By-Election Procedures (Amendment) Act (2014)

An Act to amend the outline of procedures following a vacancy in the Senate in the By-Election Procedures Act (2014).


Be it enacted by Her Excellency the Grand Chancellor, by and with the advice and consent of the Senate, and by the authority of the same, as follows:

Short Title

(1) This Act may be referred to as the By-Election Procedures (Amendment) Act (2014).

Amendments

(2) Section (3) shall be amended thusly:

"(3) Following an early vacancy the Grand Chancellor shall, as soon as reasonably possible, create a list of at least two potential candidates to fill it"

(3) Section (4) shall be amended thusly:

" (4) This list shall automatically consist of any unelected candidates from the previous Senate election, as well as members who, within twenty-four (24) hours of the Grand Chancellor's announcement, nominate themselves for the seat.

(5) The Grand Chancellor shall then, following the twenty-four (24) hour nomination period, hold a by-election for forty-eight (48) hours using the following electoral systems, as defined in the Electoral Systems and Procedures Act (2014):
(4.1) If there are two candidates in the by-election, a simple plurality voting system; or
(4.2) If there are more than two candidates standing in the by-election, the Supplementary Vote electoral system."

I'm all for giving the Grand Chancellor the authority to draw up a list of candidates- however, and this is just a thought, why don't we open up the opportunity to run to anyone who qualifies?

My reason is that in the most recent by-election the two candidates were the two members who failed to get into the Senate at the previous election that just seems to be a little too much of a restricted field. So yes while I think allowing the GC the authority to draw up an initial list is a good idea in that it would ensure the vacancy is filled I would suggest we in addition open it up to others.

Agreed with Ach, by-election candidates are usually generated from those who ran from senate and didn't get seat, or that's what I thought. If not then it may be nice to have a specific method for choosing by-election Candidates.

What about saying those who missed getting elected are automatically on the list and anyone else has 24 hours to nominate themselves before voting begins?

(3)Following an early vacancy the Grand Chancellor shall, as soon as reasonably possible create a list of at least two potential candidates to fill it. This list shall consist of any unelected candidates from the original election as well as any member who nominates themselves within 24 hours of the announcement of the vacancy.

To provide a bit of context as to why the By-Election Procedures Act is being amended: The act currently prescribes that should a By-Election be held, we use the Supplementary Vote electoral system. At the time, apparently it was beyond reason for myself and other Senators to consider that the list of candidates may only be two.

So, this Amendment thus far changes:

(4) The Grand Chancellor shall then hold a by-election, using the Supplementary Vote system as defined in the Electoral Systems and Procedures Act (2014).


To:

(3) Following an Early Vacancy, the Grand Chancellor shall, as soon as reasonably possible, create a list of at least two potential candidates to fill it.

(4) The Grand Chancellor shall then immediately hold a by-election for forty-eight (48) hours using the following electoral systems, as defined in the Electoral Systems and Procedures Act (2014):
(4.1) If there are two candidates in the by-election, a simple plurality voting system; or
(4.2) If there are more than two candidates standing in the by-election, the Supplementary Vote electoral system.


So as a matter of amending Section (3) further, I would support Dave's amendment though with a bit of shifting about:

Quote:
 
(3) Following an early vacancy the Grand Chancellor shall, as soon as reasonably possible, create a list of at least two potential candidates to fill it.

(4) This list shall automatically consist of any unelected candidates from the previous Senate election, as well as members who, within twenty-four (24) hours of the Grand Chancellor's announcement, nominate themselves for the seat.

(5) The Grand Chancellor shall then, following the twenty-four (24) hour nomination period, hold a by-election for forty-eight (48) hours using the following electoral systems, as defined in the Electoral Systems and Procedures Act (2014):

I would also recommend taking a look at the original act here to see if there are further amendments you'd like to ma–wait, what do you mean I'm not allowed to speak here?
