Cuban Sovereignty of Territory (Guantanamo Bay)

I ask for the International Court of Justice to rule on a clear violation of the sovereignty of Cuban soil by the United States.

-According to the treaty and international Law, Cuba still has sovereignty over that land which was leased not sold to the United States.

-Secondly, the treaty itself leasing the land was extracted from the then Cuban government under threat, under duress.”

-The terms of the treaty are in violation of the Vienna Laws on Treaty Conventions.

The land should immediately be given back to the Cuban government under international law and the United States remove the base from Cuban soil.

This motion is absurd.

The U.S. does not consent to the Court's jurisdiction on this petition.

Further, the Government of Cuba cannot dispute the terms of an agreement to which it freely signed. The terms of that agreement include a provision in which the territory in question shall be leased to the U.S. until by mutual consent, the parties agree to terminate such an arrangement.

For these reasons, I request that the Court dismiss this petition with prejudice and censure the Government of Cuba.

Obviously we are a smaller country which was bullied into signing a document in a time when the United States was openly threatening and finally DID attempt an invasion of Cuba.

As neither Cuba nor the U.S. recognizes the compulsory jurisdiction of the ICJ, the ICJ can only provide an advisory opinion on the issues whether the U.S. is in violation of the lease. For this Cuba can seek a General Assembly resolution pursuant to Article 96 of the U.N. Charter seeking an advisory opinion from the ICJ.
