Constitutional Amendment Act – Fourth Amendment (2014)

The following bill, proposed by Senator CGJ, shall be up for debate at least until 29/3/14, unless closed earlier by a majority vote.

Constitutional Amendment Act – Fourth Amendment (2014)

An Act to amend the Constitution of the Independent Order.

Short Title

(1) This act may be referred to as the Constitutional Amendment Act – Fourth Amendment (2014).

Amendments

(2) Section (16) shall be amended thusly:

"(16) Any proposed bill or act shall be debated in the Senate for seven days, after such time any Senator may move to vote on the bill. The Speaker may move to vote on the bill before the elapsed time period. If a majority of the Senate supports the motion the Speaker must move the bill to vote within twenty-four hours.”

(3) Section (24) shall be amended thusly:

“(24) The Cabinet shall be made up of a number of portfolios. The Premier may create and/or abolish portfolios at his/her discretion, however, it must consist of at least the following portfolios:
The Minister of Culture
The Minister of Foreign Affairs
The Minister of Armed Forces
The Minister of Justice”

Additional notes:

1) I'd like to draw attention to section (2). Despite just writing it, I'm uncertain of how it's worded and think it could be clearer. In addition, do people want that power to be limited to the Speaker or any member of the Senate?

2) While section (3) is in response to the petition, I'd also like to propose abolishing the Minister of Culture as an essential portfolio.

I support the spirit behind the Bill, although I suggest against a version which removes the Minster of Culture as an essential portfolio.

Promoting further cultural development and engaging the members in that development is important to the region as a whole. In real life cultures are what defines a people, and I feel that it is much the same for a regional community. We're seeing a boon of activity across the region, and it's best to have a Minister of Culture in place to work with members new and old as we see further development, and perhaps evolution, in that regional culture.

Thus my view of the Minister of Culture as an essential portfolio stands.

So your saying that Senators must receive confirmation from the Speaker to move it to vote before 7 days, but if it happens within 24 hours, the Speaker is obligated to do so? I'm just a little confused, that's all.

It allows the Speaker to bring the vote forward before the 7 day time period has elapsed.

That is how it works, officially, in the Constitution:

(13) Any proposed bill or act shall be debated in the Senate for no less than seven days, after such time any Senator may move to vote on the bill. If a majority of the Senate supports the motion the Speaker must move the bill to vote within twenty-four hours.


Both you and I interpreted this as a guideline, but to avoid any potential issues in future, it probably should be altered.

If the petition achieves this, then the proposed bill or act may only be voted on after seven days after original submission; otherwise the bill or act may progress normally.”
