Forum Administration Act Section 1: Definitions 1. For the purposes of this Act, forum administration shall be defined to include: a) Administrators: Royalty and nobility who have been granted access to the Administrative Control Panel (Admin CP) for the purpose of the overall administration of the forum and law enforcement. b) Global Moderators: Government ministers who by virtue of their offices shall be granted global moderation over all forums and subforums only during their term(s) of office, for the execution of their governmental duties and law enforcement. c) Forum Moderators: Government ministers, imperial officials, legislative leaders, and judges who by virtue of their offices shall be granted moderation over specific forums and subforums only during their term(s) of office for the execution of their duties; foreign dignitaries who shall be granted moderation over their embassies; and private citizens who have been granted moderation over specific forums and subforums for the purpose of regional participation. 2. Unless otherwise indicated, whenever any provision of this Act refers to forum administration that provision shall apply collectively to any and all subsets of forum administration. Whenever any provision of this Act refers specifically to one or more subsets of forum administration that provision shall apply only to the subset(s) referenced. Section 2: Administrators 1. The Sovereign shall also be the Root Administrator. Should the Sovereign leave office, the Crown Prince/ss shall become the Root Administrator until a new Sovereign can be elected in accordance with the provisions of Article II, Section 2.4 of the Constitution of Exshaw. The Root Administrator shall be immunized against criminal prosecution and/or civil suit. 2. The Sovereign shall appoint at least one additional administrator from the Council of Nobles. Any administrator(s) appointed by the Sovereign shall be liable to prosecution or suit for any act of Administrative Abuse as defined by Section 2(4) of the Exshaw Criminal Law and as regulated by this Act. Section 3: Global Moderators 1. The following offices shall have global moderation over all forums and subforums: a) Prime Minister; b) Deputy Prime Minister; c) Attorney General. 2. The Prime Minister and Deputy Prime Minister shall be granted global moderation by administrators immediately upon certification of their election by the Sovereign and/or the Crown Prince/ss and for the entire length of their term(s), except as provided for by this Act. 3. The Attorney General shall be granted global moderation by administrators immediately upon confirmation by the Senate and for the entire length of his or her term(s), except as provided for by this Act. 4. Any global moderator shall be liable to prosecution or suit for any act of Administrative Abuse as defined by Section 2(4) of the Exshaw Criminal Law and as regulated by this Act. Section 4: Forum Moderators 1. Government ministers and imperial officials shall be granted forum moderation by administrators over the relevant forums and subforums immediately upon confirmation by the Senate, if applicable, and for the entire length of their term(s), except as provided for by this Act. 2. The General Secretary of the Assembly and the Speaker of the Senate shall be granted forum moderation by administrators over the forums and subforums of the Assembly and Senate respectively, and jointly over the forums and subforums of Parliament Hall, immediately upon certification of their elections according to the procedural rules of their respective chambers or, in the absence of such rules, upon certification of their elections by the Sovereign and/or the Crown Prince/ss, and for the entire length of their term(s), except as provided for by this Act. 3. Judges shall be granted forum moderation by administrators over the forums and subforums of the Royal Court of Exshaw immediately upon confirmation by the Senate and for the entire length of their term(s), except as provided for by this Act. 4. Upon approval by the relevant administrator and/or officeholder, foreign dignitaries shall be granted forum moderation by administrators over the embassies created for the regions of which they are representatives and for as long as provided for by future legislation or by executive order. 5. Private citizens may be granted forum moderation over non-governmental forums and subforums for the purpose of regional participation at the discretion of and for the duration determined by the Prime Minister, relevant government minister(s), and/or administrators. 6. Any forum moderator shall be liable to prosecution or suit for any act of Administrative Abuse as defined by Section 2(4) of the Exshaw Criminal Law and as regulated by this Act. Section 5: Forum Administration Regulation 1. Imminent threat to the existence of the forum presented by a grievous violation of the Zetaboards Terms of Service shall constitute just cause for the editing of a topic, post, and/or forum account, or the information contained therein, and/or the deletion of a topic and/or post. Any administrator who edits a topic, post, and/or forum account, or the information contained therein, or deletes a topic and/or post shall take screen shots of the offensive material to be preserved as evidence for criminal proceedings. There shall be no just cause for the deletion of a forum account. 2. Law enforcement as prescribed by executive order and/or statute and/or implementation of sentences rendered by the Royal Court of Exshaw shall constitute just cause for accessing a member account without express permission. 3. Any administrative request that requires forum administration to access a member account and/or acceptance of election or appointment to any office that requires forum administration to access a member account shall constitute express permission to access a member account. 4. Proper authorization to edit any law in such a way that would alter the meaning of the text shall only be granted by statute. Proper authorization to edit the Constitution of Exshaw in such a way that would alter the meaning of the text shall only be granted by constitutional amendment. 5. Forum administration shall be empowered to edit any law to correct spelling and/or grammatical mistakes or to insert relevant links provided that such edits do not alter the meaning of the text and provided that all edits are properly documented and publicly posted. Forum administration shall not edit the Constitution of Exshaw to correct spelling and/or grammatical mistakes or to insert relevant links unless authorized by constitutional amendment. 6. Forum administration shall immediately close any topic in which a crime is reported or suspected to have been committed. 7. Forum administration shall be empowered at their discretion to move any topic that is posted in an inappropriate forum or subforum to a more appropriate forum or subforum; to split any and all off-topic posts in a topic into one or more new topics; to archive topics that have not been replied to in 30 days or longer or that have otherwise clearly reached their completion; to archive unused forums or subforums after an appropriate period of time; and to approve or deny any administrative request provided that such approval or denial does not violate statutory or constitutional law. 8. Forum administration shall not delete any forum or subforum unless expressly authorized by statute or by the Constitution of Exshaw. 9. Forum administration shall be empowered to carry out any and all responsibilities mandated by this or any other Act, by valid executive order, and/or by the Constitution of Exshaw. 10. Should any member of forum administration be charged with a crime, he or she shall have all forum administration access removed until such a time as he or she is found not guilty of said crime. Any member of forum administration who is convicted of any high crime and/or felony shall not have forum administration access reinstated. Any member of forum administration who is convicted of any misdemeanor shall not have forum administration access reinstated at least until his or her sentence has been served. Section 6: Forum Use and Access 1. Administrators shall be empowered to restrict posting access to any in-character roleplay forum or subforum pending agreement to Terms of Use established by the Minister of Culture, provided that such Terms of Use do not constitute unreasonable limitation of citizens' rights to freedom of speech and expression. Administrators shall further be empowered to remove posting access to any in-character roleplay forum or subforum for violation of the Terms of Use at the request of the Minister of Culture. 2. Administrators shall be empowered to create forums and/or subforums that are visible and/or accessible by password only to selected participants by their own initiative or at the request of the Prime Minister, the Deputy Prime Minister, government ministers, imperial officials, legislative leaders, and/or judges. All such forums and subforums must remain visible and/or accessible to administrators for the purpose of law enforcement. 3. Administrators shall be empowered to create subforums that are accessible by password only to members of each political party at the request of each political party's leadership. All such subforums must remain accessible to administrators for the purpose of law enforcement. Section 7: Severability 1. If a provision of this Act is or becomes illegal, invalid, or unenforceable, that shall not affect the legality, validity, or enforceability of any other provision of this Act. |
