Clients of the Banking Klan recognize all that the Banking Klan recognizes, and agree to abide by the following policies. Trade Policy a) Value is defined as anything of utility and finite supply as valuable. The following shall be considered valuable: - Intellectual Property - Services - Endorsements - Votes - Loans - Money - Insurance Policies b) Trading and Lending: Anything of value may be traded or lent. - Nations must make a written agreement (Contract) describing the nature of the transaction, and agreeing to the agreement. - When a transaction succesfully concludes, Nations must make a written statement (Receipt) of successful conclusion. - Contracts and Receipts must also have the dates included in them. - Screenshots must be taken of all Contracts and Receipts to prevent Nations from altering them. - The screenshots will be used for anti-counterfeiting, anti-theft, anti-fraud, and enforcing Contracts. - It is the Nations' responsibility to prove their own cases, but they may be represented. - Non-Existent Nations will have their assets transferred to the Banking Klan. c) Financial Crimes: The Banking Klan will enforce any violations below, if the violation is proven in The Court. - Donations: Giving money in exchange for nothing of value is illegal. - Counterfeiting: Nations may not copy/paste or otherwise alter anything of value. - Theft: Nations may not take something that does not rightfully belong to them. - Misrepresentation: Nations may not say anything untrue of another Nation, unless explicitly mentioned that it is an opinion. - Fraud: Nations may not conceal information or deceive other Nations. - Contracts: Nations must abide by any written agreement they have agreed to. - Proven violators become Property Nations of whoever they violated. - Property Nations must obey their Parent Nations. - Parent Nations may trade or lend their Property Nations to other Nations. - Property Nations have the right to trade their way out of "Property Status". d) Intellectual Property: Legally recognized exclusive rights to creations of the mind. - Copyrights: Nations may claim ownership of any written work by placing "© - (Insert Nation Name)" in their work. Copyrights may be traded or lended. - Patents: Nations may claim ownership of any idea by first writing it, and placing "℗ - (Insert Nation Name)" in their work. Patents may be traded or lended. - Trademarks: With the exception of Region Corp's logo and motto, Nations may claim ownership of any sign, design, or expression, by placing "TM - (Insert Nation Name)" next to it. Trademarks may be traded or lended. - Intellectual Property must be claimed by the inventor by posting a detailed description of it in a folder that will be created in the forum, for record-keeping. e) Services: Any proveable course of action done by one Nation for the benefit of another Nation. f) Endorsements: Clicking "Endorse" on a Nation's page. g) Votes: Politicians may trade and lend votes. - Politicians have 1 vote for each proposal, and thus, cannot give more than 1 vote. - Politicians who give their vote to another Councilor may not vote on the proposal that follows the trade. - Politicians can receive as many votes as they can from other Councilors, but must give something in return to each of them. - Politicians who receive a vote from another Councilor have the right to use that vote, as well as their own. g) Money: Anything valuable may be bought using money. - Both Nations must agree to the currency used. - Both Nations must include screenshots of their transactions in their Receipts. d) Loans: Nations may lend anything of value, and ask for more of it in return (Interest). - Loans can be sold and traded. - Nations may not borrow if they cannot pay back. It is their own responsibility to make sure they can. - If a Nation does not pay back the loan to a lender, that Nation becomes a Property Nation of the Lender. - Parent Nations may not order their Property Nations to transfer any wealth to the Parent. e) Insurance Policies: Nations may assume the risk of another in exchange for a fee. - Insurance Policies may be sold. - Insurance Policies are contracts subject to Clause c) Contracts. Corporate Policy a) the Banking Klan hereby recognizes Corporations: - Corporations are separate entities equal to Nations and subject to the same Laws as Nations, unless mentioned otherwise. - Corporations may be founded by Nations or other Corporations, by posting a Declaration of Incorporation. - Declarations of Incorporation must include all relevant information, as applicable. This includes but is not limited to: The Founders; the shareholders; the price of 1 share at last sale; company policies; agreements between shareholders; the dividends if any; a link to the Corporation's bank account if more than 1 shareholder; whether or not the Corporation has dissolved. - Corporations must keep their Declaration of Incorporation updated at all times. - Corporations may have their own forums. - Corporations are made of shares owned by Nations or other Corporations. - Shares signify ownership in a company and entitles the shareholder(s) to receive dividends. - The Banking Klan recognizes shares as valuable. - Dividends are proceeds of a Corporation's profits paid out to its shareholders. - Shareholders must be paid dividends. Employees are paid salaries and/or commissions. - Shareholders may not be held responsible for the actions of their Corporations. - Dissolving a Corporation means to stop all operations and transfer everything the Corporation owns to its shareholders, spread according to their share distribution. To declare a dissolution, Corporations must simply update their Declaration of Incorporation. - If a Corporation is inactive after 2 weeks, all assets will be transferred to the Banking Klan. - If a Corporation cannot pay back its debt, it must sell its shares to other Nations until the debt is paid back. If unable to do so, the Corporation must be dissolved. - If a Corporation commits a crime against a Nation or another Corporation, it will be dissolved unless the victim agrees to receive shares in the Corporation. Military Policy a) Raiding - Corporations may offer raiding services: - If a raid disrupts ties between the target region and the Banking Klan, the Corporation will reimburse any lost profits to the Banking Klan's partners who were directly affected by the raid. This does not apply if the raid is encouraged by the ITF Court. b) Occupying - Corporations may offer occupation services: - If an occupation disrupts economic ties between the target region and the Banking Klan, the Corporation will reimburse any lost profits to Banking Klan's partners who were directly affected by the occupation. This does not apply if the occupation is pre-approved by the ITF Court. c) Intelligence - Corporations may offer intelligence services: - Corporations may not gather and report intelligence about the Banking Klan - Corporations may not stage a coup against the Banking Klan - If a coup disrupts economic ties between the target region and the Banking Klan, the Corporation will reimburse any lost profits to the Banking Klan's partners who were directly affected by the coup. This does not apply if the coup is pre-approved by the ITF Court. d) Self-Governance - Private Military Corporations may govern their employees, as they see fit: - This does not apply if the Corporation is breaking any laws, in doing so. - Corporations may apply any method necessary to ensure that its employees comply with the law. The Banking Klan Recognizes: - Judicial services provided by the ITF Court and Case Law Inc. - Rulings reached by private judges - Verdicts reached by private juries - Mistrials declared by the Banking Klan Verdicts are reached by de facto innocence until declared ''proven guilty'' before a jury; a simple majority vote will determine the outcome. Judges may dismiss a case, in the absence of evidence. Trials must be restarted if the Banking Klan declares mistrial.
