The following bill, proposed by Senator CGJ, shall be up for debate at least until 4/10/14.

By-Election Procedures Act (2014)

An Act to outline the procedure following a vacancy in the Senate.

Short Title

(1) This act may be referred to as the By-Election Procedures Act (2014).

Early Vacancies

(2) If a seat is vacated within the first 23 days of the start of the Senate term, then it shall be known as an early vacancy.

(3) Following an early vacancy, the Grand Chancellor shall create a list of potential candidates to fill it.

(4) The Grand Chancellor shall then hold a by-election, using the Supplementary Vote system as defined in the Electoral Systems and Procedures Act (2014).

Late Vacancies

(5) If a seat is vacated following 23 days of the start of a Senate term, then it shall be known as a Late Vacancy.

(6) Following a late vacancy, the Grand Chancellor may, at his discretion, hold a by-election or manually appoint another member to fill it.

I would suggest the following changes, in bold:

Currently they're appointed by the Grand Chancellor in all cases.
And coming from the Senator that was appointed BY the Grand Chancellor ;)

On a serious note, the reasoning behind the nomination list is that to use another system (such as an open ballot) would require another change to the Constitution.

I disagree. If we were to pass this act first then the Expansion Act would be in contravention of this act. This act requires the Grand Chancellor to hold elections for vacant seats. The Expansion Act, if passed afterwards, would create two vacant seats. Logically this act would require the GC to hold elections for those seats, while the Expansion act would require him to appoint the members.

I disagree. If we were to pass this act first then the Expansion Act would be in contravention of this act. This act requires the Grand Chancellor to hold elections for vacant seats. The Expansion Act, if passed afterwards, would create two vacant seats. Logically this act would require the GC to hold elections for those seats, while the Expansion act would require him to appoint the members.
Parliamentary sovereignty, E :) If one Act contradicts another, then the newest act takes precedence.
