Supreme Court Procedure Act
§ 1 Definitions
1. trial - the process wherein the Supreme Court examines a case in order to reach a verdict
2. verdict - the Supreme Court's decision of the defendant being either guilty or not guilty
3. defendant - the party of a trial that is the target of the plaintiff's complaint or the prosecutor's charge
4. plaintiff - the party of a trial that makes the complaint in front of the Supreme Court
5. complaint - the act of blaming someone for conduct that should be punished or compensated
6. prosecutor - the Minister of Justice, the regional official responsible for charging someone seen to have committed a crime compromising common interests
§ 2 Jurisdiction of the Supreme Court
1. Jurisdiction of the Supreme Court is limited to cases wherein all defendants and plaintiffs were members or citizens of the United Republic of Nations at the time of the alleged inappropriate conduct or crime.
2. Defendants and plaintiffs may be persons, nations, or groups of persons or nations such as political parties or associations.
3. Non-citizens fall in the jurisdiction of the regional President, according to the Constitution.
4. The impeachment of Ministers falls in the jurisdiction of the Federal Council or the Constitutionality Review, according to the Constitution.
§ 3 Composition of the Supreme Court
1. It is required that three (3) judges participate in a trial.
2. If a judge is unable to participate in a trial (e.g. if he is the defendant or plaintiff), the vice judge takes his place.
3. The composition of the court shall not be changed amidst an ongoing trial, even if new judges are appointed.
§ 4 Appointment of the judges
1. After a new Federal Council has been elected, the Minister of Justice must initiate the appointment process of judges.
2. The previously appointed judges shall serve until new judges are appointed.
3. The Federal Council shall, during its term,
i. publicly announce that regional member nations may apply for becoming a judge
ii. interview or otherwise compare the applicants to find the best
iii. make a suggestion listing one (1) president of the court, two (2) other judges and one (1) vice judge
4. The judges shall be approved by the nations of URoN:
i. there must be seven (7) days voting time
ii. nations may vote either for or against the Council's suggestion
iii. the suggestion is approved if over 1/2 of voters support it
iv. if the suggestion is rejected, the Council must make a new suggestion
5. If a judge is permanently incapacitated, the Council shall appoint a new judge without need for the approval of member nations.
§ 5 Who can be judge
1. Neither the President of URoN nor the Minister of Justice can become judge.
2. No more than one of the nations serving as judge can simultaneously have membership of the Federal Council.
3. If a nation becomes member of the Council, it shall immediately lose its position as judge.
§ 6 Sentencing
1. The possible punishments to be ordered by the Supreme Court include but are not limited to:
i. permanent banishment from the region
ii. temporary ban from the forum, taking away the possibility of voting and discussing for a defined time period
iii. a form of compulsory community service
2. The sentence shall not be harsher than the harshest punishment demanded by the prosecutor or the plaintiff, but it can be milder.
