CHARTER AMENDMENT SUBMISSION FORM Formal Name of Submitting Nation(s): Kingdom of Dartfordia & South Hills Council of Governments Title of Submission: Simplification of Security Council Appointment rules

Article 22
1. The Security Council shall consist of three permanent members of Commonwealth Treaty Organisation and a maximum of three non-permanent members elected by the General Assembly, with due regard being specially paid to the contribution of Members of the Commonwealth Treaty Organisation to the maintenance of international peace and security and to the other purposes of the Organisation. A nation may not stand for any seat in the Security Council when a national is acting as Secretary General. 2. Permanent members shall be nominated by the Security Council and elected, by majority, by the General Assembly. 3. Non-permanent members of the Security Council shall represent, and be elected by a majority of, members within a geographical region determined by the General Assembly, for a term of three years. 4. A retiring non-permanent member shall not be eligible for immediate re-election, and permanent members may not run for non-permanent seats. 5. Each member of the Security Council shall have one representative. 6. The Security Council shall only convene when there are more than fifteen members of the General Assembly, and when the Security Council is not convened, the powers and authority it shall be vested in the entire General Assembly. 7. A member of the Security Council may resign their seat, or, should it be determined by a vote of two-thirds of members of General Assembly that the member has acted contrary to the spirit or letter of the Treaty, or has otherwise acted in a way which undermines the ability and integrity of the Security Council or Commonwealth Treaty Organisation, be removed from their position on the Security Council. 8. Should a non-permanent vacancy occur within the first 18 months of a Security Council term, the Secretary-General shall organise an election to fill the vacancy. This election will take place in accordance with Article 22, Section 4, with the assumption that an elected member will serve a full term. 9. Should it occur in the latter 18 months of a Security Council term, then the Security Council may elect a nation in good standing, from the appropriate region, to sit on the Security Council. Article 22, Section 4 shall not apply in this instance, and it shall be assumed the member is not serving an official term. 10. Should a motion be brought forward to expel a member of the Security Council, the Secretary-General shall determine independently whether the immediate presence of the member in the Security Council would cause a conflict of interest, and should that be the case, the member shall be suspended from the Security Council until the conclusion of the General Assembly vote. 11. A member of the Security Council dismissed by the General Assembly shall be required to rectify the issues noted in the Dismissal Resolution before being allowed to stand in future Security Council elections. This shall be determined by a unanimous vote of the Security Council upon the recommendation of the Secretary-General.
Article 62
The Secretariat shall comprise a Secretary-General and such staff as the Organisation may require. The Secretary-General shall be appointed by the General Assembly for a term of three years, of candidates excluding those native of countries currently on the Security Council, renewable once, upon the recommendation of the Security Council, and may be removed from office with the concurrence of two-thirds of the members of the General Assembly. He shall be the chief administrative officer of the Organisation.
Explanation: Current rules are relatively complex and this seeks to simplify the rules and make them fairer.

Also I do not intend on this going to vote until after the presently vacant security council seat is filled, which will be done by Sec Gen presentation of nominee list to the GA

OC: My only suggestion is to have 'A nation may not stand for any seat in the Security Council when a national is acting as Secretary General.' moved to its own bullet point.

"Our Dartfordian colleague has a point. However we would like to take it further in an effort to clarify a point." Cheryl said looking around "The Security Council regardless of membership is now a Hybrid model, that comprises three permanent members and three elected members, now common sense easily blocks a non permanent member nation under this proposal simply because the Security Council elections are held after the Secretary General elections.
However what needs to be addressed is what happens if a national of a permanent member is elected Secretary General? I would submit that considering this proposal the only fair way to deal with that is for the permanent Security Council seat in that instance to be forfeit."

"May I suggest," the Dartfordian delegate spoke, "that perhaps the permanent seat would be rendered redundant for the period in which their citizen is Secretary-General? In this instance we would not need to discourage individuals from certain countries from taking the position of Secretary-General."

"A fair suggestion, we should also incorporate review of the Permanent Members." Cheryl said "This would allow the General Assembly to periodically assess whether the right nations are holding those permanent seats, because we cannot allow this organisation to become easily hamstrung again by inaction."

"Once in awhile the Secretary-General opens a session and allows members to discuss the contributions of each member and whether they should be stripped of, or maintain, their positions."

So presumably that would be at the Secretary General's discretion.
