It'll be an interesting fight for sure. But we're 11 months away from the inauguration of the next President. When President Obama does make his nomination, and sends them to the Senate for Conformation I'm not sure I understand the Republican Argument "Allow the American People to elect a President to nominate his successor"? We did, in 2012. We elected President Obama for a four year term. It is within that term and therefor the President has a constitutional obligation to make a nomination. Of course the Senate then has a constitutional obligation to confirm that appointee. But that's only if the Senate holds themselves to the same standard they continue to hold the President to.

Perhaps Obama should work with the Republican majority Senate to choose a candidate that is acceptable to both? The American people saw fit to elect a Republican majority Senate, so the idea that Obama has a mandate from 2012 to do what he wants when it comes to appointments does not hold water.

The Senate absolutely has an Obligation to confirm SC Nominees, and I think the late Justice Scalia would laugh at the idea they do not.

as to your second point, the short list for Scalia's replacement is Judge Sri Srinivasan who The Senate voted 97-0 to confirm just two and a half years ago. So the President does have a candidate acceptable to both. :)

The Senate does have an obligation, though. They have an obligation to vote on it. They have no obligation to approve it. The Constitution obligates the Senate to advise and consent. Not to refuse to advise.

Perhaps Obama should nominated whomever the hell he wants because he's the President, as R and D Presidents before him have done. The American people may have elected more Republicans in 2014 to give them a majority in Congress, but... that paints a false picture, too. If we want to argue the will of the American people, let's be honest in that the added total of the votes for those in the Senate is: 99,985,000~D to 96,443,000~R. Obama won with 5,000,000 more votes than Romney did. I would say the President is on pretty solid ground to invoke, and use, the constitutional authority granted to his office to name and nominate a successor to Justice Scalia. Should Congress try to stall it. Good, let them. And we'll win in November, gaining back the Senate and keeping the White House.
