Proposed Charter of the Life Party
 
Preamble

The Life Party of Right to Life is a political organization that seeks the preservation of a free, democratic government within Right to Life, the protection of a laissez-faire, free market economic system within the region, and the advancement of the pro-life cause and traditional family values throughout NationStates and the World Assembly. In the hopes of advancing these ideals, the Party adopts this document as its official charter.


Section 1: Members of the Life Party

Article 1
Part 1: Members of the Life Party (hereinafter the Party) shall have the right to nominate the Council of the Life Party, vote in Party elections, and introduce petitions concerning the governance and organization of the Party.
Part 2: By holding membership within the Party, an individual agrees to abide by this Charter and any statutes that may be enacted by the Council of the Life Party (hereinafter the Party).

Article 2
Part 1: In order to apply for membership within the Party, an individual must be a citizen of Right to Life who has affirmed their support for the ideals of the Party and is not a member of any other political party within Right to Life.
Part 2: The Council shall review applications for membership within the Party and decide which individuals will be granted membership within the Party.
Part 3: If the Council determines that an individual fails to meet the criteria established in Part 1, it may, by majority vote, remove their membership within the Party.

Article 3
Part 1: Membership within the Party shall not be denied to any individual on account of their nationality, ethnicity, sex, or religious beliefs.
Part 2: If any individual feels that they have been denied membership within the Party, they may request that the Council review their application for membership. If the Council, by majority vote, determines that the Officer of Recruitment’s decision to deny said individual membership was in violation of Part 1 of this Article, it may grant said individual membership within the Party.


Section 2: Council of the Life Party

Article 4
Part 1: The Party shall be organized by the Council of the Life Party.
Part 2: The Council shall consist of three (3) members who are also members of the Party, one of whom shall act as Chairman of the Council of the Life Party (hereinafter the Council Chairman).
Part 3: The Chairman of the council shall act as the official leader of the Party. The Chairman shall be responsible for moderating debate within the Council and enforcing statutes enacted by the Council, and shall enforce verdicts in trials presided over by the Council.

Article 5
The Council may, by majority vote, enact, amend, or repeal statutes for the purpose of organizing and governing the Party.

Article 6
Part 1: The Council shall be responsible for managing the Treasury of the Life Party (hereinafter the Treasury), a corporation registered with the Bank of Right to Life that shall be responsible for managing the funds of the Party. It shall, by majority vote, enact statutes concerning the management of the Treasury.
Part 2: Each member of the Council shall hold 25 shares in the Treasury as long as they hold membership within the Council. Of the remaining 25 shares, five shall be given to Cocles, five to Ovybia, five to Phydios, five to Stellonia, and five to Xinxian. No individual shall be permitted to sell or give away their shares.
Part 3: The Council Chairman shall act as CEO of the Treasury.
Part 4: No individual may profit from owning shares in the Treasury, as the Treasury shall be a non-profit organization.

Article 7
Part 1: The Council may, by majority vote, remove one of its members from office. However, such a removal from office shall not go into effect unless it is approved in a Party referendum.
Part 2: Impeachments shall only result in removal from office.

Article 8
Part 1: The Council shall be responsible for trying individuals found to be in violation of this Charter or any statutes enacted by the Council. It may, by majority vote, convict an individual found to be in violation of one or more Life Party statutes and levy an appropriate sanction upon them.
Part 2: The Council shall be responsible for ensuring that any trials it presides over are fair and impartial.
Part 3: To avoid any conflict of interest, a member of the Council may recuse himself from presiding over a trail. By majority vote, the Council shall select another person who is not a member of the Council to hear the trial in their stead.
Part 4: If necessary, the Justice Court of Right to Life may be summoned to hear a case that would otherwise be heard by the Council.


Section 3: Nominations for the Council of the Life Party

Article 9
The Council shall be nominated in January, March, May, July, August, September, and November, during the final 96 hours of each of these months.

Article 10
Party members who wish to become members of the Council shall create a thread entitled “Nominations Thread for [account name]” in the Party subforum, with the name of their account on the Right to Life forums being substituted for [account name].

Article 11
Part 1: Party members may nominate as many individuals for the Council as they please.
Part 2: To nominate an individual for the Council, a party member shall post “I nominate [account name] for the Council” in the thread entitled “Nominations Thread for [account name]”, with the name of the nominee’s account on Right to Life being substituted for [account name]. Such threads shall be pinned to the top of the Party subforum for the entirety of the period in which the Council is being nominated.

Article 12
Part 1: The three individuals receiving the most nominations shall become members of the Council; the individual receiving the most nominations shall become the Council Chairman.
Part 2: In the event that a vacancy occurs in the office of Council Chairman, the individual who is eligible to serve on the Council and who received the next-most nominations in the previous nominations period shall take their place.
Part 3: In the event that a vacancy occurs in the Council, the individual who is eligible to serve on the Council and who received the next-most nominations after the last individual to be nominated to the Council in the previous nomination period shall take their place.

Article 13
In the event that two or more individuals receive the same number of nominations, the acting Council Chairman shall break the tie.

Article 14
The newly-nominated Council shall take office on the fifth day of the month following the nominations period.


Section 4: Primary Elections

Article 15
Before each presidential and senatorial election, the Party shall hold a primary election to nominate Life Party candidates to run in the election. These primaries shall begin 96 hours before the beginning of the nominations period, as designated by Right to Life law, and shall end at the beginning of said nominations period.

Article 16
Part 1: Party members who wish to run in a primary election shall declare their candidacies in a designated thread entitled “Declare Your Candidacy for the Presidential/Senatorial Election”, depending on whether the upcoming Right to Life election will be used to select the President or the Senate.
Part 2: The aforementioned thread shall open 96 hours before the beginning of the primary election and shall close immediately before the primary election. Said thread shall be pinned to the Party subforum during this time period.

Article 17
Part 1: One presidential candidate shall be nominated using the instant-runoff voting system.
Part 2: Two senatorial candidates shall be nominated using the single-transferable vote system; the quota for election shall be set using the Droop method.

Article 18
In the event that a tie occurs in an election, the acting Council Chairman shall break the tie.


Section 5: Petitions and Referendums

Article 19
Each party member shall have the right to formally introduce and sign petitions concerning the organization and governance of the Party.

Article 20
Party members may petition to hold a referendum on statute enacted by the Council, to hold a referendum to amend this Charter, or to re-open nominations for the Council, or to amend this Charter.

Article 21
A petition to hold a referendum on a statute enacted by the Council or to hold a referendum to amend this charter must be signed by one quarter of Party members within seven days of the petition’s introduction in order for the proposed referendum to be held.

Article 22
A petition to re-open nominations for the Council must be signed by a majority of Party members within seven days of the petition’s introduction in order to re-open nominations for the Council.

Article 23
In order to preserve the enactment of a statute that is being voted on in a referendum, a majority of all individuals voting in the referendum must vote in favor of the statute being voted on.

Article 24
In order to amend this Charter or affirm the impeachment of a member of the Council, at least two thirds of all individuals voting in the referendum must vote in favor of the amendment or impeachment in question.

Article 25
No referendum shall be valid unless at least half of all Party members vote in it.

I'm fine with having a three-seat Council, but four party officials on top of that? Are you sure you aren't going overboard with the offices? We only have eight members! If we do this, it'll have to be not only permitted, but normal to hold multiple offices- two, three, even four at a time.

Since our motto is Faith, Family, Freedom, I think you should include some description of exactly what is meant by that.

Also,

That's fine except for the last part, "religious beliefs." We have certain principles and if those principles aren't held by certain religious beliefs then we can't accept them (e.g. sodomy, freedom, and equal dignity of all men). For example, if someone says that he worships the devil, we certainly shouldn't let him into our party.

That's fine except for the last part, "religious beliefs." We have certain principles and if those principles aren't held by certain religious beliefs then we can't accept them (e.g. sodomy, freedom, and equal dignity of all men). For example, if someone says that he worships the devil, we certainly shouldn't let him into our party.
I agree. I think there should be a provision that states "...so long as said beliefs do not contravene the core principles of the Party."

I think that members of the Council should hold functional offices (such as Recruitment Officer, Discipline Officer (or Whip), Propoganda Officer, etc.), as well as being Council members. An article should also be written that provides for the appointment of additional Party Officials by the Council, who can also be deposed by majority vote of the Council.

There's this thing I wrote a while back:

"We are party that is socially conservative and economically liberal. We stand for traditional values and the free market, and are committed to defending the right to life of the unborn, in all circumstances. We are the most consistently conservative party in Right to Life, and our core values are expressed in our motto: Faith, Family, Freedom

Faith: We affirm without reservation the truth of the Christian religion and acknowledge its foundational role in shaping the law, language and culture of Western Civilisation. We are determined to preserve its primacy in society, whilst at the same guaranteeing freedom of conscience and religious tolerance to all citizens. We believe that man-made law should conform to Divine Law, as revealed in Holy Scripture, and that Faith alone provides the guiding compass, the 'True North' by which, and to which, the great Ship of State may be steered.

Family: The heterosexual married family is the bedrock and fundamental unit of society, the environment in which children are nurtured and reared to be productive and law-abiding Citizens, and as such we will resolutely defend it against all assault; whether from easy, no-fault divorce, or same-sex, so-called "marriage". The State should not seek to usurp the place of the family, but rather to support and protect it. Although we are dedicated to the capitalist way of life, we nonetheless hold that a part of compassionate government is providing assistance to honest families that are in need, through no fault of their own.

Also, the separate nominations of the Council and the President/Senator candidates could cause something of a problem. What if a situation arose where the Life Party President and Senators were entirely separate from the leadership of the Party, and could theoretically be expelled/disciplined by them? Surely it makes sense that the party members who have received the endorsement of the public in being elected to public office, and bear the greatest burden of responsibility, are also the decision makers in the party.

I think in particular, that Phydios, as the Life Party President of Right to Life, should be Chairman/Leader of the Party. Otherwise there could be potential conflicts of interest.

What do you think about changing the Charter so that all Senate nominees and the Presidential candidates are members of the Council, or at least have some power in the Party. You could combine the primaries and nominations period?
