The Constitution of the Royal Colony of Mediterrania

An act to create a sensible and organized government for the betterment and defense of the Royal Colony of Mediterrania.

Preamble

We, the citizens of the Royal Colony of Mediterrania, do hereby create this document to ascertain our right as a Colony of the Mazerian Empire, in order to provide for our Defense and Welfare, and to create an equal society for the betterment of the People.

Short Title

(1) This document may be referred to and/or cited as the Constitution of Mediterrania.

Royal Authority

The People

(2) This colony's official title shall be the Royal Colony of Mediterrania.

(3) The ability to govern the Colony of Mediterrania is recognized as a fundamental and sovereign right of the People.

The Emperor

(4) The Emperor of Mazeria is hereby recognized as the sovereign leader and the Head of State of the Royal Colony of Mediterrania.

(5) The Emperor has the right to administrate to forums and has the right (along with the Doge of Mediterrania), to ban and/or eject a nation as defined by law.

Executive Authority

The Doge

(6) In order to have practicality and an efficient Government, this Act herein by establishes the Office of the Doge of the Royal Colony of Mediterrania, who shall be elected by popular vote by the citizens of Mediterrania to a term not to exceed a period of two (2) months, and shall be the elected Head of Government, who will faithfully execute their actions and duties on behalf of said citizens.

(7) In the event of the incumbent Doge is unable to fulfill his duties, the next in the Line of Succession shall assume the Office until the event concludes. The procedures and means of when the next in the Line of Succession may assume this office may be defined by other legislation.

Line of Succession

(8) The Line of Succession shall be as follows:

Doge of Mediterrania
Secretary of Interior & Cultural Affairs
Secretary of Imperial Affairs
Secretary of Foreign Affairs
Chief Colonial Justice of Mediterrania
President of the Collegio

The Cabinet

(9) The Cabinet shall consist of five members: The Emperor, the Doge of Mediterrania, the Secretary of Imperial & Cultural Affairs, the Secretary of Imperial Affairs, and the Secretary of Foreign Affairs.

(10) In the execution of Government, on behalf of the citizens of Mediterrania, the Doge shall have the ability to appoint members to his/her Cabinet. Each member of the Cabinet shall have an effective function of the Government. Each member of the Cabinet, shall head a Ministry, which will be defined by their title. For instance, the Secretary of Imperial Affairs shall direct the Ministry of Imperial Affairs, and so forth.

(11) These Cabinet members may carry out policy actions and implement methods exclusive to their position in Government.

Legislative Authority

The Collegio

(12) The Collegio shall be the supreme legislative authority for the Royal Colony of Mediterrania.

(13) The main duty of the Collegio shall be to create, discuss, pass and amend any and all legislation that is created in Mediterrania, for the sole purpose of the continuation of the enforcement of the law and the effective governance of the Colony.

(14) The Collegio is empowered to pass, amend and repeal any and all legislation that is created in Mediterrania.

(15) The Collegio is allowed to create measures and guidelines for its own self-governance.

(16a) The Collegio is also empowered to approve or deny all appointments made by any elected office in the Colony.

(b) The Collegio is also empowered to remove any member of Government from office, if accused of misconduct or any negligence in official duties while in office, with a two-thirds (2/3) majority vote of no confidence.

(17) Citizens of the Colony have the right, to hold a referendum on the confidence of an elected office in Mediterrania at any point in time. Should the citizenry pass a motion of no confidence with a two-thirds (2/3) majority, that person shall be removed from office, along with any appointments he made to execute the duties of their office or of the Government.

(18) If an elected official is removed at least fourteen (14) days before the occurrence of elections, then new elections shall take place for that post. If, however, the removal of an elected official occurs within the time period of fourteen (14) days, then the Emperor shall appoint a caretaker for the remainder of the said term.

Executive Orders

(19) The Emperor and the Doge are empowered to enact Executive Orders that carry the full force of law in order to keep the functions of Government orderly and efficient, as well as to maintain civil order and peace.

(20) The Collegio has the right to repeal any Executive Order enacted with a two-thirds (2/3) majority. The citizenry also has that right to repeal an Executive Order, provided that that request is met with approval from a simple majority in the Collegio.

Responsibilities of the Cabinet

The Emperor

(21a) The Emperor shall:

(i) Maintain the Regional Message Boards (RMBs) with the use of the Colony's Founder Nation;
(ii) Vote in the Collegio when there is a tie;
(iii) Provide his signature to passed treaties with another region(s);

(b) The Emperor may carry out in parallel to, and has royal prerogative in matters of Foreign and Imperial Affairs, and may override such decisions made by the Government, or the Secretaries of Foreign and Imperial Affairs.

The Doge of Mediterrania

(22) The Doge shall partake in Cabinet discussions and direct governmental policy. The Doge shall act as a representative of the Royal Colony of Mediterrania in the Imperial Assembly. The Doge shall also have the sole right to sign any passed laws and amendments, provided they pass with a defined majority in the Collegio.

Secretary of Interior & Cultural Affairs

(23) The Secretary of Interior & Cultural Affairs shall oversee and direct any and all recruitment and welcoming efforts made by the Government.

(24) The Secretary shall also organize Festivals and non-Festival activities and events for the entertainment of the citizens of Mediterrania, as well as keeping and maintaining high levels of participation from the citizenry.

(25) The Secretary shall carryout orders made by the Doge or the Emperor.

Secretary of Imperial Affairs

(26a) The Secretary of Imperial Affairs shall:

(i) Discuss regularly with the Mazerian Imperial Secretary on matters of state and policy, as well as help maintain a recruitment script with the Secretary of Interior & Cultural Affairs and the Mazerian Imperial Secretary;
(ii) Represent the Royal Colony of Mediterrania, along with the Doge, in the Imperial Assembly;
(iii) Act as a liaison for the Doge to the other colonies of the Mazerian Empire.

(26b) The Secretary of Imperial Affairs shall also carryout any orders from the Doge or the Emperor.

Secretary of Foreign Affairs

(27a) The Secretary of Foreign Affairs shall be responsible for the Colony's Foreign Policy, including, but not limited to:

(i) Negotiating alliances and treaties with other regions, with a two-thirds (2/3) majority of the Collegio, and the explicit approval of the Emperor;
(ii) Constructing embassies (both in-game and forum) with other regions.

(27b) The Secretary of Foreign Affairs shall also carryout orders from the Doge or the Emperor.

Elections

Administration of Elections

(28) Elections shall be administrated by the Emperor, or the Crown Prince in his absence. If both are unable to administrate, then the Chief Colonial Justice shall administrate elections.

(29) If all three mentioned above are unable to administrate elections, then the Emperor, Crown Prince, or the Chief Colonial Justice may appoint an Administrator to oversee elections.

(30) Electoral Candidates may not administrate elections.

Procedure

(31) The Nomination/Campaign period for all Elections shall be opened seventy-two (72) hours before the scheduled voting period for said Elections.

(32) Voting for all Elections shall commence immediately after the closing of the Nomination/Campaign period, and shall extend for a period of time not to exceed forty-eight (48) hours.

(33) If in the event of a tie in any Election, a Runoff Election shall take place to break the tie.

(34) Runoff Elections shall immediately take place following the closure of the Election whose result they are a consequence of.

(35) If no candidate receives more than fifty (50) percent of the total votes cast, then the first and second place candidate shall have a Runoff Election held to decide the winner immediately after the voting period. If two or more candidates are tied for first or second place, then the Emperor shall break the tie. If the Emperor is unable to break the tie, then it shall fall to the Chief Colonial Justice to break it.

(36) In any Election where there is less than two candidates, 'None of the Above' shall become an option on the list of candidates.

(37) If 'None of the Above' has a majority, the Election in question will restart at the nominations/campaign Period and continue as stated by the relevant sections above. The incumbent holder of the Office being contested will continue to serve as an acting holder of that Office.

Repeals

(38) This Act herein by repeals the first Mediterranian Constitution, the Mediterranian Ministries Act, and the Collegio Secret Ballot Act.
