Amendment V. Speaker Reform

Now that the major hurdle is out of the way, we can begin the most necessary task of fixing the rest of the Constitution so it can function properly. To that end, I propose the following amendment for the consideration of the League of Nations:

Amendment V. Explicit Creation of the Role of Speaker of the League of Nations

UNDERSTANDING that regular moderation of the League of Nations is necessary,

ACKNOWLEDGING that the current form of the Constitution of the Second Republic of New Sorvun is virtually silent about such a role,

and RECOGNIZING that in the portion that does mention this role, it is severely limited and fairly vague as to what this role's duties are, and what powers this role has to perform such duties,

THEREFORE, the League of Nations of the Second Republic of New Sorvun formally and explicitly creates this role now titled "Speaker of the League of Nations" in the following fashion:

Addendum: The following shall be added to the Constitution of the Second Republic of New Sorvun immediately following Article II. Section II. Subsection II.
Quote:
 
Subsection III. The Speaker of the League of Nations.

In order to insure effective and efficient flow of business within the League of Nations, the office of Speaker of the League of Nations ("Speaker") is necessary.

  1. Election: The Speaker is elected by general election
    1. Candidates must be eligible members of the League of Nations. The Lord Chancellor nor any Judicator can hold the position of Speaker
    2. The Speaker has a term of three months, and the election will be held at the same time as the Lord Chancellor elections

  2. Duties: The Speaker is entrusted with the following duties:
    1. Moderate the League of Nations, the Legislative Archives and all committees created by the League of Nations.
    2. Enforce all Resolutions passed by the League of Nations
    3. Organizing the floor of the League of Nations.

  3. Powers: The Speaker is endowed with the following powers:
    1. Create the League Rules of Order
      1. The League Rules of Order dictates the time allotted to each phase of the legislative process, defines acceptable conduct by all participates and the necessary requirements for parliamentary procedural items such as motions.

    2. Classify proposals according to the appropriate committee.
    3. Close Inactive Proposals: If a proposal on the floor of the League of Nations has gone inactive for thirty (30) days, the Speaker may consider the proposal as rejected and therefore close the proposal and remove it from the floor of the League of Nations.
    4. Censure: If a member of the League of Nations is disrupting business, the Speaker may submit a Motion to Censure to the League of Nations which temporarily removes or prohibits a member of the League of Nations from participating in the discussion and/or voting phase. The maximum duration shall be no more than thirty (30) days. Motions to Censure must be approved by a three-fifths (3/5) simple majority of the League of Nations.
    5. Vote on all proposals.


Reduction: The following shall be struck from the Constitution of the Second Republic of New Sorvun, and apply the necessary re-numeration and stylizing of the affected portions:

Subsection I. Legislative Process.

The LoN shall follow this procedure to effectively conduct business.

1.) Any citizen (regardless of membership) save for Judicators, can present proposals to the floor of the LoN.


2.) The LoN must elect a Speaker to moderate. The Speaker can not vote except in the case of ties.

3.) The Speaker can establish the House Rules at the beginning of his term, with the consent of the LoN.

4.) The time table must be established and agreed upon by the LoN, prior to any conduction of business. Any changes to the time table must be voted upon before enacting.


5.) Should a Directive be passed by the LoN, it is sent to the Lord Chancellor's Office for signage or veto. If he is on official leave, the Directive will remain in his office until he returns, otherwise the Lord Chancellor must either sign or veto the directive within five (5) days. If a decision has not been made by the Lord Chancellor in that time, it will be assumed passed into Law.




This clearly defines what the Speaker is, what it can do, and how it can do it, plus it removes the voting limitation, so the Speaker can also vote on proposals. I also proposed having it an elected position so Speakers will be motivated to remain active, should this amendment pass, the first election for Speaker will be January 15th alongside the Lord Chancellor, High Judicator and FRA Representative elections, so Tzipi will remain Speaker until then.

Also just as a sidenote, personally, I'd prefer if future proposals follow a similar writing style as I have done, so they will not only look more official, it helps in reducing confusion and perhaps motivate some of the RP-oriented members to be more involved since they are essentially "role-playing" as a member of the legislature. (However this can be discussed elsewhere, at a different time, and should have no bearing on the actual proposal itself.)

Okay let me break it down. Prior to Amendment IV. The only people that could vote in the League of Nations were those who played in RPs.

Now, currently the only RPs we have are:

Darom (Tzipi)
Svunbrink
Baal
Brum Brum
Kenneth Williams
Likako A. Nehio
Deckard Christopher
Roy_Mustang

Now, Darom can't vote because he's the Speaker, Deckard can't vote because he's the Lord Chancellor, and Kenneth and Svunbrink can't vote because they are Judicators, so that leaves:

Baal
Brum Brum
Likako A. Nehio
Roy_Mustang

Out of those four: BB, myself, and Roy has voted and the current version of the Constitution (prior to Amendment IV):

3.) Constitutional Amendments require a two-thirds absolute majority (2/3 of all voting members) in the LoN to gain approval.


And unless I missed some other eligible voters, 3 out of the 4 members that are eligible to vote, have voted in the positive which is a 75% majority > 66.7% majority. Of course the only person with the legal authority to verify this is Kenneth.

Now that the heavy lifting of building the Commonwealth is over, can we get back to business here. We have more active citizens than ever, and it is time we take advantage of it. It is really important that this amendment be passed prior to the upcoming election on January 15th.

Indeed, especially since our original speaker had resigned, it has become ever more pertinent to pass this amendment.

With that said, I would like to hear from our new Atrigean brethren (and perhaps our natives as well) on the legislation itself, i.e. don't just approve of it based solely on necessity, but also look at the proposal itself and be sure the effect of it are agreeable.

I think the process laid out here is far too rigid. Selecting speakers, and more importantly replacing inactive ones, should be a speedy and easy process. Mandating term limits and general elections does the total opposite.

What term limits do you mean Tsruh? The term is three months, meaning that they need to win re-election every three months is about all. I don't think that's a terribly high bar to overcome if a Speaker is doing their job well.
