Aparte. §1 Each Protectorate can become a Status Aparte. §2 The nations with residence in a Status Aparte are called Exta-Territorial Atlantics by Atlantic Law. They can also have there own regionality given by Minister of Internal Affairs. §3 Extra-Territorial Atlantics have all Atlantic Civil Rights and all Political rights given by Senate. §4 Status Apartes can have their own laws and institutions, allways given by by Senate. But they can't be given the right to have their own highest court, head of state, army, territorial organisation or civil and political rights. §5 Status Apartes are internal territories and therefor under the ruling of the minister of internal affairs, Senate and their own institutions. §6 Status Apartes can't be used for any purpose different than the Atlantic Main Region can be used for. §7 Regions become Atlantic colonies when a Senate and a local referendum say so. Article IV: The Colonies, Protectorates and Status Apartes of Atlantia. §1 The Colonies of Atlantia are: Verenigde Nederlanden (United Netherlands). §2 Atlantia has no Protectorates yet. §3 Atlantia has no Status Apartes yet. _____________________________________ Altantic General Forum Law.DEFERED Article I: The Forum Composition. §1: Changes to the forum composition can only be made by law or every conclusion with equal status. This action will count to garantee the continuity of Atlantia. §2: The Forum contains 4 categories: General; Government; Parties & Organisations; Ministries & State Machinery. Article II: The Admin-Moderators. §1: Atlantia has three Admin-Moderators. §2: The Admin-Moderators are South Oceana, The Nike Swoosh & Upscale Cruises. §3: Admin-Moderators lose their function after 9 weeks inactivity, then the most experienced Atlantic forum member takes over. §3 BIS: Most experienced means oldest membership, longest administrator and/or moderator functioning in Atlantia. §4: The Admin-Moderators have no other duties or responsibilities than adminstrators and moderators. They have no special status. Article III: The Administrators. §1: 9% off the total Atlantic Forum Members are Administrator. §2: The appointment of new adminstrators belongs to the ministry of internal affairs. §3: As of Art.III,§2 the minister can also fire administrators by virtue of law. Article IV: The Moderators. §1: Moderators, other than Admin-Moderator, are allways elected by the citizenry. §2: Moderators are given their powers for specific actions and forum regions by law and according to their duties and responsabilities. §3: Moderators are only created when it benefits Atlantia's way of progress. __________________________________ Atlantic Institutional Law.DEFERED Article I: The Form of Government. §1: The Region of Atlantia is a hereditary kingdom with a king or queen as head of state. §2: The heritage is according to registration on the Atlantic Forum. §3: The heritage happens by dying on NS, moving of region, abdication or royal death. §4: Royal death means the nation is death as in it role of head of state. This happens one a RL royal family member dies, is born or is taken into hospital. §5: The crown prince or princess can reject the heritage. §6: The king of Atlantia is South Oceana, the crown prince is The Nike Swoosh, the second in line is Deutsch Rammstein. §7: The king has exclusive the power given by law. §8: The king shall take also a RL name as royal pseudonym (ex: Childeric of Franconia III). The citizenry can give the king or queen a suffix name (ex: Childeric the Noisy). |
