Mr Speaker, members of the Senate. I today present the following Order of the Premier for consideration, I remind the Senate that this Order is nothing to be afraid of since the final say rests with the legislature. Today this the very first such order concerns the first Judicial appointment of the order and backdates the establishment of the bench to include the other two people who presently hold a judicial position, in short should the Senate pass this Order then we're finally getting a bench . The appointments are in accordance with section (39) of the Constitution as amended by section (20) of the Judiciary Act which states "The Premier, with the consent of the Senate, shall appoint judges to, or remove judges from, office.” As Premier I therefore propose the following:
Brief explanation the main appointment is that of Hobbes he goes in at the lowest level of the Judiciary though this may be subject to change if the Chancellery will enlighten me as to whether he is on the Privy Council or not. If he is then this Order will be subject to amendment Myself and Rhodes I know for certain are on the Privy Council, this is the back dating point- Rhodes is presently the Attorney General and I was the Attorney General when the Judiciary Act was passed into law so both of us are qualified by that point, given that we currently as government ministers can't hold the position of a judge we must rely on the exception to the rule which has been established to be members of the Privy Council sitting as the appeal court. It is for this reason that myself and Rhodes would go in at the Appellate level, this also establishes that we have a judge of first instance and appeal court judges. Mr Speaker I therefore place this order before the Senate and request it be put to a vote at the chambers earliest convenience. Premier Achkaerin Edited by El Presidente, 6th July 2015 - 08:43 AM.
