The following bill shall be up for debate until at least 1/8/2014

Line of Succession Act (2014)

An act to allow for the continuation of stable government in The Independent Order under extreme circumstances.


Short Title

(1) This act may be referred to as the Line of Succession Act (2014).

Procedures

(2) Should the Office of the Premier and the Office of the Vice Premier simultaneously fall vacant, or the incumbents fall inactive without having declared an official Leave of Absence, or under any other extreme circumstances, the Office of the Premier shall be assumed by the citizen listed the highest in the Line of Succession, under the provision that they are legally and officially confirmed as per Section 4 of this Act.

(3) Any citizen listed in the Line of Succession may refuse to assume the Office of the Premier, in which case the Office of the Premier shall be assumed by the next-highest listed member in the Line of Succession, under the provision that they are legally and officially confirmed as per Section 4 of this Act.

Devolvement of the Office of the Premier

(4) Where a citizen accepts the devolvement of the Office of the Premier upon them, said citizen must be confirmed by the Grand Chancellor, or by the Vice Chancellor in the Grand Chancellor's absence, to assume the Office of the Premier.

(5) In the event that the Grand Chancellor or Vice Chancellor is incapable of providing the aforementioned confirmation for a citizen to assume the Office of the Premier, said confirmation shall not be required for the citizen in question to assume the Office of the Premier.

Implementation of the Line of Succession

(6) The Line of Succession is hereby implemented, and shall be listed as follows:

1. The Speaker of the Senate
2. The Attorney General
3. The Minister of Defence
4. The Minister of Home Affairs and Integration
5. The Minister of Foreign and Imperial Affairs
6. The Minister of Accountability
7. The Minister of Culture
8. The Deputy Speaker of the Senate

Other/Emergency Procedures

(7) Should all citizens listed in the Line of Succession refuse to assume the Office of the Premier, a special election to fill the Office of the Premier shall be held immediately after the citizen listed lowest in the Line of Succession has refused to assume the Office of the Premier.

(8) The winner of said special election shall assume the Office of the Premier until the end of the original term.

Okay, I am generally opposed to this bill, at least in its current form.

1) The Premier is not the highest office of the land. Unlike the President of the United States, or even the Grand Chancellor here, a line of succession is not necessary because ultimately the GC can appoint someone to replace the Premier. I think it would be best, if both the Premier and Vice Premier were to become absent, for an Acting Premier to be appointed by the Grand Chancellor. Early Vacancies would trigger another election, late vacancies can hold onto the position until the next Premier elections.

2) It eliminates, in its current form, the Premier's ability to create, merge, split or dissolve ministries as it fixes the positions in law. This would be unconstitutional.

3) It also gives rank to Cabinet positions, making some more important than others. I, as Premier, appoint people into positions I believe they are suited for. I don't want to have people appointed for political power-play.

4) It solidifies in law the position of the Speaker as a party-political player, which is exactly the opposite direction I'd personally like to see the Speaker go.

Aside from that, I would propose creating a Line of Succession Act for the position of Grand Chancellor, at least on an interim basis.

As well as what CGJ says I also think the fact it does not define how long an absence needs to be for this to kick in is an issue. For Senate positions we have a limit as we've just sadly seen with E, I believe this bill would need something to bring it in line with that.

(FYI: I didn't really intend my draft to be the final bill. I merely wanted to present the Line of Succession Act as an idea that we could work on.)

Alright, here goes my version of the Bill:

Succession Act (2014)

An act to allow for the continuation of stable government following the demise of the Chancellory or vacancy of the Premiership, and to amend the Vice Chancellor Act (2014).


Short Title

(1) This act may be referred to as the Succession Act (2014).

Demise of the Chancellory

(2) Should the Grand Chancellor of the Independent Order go inactive for a period of seven (7) days without an official declared leave of absence, there shall be a demise of the Chancellory.

(3) Pursuant to the Vice Chancellor Act (2014), if the Vice Chancellor is unable to assume the Chancellory, then the Chancellory shall be assumed by members of the Privy Council by the date of joined the Independent Order.

(3) A member of the Privy Council entitled to assume the Chancellory may defer the position, in which case it shall be assumed by the next entitled member.

(4) Sections (2) and (3) shall remain pursuant to Section (3) of His Majesty’s Declaration of Abdication Act (2014).

Vacancy of the Premiership

(5) Should the position of Premier become vacant, then, pursuant to Section (28) of the Constitution of the Independent Order, the Vice Premier shall inherit the power, authority and responsibility of the position accordingly.

(6) Should the office of the Vice Premier also become vacant, then the Grand Chancellor shall be responsible for appointing an Acting Premier to inherit the power, authority and responsibility of the Premiership.

(7) The Vice Premier’s position shall become vacant following a resignation or if the Vice Premier does not log in to the forum for a period of seven (7) days without a declared Leave of Absence.

(8) Should there be an Early Vacancy of the Premiership, as defined by Section (2) of the By-Election Procedures Act (2014), then an immediate Premier Election shall be called by the Grand Chancellor.

(9) Should there be a Late Vacancy of the Premiership, as defined by Section (5) of the By-Election Procedures Act (2014), then the Acting Premier shall, at their discretion, continue to hold the position of Acting Premier until the next due elections.

(10) Section (8) shall not apply following the declaration of either a Level One or Level Two State of Emergency, as defined by The Emergency Procedures Act (2014).

Amendments

(11) The following section shall be added after Section (3) of the Vice Chancellor Act (2014):

“(4) Following a demise of the Chancellory, the Vice Chancellor shall be named the Grand Chancellor, and shall inherit the power, authority and responsibility of the position accordingly.”
