Procedural Rules of the Senate Section 1: Responsibilities of Senators 1. In accordance with the Constitution, the Senate shall be comprised of five senators. The Senate shall do business with a quorum of five senators. If quorum cannot be reached, any senator can motion to waive quorum. If such motion is seconded and thirded, a vote shall take place. 2. Senators who are unable to vote on legislation or participate in a Roll Call must declare a leave of absence prior to their absence. Such leave of absence declarations must be as specific as possible to ensure the smooth operation of the Senate. 3. If a senator does not declare a leave of absence or does not return when specified in their declared leave of absence, any senator has the right to motion for the expulsion of said member. 4. The absentee senator shall have the right to defend their absence upon their return. No vote of expulsion shall be held until the senator has had the opportunity to offer a defense or until seven days have elapsed since the senator fell absent. 5. Once the absentee senator has defended his or her absence or seven days have passed since the motion for expulsion, the remaining senators shall hold a vote of expulsion. The absentee senator shall be expelled from the Senate if all four senators vote for his or her expulsion. 6. In accordance with the Constitution, a special election shall be held to fill the vacant seat of an expelled senator. The expelled senator has the right to appeal his or her expulsion to the Senate prior to the opening of voting in said special election. 7. In the event that a tie shall occur due to abstention, absenteeism, or other circumstances, the General Secretary of the Assembly shall cast a tie-breaking vote. The General Secretary shall not cast votes in the Senate under any other circumstances. Section 2: The Duties of the Speaker and the Bill Process 1. In accordance with the Constitution, it shall be the duty of the Speaker to lead the Senate. Elections for Speaker shall be facilitated by the Sovereign or, in his absence, the Crown Prince/ss. Nominations shall commence immediately upon the beginning of a new Senate term and shall remain open for two days, after which senators shall immediately proceed to vote for Speaker. Voting shall remain open for exactly two days or until every senator has cast a vote, whichever comes first, at the end of which the new Speaker shall immediately take office. 2. Any senator is free to submit a bill for discussion without the approval of the Speaker. Senators are free to discuss a bill and suggest or make revisions. 3. Before a bill shall proceed to vote, the Speaker must proclaim it finished. Any senator may challenge this and proclaim the bill unfinished and in need of further revision. If this challenge is seconded and then thirded within one day of the initial challenge, the Speaker is required to give senators three more days to continue discussion. This extension can only be given once for each bill. At the end of these three days, or if no senator challenges the Speaker's initial proclamation of finished within one day's time, discussion on the bill shall be closed and the Speaker shall open voting. If a bill is deemed ready for vote but the Speaker has not given his proclamation, senators can force the bill to vote if a motion is made to open voting and then seconded and thirded. 4. A passed bill that originates in the Senate shall be immediately delivered by the Speaker to the Office of the General Secretary for consideration by the Assembly, while a passed bill that ends in the Senate shall be immediately delivered by the Speaker to the Office of the Emperor for his signature. 5. Upon receipt of nominee(s) for confirmation, the Senate shall conduct a hearing to question the nominee(s) and to discuss the nomination(s). Confirmation hearings shall generally last for two days, but any senator may make a motion to either close or extend a hearing. If a motion to close is seconded and then thirded the hearing shall be closed and senators shall proceed to vote on the nominee(s). If a motion to extend is seconded and then thirded that hearing shall be extended for no more than two additional days before senators shall proceed to vote on the nominee(s). 6. Voting on any bill shall remain open for exactly two days or until every senator has cast a vote, whichever comes first, at the end of which voting shall end and the results shall be revealed. A bill that has been passed shall come into effect according to the provisions of Article IV, Section 4 of the Constitution or, in the case of internal Senate matters, immediately after passage. Section 3: Committees 1. It shall be the responsibility of the Speaker to determine whether the Senate shall participate in joint committees with the Assembly and to decide which senators shall participate in said committees. |
