In recent days the People's Republic of China has asserted in various diplomatic statements that American and Indian warships have violated China's territorial waters. While I can not speak on behalf of the Indian navy the belief in Beijing that the United States Navy violated Chinese territorial waters is a false claim. I also believe it is important to point out that international law provides considerable freedoms to all nations for the access to territorial waters.

Even though the United States has yet to ratify the United Nations Convention on the Law of the Sea we will respect the Law of the Sea in this case, as the People's Republic of China has ratified the United Nations Convention on the Law of the Sea as well as the majority of the international community. The Law of the Sea defines Territorial Waters as being out to 12 nautical miles (22 kilometers; 14 miles) from the shore.

While it is true that the coastal state, in this case the People's Republic of China is free to set laws, regulate use, and use any resource. Vessels according to the Law of the Sea are given the right of innocent passage through any territorial waters. "Innocent passage" is defined by the convention as passing through waters in an expeditious and continuous manner, which is not "prejudicial to the peace, good order or the security" of the coastal state.

There is also a clause that enables countries to temporarily suspend innocent passage. However China has to date not informed our government that it intended to or intends to temporarily suspend innocent passage in specific areas of China's territorial seas. Finally with regards to port visits of US naval ships to the region the United States Navy would be willing to include the People's Republic of China in future port calls if your government feels that it would make the situation more inclusive for Beijing.

At least Washington has decided to admit their own hypocrisy regarding the law of the sea. It is true that China is a signatory, however the territory listed is claimed by, and supported with historical evidence, as property of the People's Republic.

We will also take this time to lodge renewed protests against the aggressive actions taken by American spyplane and drones along the Chinese coast. Giving recent threats and provocation from Washington, Beijing cannot allow continual invasions of its airspace and espionage activities.

The United States has not undertaken any actions against the People's Republic of China which may be termed aggressive, and we regret that this is the official position of the Chinese government. Our relations with Taiwan are governed by the Taiwan Relations Act, and the Six Assurances which we provided to Taiwan. Both of these have been known to the People's Republic of China for decades, therefore it should come as no surprise that we are fulfilling our obligations in this question. We will do what is necessary to ensure the security of the people on Taiwan.

As for the allegations that the United States has deployed any unmanned aerial vehicles, or aircraft meant for espionage activities, we would request further information from Beijing with regards to this issue, given that we ourselves appear to not know of such aircraft in the vicinity of the People's Republic, yet are claimed to own them.
