Herein lies the Constitution of Dethklok 1000

The Constitution of The Federation of Dethklok 1000.

Preamble:
This Act of Constitution declares the unity and harmony of the nations of The Federation of Dethklok 1000. We are in concordance that all the states, cultures, tribes and peoples, and the representatives thereof are equal and to be considered no less. We are committed to PROTECT one another, to SERVE our common interests, to grant JUSTICE to our peoples, to DEFEND our individual’s FREEDOM, to conspire together for the cause of TOLERANCE and to manifest, protect and increase the WELFARE and PROSPERITY of all those who are a part of The Federation of Dethklok 1000. We stand together, united, strong together and declare to ourselves and the world that The Federation of Dethklok 1000 PREVAILS.

Article I: - Membership

Section One - The Nations of The Federation:
1. The Federation of Dethklok 1000 refers to the body which all nations have joined by having signed this constitution and agreeing to its terms.
2. All Nations who ratify this constitution are considered as rightful citizens of The Federation of Dethklok 1000 and are subject to its laws and receive its privileges
3. Nations who become members of the Federation of Dethklok 1000 agree to its laws.
5. Nations who become members of the Federation of Dethklok agree to treat all citizens and peoples of other nations as if their own, and will not restrict the freedoms and movements of others.

Section Two - New Nations:
1. Should a nation wish to join the Federation of Dethklok 1000, they must become a citizen of the region and ratify the constitution of the Federation. The Head of The Executive Council (Either the Founder or the WA Delegate) must approve their citizenship once they have been identified as a legitimate nation.
2. New Nations may not be duplicate accounts of existing nations or puppets of previously banned nations.

Section Three - Rights of the Citizens
1. No administrative official (Admin) shall have the right to delete or tamper with any posts made by any citizen unless empowered to do so by the law.
2. Citizens have a freedom of idea, expression and speech unless it is inappropriate, offensive, or against the constitution and law.
3. All citizens shall have their right to have their privacy protected, unless engaged in a criminal trial.
4. Citizens accused of a crime are guilty until proven innocent, rather than innocent until proven guilty.
5. No law shall be made against a particular citizen, nor shall laws be designed to attack any particular citizen.
6. Citizens have a right to be protected under the law.
7. Citizens have a right to an active government. Should any government official fail to remain active for a minimum of seven days, any citizen may bring up a charge of dereliction of duty against them, punishable by removal from their current position.
8. Citizens have a right to a legitimate government. Any government official found guilty of any offense against the citizens by the Judicial Council shall be immediately punished by the Judicial Council
9. All Citizens may run or vote in elections and referendums, unless otherwise restricted by law.
10. All citizens shall have 48 hours notice before any vote or election.

Article II - The Executive Branch

Section One - Executive Power:
1. Executive Power is defined as the power to:
i) Edit laws drafted by citizens.
ii) Approve any draft made by a citizen (by a majority - 51% or more).
iii) Refuse any draft made by a citizen (by a majority - 51% or more).
iv) Present any final version of a law before The Legislative Council.
iv) Order the repeal of any existing legislation (by a majority - 51% or more).
v) Propose amendments to this constitution.
vi) Draft any amendments to the constitution.

Section Two - The Executive Council:
1. Executive Power in the Federation of Dethklok 1000 is invested in The Executive Council. (See 2.1.1).
2. The Members of The Executive Council shall be elected by a first-past-the-post system during an election lasting no more than 48 hours. The top candidates by number of votes will become the members of the Executive Council. From the elected members of the Executive Council, The Head of The Executive Council (to be known as “The WA Delegate” or “Chief”) will be elected by a majority-by-elimination (also known as an Exhaustive ballot) election. (See 2.3.1) (See Article 6). There will also be a Vice WA Delegate that will serve under the WA Delegate.
3. The Executive Council will consist of 4 to 6 members and will be very exclusive.
4. The Executive Council may be abbreviated as “TEC”.
5. The Head of The Executive Council shall have a weighted vote in The Executive Council that will count as 2 votes. (See 2.3.13).
6. The Executive Council will appoint a representative to present final versions of laws to The Legislative Council.
7. The Executive Council members will be elected in elections held six weeks apart and staggered with the other Council.
8. The Executive Council will among themselves, elect a Supreme Chancellor. (See 2.4)

Section Three - The Head of The Executive Council:
1. The Head of The Executive Council shall be an elected member of The Executive Council. (See 2.2.2)
2. The Head of The Executive Council may be alternatively known as “WA Delegate” or “Chief”.
3. The Head of TEC shall be the highest power in The Federation except for the Founder, who must approve the WA Delegate.
4. The Head of TEC shall swear to uphold the Constitution and all laws created.
5. The Head of TEC shall have the following powers
i) The power to declare a state of emergency.
ii) The power to announce a military alert.
iii) The power to authenticate a declaration of war.
iv) The power to sign foreign treaties.
v) The power to propose amendments to the constitution.
vi) The power to form embassies between The Federation of Dethklok 1000 and other regions,
6. The Head of TEC shall be allowed to name an Acting WA Delegate to take up the responsibilities and duties of the WA Delegate for up to a week, but for no longer than a week. This period shall be known as a “Delegational Leave Period”.
7. If the responsibilities and duties are handed over to an Acting WA Delegate a period of time must be specified. At the end of this period power must be handed back to The WA Delegate/Head of TEC. The Head of TEC may take back power at any point during the period.
8. A Delegational Leave Period may be renewed at its end but a new Acting WA Delegate must be made.
9. An Acting WA Delegate retains all their current portfolios and voting powers during a Delegational Leave Period.
10. The Head of TEC is allowed to eject or ban nations, but may only do so under judicial review or during a state of martial law.
11. The Head of TEC will have the authority to declare an act of war or martial law, with a vote from the The Legislative Council, in times of invasion, at which he will be allowed to lock the region by password and eject, but not ban, any and all nations that have attempted to invade. Martial Law can last no more than two days unless authorized by The Legislative Council, and this authorization must be re-enacted every two subsequent days until the crisis subsides. Any nations ejected must be justified by the Head of TEC, and any abuse of the power may end in a charge of treason and removal from office.
12. The Head of TEC will not have any power to obstruct the legal process or any criminal proceeding to change this document or any other law apart from his/her vote in The Executive Council.
13. The Head of TEC shall have a weighted vote in The Executive Council equivalent to two normal votes. (See 2.2.5).

Section Four - The Supreme Chancellor: (See 2.2.8)
1. The Supreme Chancellor will be elected within The Executive Council.
2. Apart from electoral duties, the Supreme Chancellor will have no extra power.
3. The Electoral Duties that the Supreme Chancellor must perform are as follows:
i) The Supreme Chancellor must organize candidates for all elections. (See Article 6)
ii) The Supreme Chancellor must confirm the dates and times for all elections at least 36 hours before they begin. (See 1.3.9)
iii) The Supreme Chancellor must ensure that all elections begin no fewer than 40 days (960 hours) and no more than 44 days (1056 hours) after the last election.
iv) The Supreme Chancellor must ensure that all elections begin no fewer than 12 days (288 hours) and no more than 16 days (384 hours) after the last set of elections.
v) The Supreme Chancellor must police all election threads and count up the results.
4. The Supreme Chancellor must inform the Head of The Executive Council if he is to be unable to carry out elections.
5. The Supreme Chancellor may also be known as the "Viceroy".

Article III - The Legislative Branch

Section One - Legislative Power: (See 3.4)
1. Legislative Power is defined as the power to
i) Vote on laws presented to The Legislative Council by The Executive Council. (by a majority vote - 51% or more) (See 2.1.1.i).
ii) Vote to repeal laws if requested by The Executive Council. (by a majority vote- 51% or more).
iii) Approve amendments to this constitution (by two-thirds vote - 67% or more).
iv) To reject amendments to this constitution (by two-thirds vote - 67% or more).
v) To approve the declaration of martial law (by a majority vote- 51% or more).
vi) To revoke martial law (by a majority vote- 51% or more).
vii) To approve the writing of a new constitution (by a unanimous vote - 100%).
viii) To remove the WA Delegate by unanimous vote. [added 5th February 2014]

Section Two - The Legislative Council:
1. Legislative Power in The Federation of Dethklok 1000 is invested in the The Legislative Council. (See 3.1.1).
2. The Legislative Council will be elected in the same manner as The Executive Council. (See 2.2.2) (See Article 6).
3. Should a seat be vacated in The Legislative Council a by-election will be immediately held.
4. Proceedings in The Legislative Council shall be conducted by The Head of The Legislative Council.
5. The Legislative Council may be abbreviated as “TLC”.
6. The Head of TLC may be alternatively known as the “Chief of TLC”.
7. The Legislative Council will consist of 5 to 9 members.

Section Three - The Head of The Legislative Council:
1. The Head of The Legislative Council shall conduct proceedings in The Legislative Council.
2. The Head of The Legislative Council shall be the spokesperson and face of The Legislative Council.
3. The Head of The Legislative Council shall be more commonly known as the “Chief of TLC” (See 3.2.6).
4. The Council Magistrate shall be elected by The Members of The Legislative Council.
5. The Council Magistrate shall not have a weighted vote.

Section Four - Legislative Duties: (See 3.1)
1. The Legislative Council shall have the power to write, debate, and vote on legislation including revisions to the constitution.
2. The Legislative Council is required to record all debates and make all records including debate and creation of laws publicly available at all times.
3. All Councilors are required to be present for the final reading of an Act, and for the final vote that will pass it into law and will be summoned as such.
4. Legislation, minus amendments, will only pass when a simple majority of the Legislative Council votes to approve it and it is written into law by The Chief of TLC.
5. The Legislative Council will have the power to add, or change portions of this Constitution. Changes to the constitution must be by absolute rounded two-thirds majority vote (67% or more) of the Legislative Council. After passing, the region will vote in a referendum on the changes. The referendum is to last no longer than seven days.
7. The Legislative Council, on behalf of the citizens of Dethklok 1000, shall have the right to issue a vote of no confidence regarding any member of the civil government. An absolute rounded two-thirds majority vote will remove any public official from their position.
8. The Legislative Council has the power to bring about any legislation which affects the region as a whole, protects the region from exploitation, and benefits the region as a whole.

Section Five- Limits of Powers:
1. No law shall be made retroactively. No nation shall be convicted of an act that was made illegal after they committed it, but the current system of trial and legal proceedings may be used to find guilty a citizen committing an act previous to the institution of this Constitution.
2. No law shall contradict the Constitution.
3. The constitution shall not be changed simply to allow the passing of legislation, amendments must be further justified.

Section Six - Powers Prohibited by Nations:
1. No nation may pass a law that contradicts the constitution or any law passed by the Legislative Council.
2. No single nation may engage in representative relations with a foreign power or declare hostility against another region without official authority from the Head of The Executive Council.
3. No single nation may declare war against another region or nation except through the legal means herein.

Article IV - The Judicial Branch

Section One - Judicial Power:
1. Judicial Power is defined as the power to:
i) Try any citizen brought before the Judicial Council with sufficient evidence.
ii) Convict any citizen of crime if proven guilty (by a majority vote - 51% or more).
iii) Decide acceptable punishment for crimes (by a majority vote).
iv) Repeal any sentence once a citizen has been acquitted (by a majority vote).
v) Acquit any citizen of a crime if proven innocent (by a majority vote).

Section Two - The Judicial Council:
1. Judicial Power in The Federation of Dethklok 1000 is invested in The Judicial Council.
2. The Judges of the Judicial Council shall be elected in the same manner as The Executive Council. (See 2.2.2) (See Article 6)
3. The Head of The Judicial Council shall be known as The Head Justice.
4. The Head Justice shall not have a weighted vote.
5. The Judicial Council shall consist of 3 members.
6. The Judicial Council's decision is final and may only be repealed and re-tried by order of a two-thirds vote by Legislative Council or Executive Council
(but neither may change the Judicial Council's decision).
7. Any Judicial Council decision may only be repealed once.
8. The Judicial Council may be abbreviated as “TJC”.

Section Three - The Head of The Judicial Council:
1. The Head of The Judicial Council shall be an elected member of The Judicial Council. (See 4.2.2)
2. The Head of The Judicial Council shall conduct proceedings in The Judicial Council.
3. The Head of The Judicial Council shall be more commonly known as the “Head Justice”.
4. The Head Justice shall conduct proceedings in The Judicial Council.
5. The Head Justice shall not have a weighted vote. (See 4.2.4)
Section Four - Trials and Jurisdiction:
1. The Judicial Council is expected and encouraged to hold trials as soon as possible.
2. The accused are innocent until proven guilty, but the Judicial Council must not delay the beginning of a trial longer than one week. If they do then the nation must be allowed freedom until they can be tried.
3. If the nation cannot be brought to the Judicial Council for trial within 1 week, then he shall be tried.
4. If the accused is found guilty by TJC then they must choose an appropriate sentence and enforce it.
5. No nation’s court may overturn the decision made by the Judicial Council.
Section Five - Lawful and Due Process:
1. Any citizen shall be allowed to bring any other citizen before the Judicial Council with acceptable evidence
2. Citizens may not simply accuse another citizen of a crime, they must provide evidence.
3. No citizen may accuse another citizen of crime simply for their own personal gain (a gain made if they are convicted or defamed).
4. Any citizen may defend another citizen who has been accused of a crime or request that a sentence be repealed.
5. Any nation that has broken a law in our region will be brought before a court, and may have posting permissions restricted if deemed necessary by the Supreme Judge.
6. The accused will still have access to the forums and will have the opportunity to defend themselves in court immediately after they are brought before the court.
7. If the accused is found not guilty, they shall be not restricted or punished in any form. .
8. If a citizen is badly defamed but proven innocent then that citizen may have a fresh start in the Republic with a new nation and a new forum account. Only the incumbent President at the time of the fresh start shall have the knowledge of whom that citizen is.
9. If found guilty, the President and administrators are to ensure that the punishment by the courts is enacted.
10. Treason, defined as the unnecessary endangerment of the region, shall be immediately punished.

Article V – Amendments
1. Any citizen, regardless of their position, may propose an amendment to the constitution; however an absolute rounded two-thirds unanimous vote from the Legislative Council must follow, then to be posted for public referendum for no longer than seven days, in which it must achieve a simple majority. Upon being signed by the President, the amendment will take immediate effect.
2. An amendment may add to the constitution or overwrite anything already written herein.
3. The Executive Council (by two-thirds majority - 67% or more) may propose the writing of an entirely new Constitution, but it must be approved by a unanimous vote from the Legislative Council, and an absolute unrounded four-fifths (80% or more) referendum vote.

Article VI - Election of Officials
1. Government Officials will be elected in staggered elections six to nine weeks apart.
2. The Order of Election will be as follows; Executive Positions; Legislative Positions; Judicial Positions.
3. Elections will be organized by the Supreme Chancellor. (See 2.4)
4. Citizens who wish to be a Candidate they must inform The Supreme Chancellor before a set cut-off date.
5. All positions except for President will be elected by a first-past-the-post system.

Article VII - The Regional Capital
1. The Federation of Dethklok 1000 will have a regional capital.
2. The Constitution must be amended to change the regional capital. A new clause will be added each time to create a new capital.
3. The first capital will be Thunderhorse.

Article VIII - The National Anthem
1. The national anthem can be changed when voted to be changed by a majority of the citizens.

The Constitution of Yulis following the Election and Terms of Government Officials Act (Passed 16th March 2014).
The Election and Terms of Government Officials Act states that "[the] Constitution shall be modified accordingly to accommodate the changes outlined in this act" (2.9). The changes required by the Act mean that it is best to display a new document with the changes made as well as the previous constitution to display the changes in a tidier way. iii) The Viceroy must ensure that all elections begin as close to 60 days after the last election.

3. Should a seat be vacated in The Legislative Council a by-election will be held if two or more vacancies arise. [Modified 16th March 2014]
4. Proceedings in The Legislative Council shall be conducted by The Head of The Legislative Council.
5. The Legislative Council may be abbreviated as “TLC”.
6. The Head of TLC may be alternatively known as the “Chief of TLC”.
7. The Legislative Council will consist of 5 to 9 members.
8. The Viceroy may confirm the exact size before an election, but by-elections may be held mid term to add more members. [Added 16th March 2014]

Section Three - The Head of The Legislative Council:
1. The Head of The Legislative Council shall conduct proceedings in The Legislative Council.
2. The Head of The Legislative Council shall be the spokesperson and face of The Legislative Council.
3. The Head of The Legislative Council shall be more commonly known as the “Chief of TLC” (See 3.2.6).
4. The Chief of TLC shall be elected by The Members of The Legislative Council.
5. The Chief of TLC shall not have a weighted vote.
6. The Chief of TLC may vote a second time to break a tie. [Added 16th March 2014]

Section Four - Legislative Duties: (See 3.1)
1. The Legislative Council shall have the power to write, debate, and vote on legislation including revisions to the constitution.
2. The Legislative Council is required to record all debates and make all records including debate and creation of laws publicly available at all times.
3. All Councilors are required to be present for the final reading of an Act, and for the final vote that will pass it into law and will be summoned as such.
4. Legislation, minus amendments, will only pass when a simple majority of the Legislative Council votes to approve it and it is written into law by The Chief of TLC.
5. The Legislative Council will have the power to add, or change portions of this Constitution. Changes to the constitution must be by absolute rounded two-thirds majority vote (67% or more) of the Legislative Council. After passing, the region will vote in a referendum on the changes. The referendum is to last no longer than seven days.
7. The Legislative Council, on behalf of the citizens of Dethklok 1000, shall have the right to issue a vote of no confidence regarding any member of the civil government. An absolute rounded two-thirds majority vote will remove any public official from their position.
8. The Legislative Council has the power to bring about any legislation which affects the region as a whole, protects the region from exploitation, and benefits the region as a whole.

Section Five - Limits of Powers:
1. No law shall be made retroactively. No nation shall be convicted of an act that was made illegal after they committed it, but the current system of trial and legal proceedings may be used to find guilty a citizen committing an act previous to the institution of this Constitution.
2. No law shall contradict the Constitution.
3. The constitution shall not be changed simply to allow the passing of legislation, amendments must be further justified.

Section Six - Powers Prohibited by Nations:
1. No nation may pass a law that contradicts the constitution or any law passed by the Legislative Council.
2. No single nation may engage in representative relations with a foreign power or declare hostility against another region without official authority from the Head of The Executive Council.
3. No single nation may declare war against another region or nation except through the legal means herein.

Article IV - The Judicial Branch

Section One - Judicial Power:
1. Judicial Power is defined as the power to:
i) Try any citizen brought before the Judiciary with sufficient evidence. [Modified 16th March 2014]
ii) Convict any citizen of crime if proven guilty. [Modified 16th March 2014]
iii) Decide acceptable punishment for crimes. [Modified 16th March 2014]
iv) Repeal any sentence once a citizen has been acquitted. [Modified 16th March 2014]
v) Acquit any citizen of a crime if proven innocent. [Modified 16th March 2014]

Section Two - The Judiciary: [Modified 16th March 2014] – previous and subsequent use modified
1. Judicial Power in The Federation of Dethklok 1000 is invested in The Judiciary.
2. The Judiciary shall be appointed by the Legislative Council.

3. The Head Justice shall not have a weighted vote.
4. The Judiciary shall consist of 3 members.
5. The Judiciary's decision is final and may only be repealed and re-tried by order of a two-thirds vote by Legislative Council or Executive Council
(but neither may change the Judiciary's decision).
6. Any Judiciary decision may only be repealed once.

7. “Judiciary” may refer to all three Judges collectively or to simply the Judge responsible for a certain decision.
9. Any Judge may make a decision on behalf of the Judiciary, but they must ultimately answer to the Head Justice. [Added 16th March 2014]

Section Three - The Head of The Judiciary:
1. The Head of The Judiciary shall be an elected member of The Judicial Council. (See 4.2.2)
2. The Head of Judiciary shall conduct proceedings in The Judiciary.
3. The Head of The Judiciary shall be more commonly known as the “Head Justice” or “Supreme Judge”. [Modified 16th March 2014]
4. The Head Justice shall conduct proceedings in Judiciary.
5. The Head Justice shall not have a weighted vote. (See 4.2.4)

Section Four - Trials and Jurisdiction:
1. The Judiciary is expected and encouraged to hold trials as soon as possible.
2. The accused are innocent until proven guilty, but the Judiciary must not delay the beginning of a trial longer than one week. If they do then the nation must be allowed freedom until they can be tried, that is, nothing may be imposed on them on account of their accusation. [Modified 16th March 2014]

3. If the accused is found guilty by the Judiciary then they must choose an appropriate sentence and enforce it.
4. No nation’s court may overturn the decision made by the Judiciary.

Section Five - Lawful and Due Process:
1. Any citizen shall be allowed to bring any other citizen before the Judiciary with acceptable evidence
2. Citizens may not simply accuse another citizen of a crime, they must provide evidence.
3. No citizen may accuse another citizen of crime simply for their own personal gain (a gain made if they are convicted or defamed).
4. Any citizen may defend another citizen who has been accused of a crime or request that a sentence be repealed.
5. Any nation that has broken a law in our region will be brought before a court, and may have posting permissions restricted if deemed necessary by the Supreme Judge.
6. The accused will still have access to the forums and will have the opportunity to defend themselves in court immediately after they are brought before the court.
7. If the accused is found not guilty, they shall be not restricted or punished in any form. .
8. If a citizen is badly defamed but proven innocent then that citizen may have a fresh start in the Republic with a new nation and a new forum account. Only the incumbent President at the time of the fresh start shall have the knowledge of whom that citizen is.
9. If found guilty, the President and administrators are to ensure that the punishment by the courts is enacted.
10. Treason, defined as the unnecessary endangerment of the region, shall be immediately punished.

Article V – Amendments
1. Any citizen, regardless of their position, may propose an amendment to the constitution; however an absolute rounded two-thirds unanimous vote from the Legislative Council must follow, then to be posted for public referendum for no longer than seven days, in which it must achieve a simple majority. Upon being signed by the President, the amendment will take immediate effect.
2. An amendment may add to the constitution or overwrite anything already written herein.
3. The Executive Council (by two-thirds majority - 67% or more) may propose the writing of an entirely new Constitution, but it must be approved by a unanimous vote from the Legislative Council, and an absolute unrounded four-fifths (80% or more) referendum vote.

Article VI - The Regional Capital
1. The Federation of Dethklok 1000 will have a regional capital.
2. The Constitution must be amended to change the regional capital. A new clause will be added each time to create a new capital.
3. The first capital will be Thunderhorse.

Article VII - The National Anthem
1. The national anthem can be changed when voted to be changed by a majority of the citizens.

Article IX - Election of Government Officials [Added 16th March 2014]
1. Government Officials shall be elected, appointed or otherwise placed into power following the terms outlined in the 'Election and Terms of Government Officials Act'.
2. All Elections and Appointments of Government Officials shall be organised by the Viceroy, following terms outlined in the 'Viceroy Act'.
