Constitution of the Dominion of Okatama Section One - Forum and Government
- http://w11.zetaboards.com/Okatama/index/ shall be the official forum of Okatama. The government organized on it is the legal government of the region.
- The constitution is the supreme law of Okatama. This is the constitution.
Section Two - Intent and Structure of Governance
- It is the intent of Okatama to represent the will of the region’s game residents and protect the sovereignty of the region. It is also the intent of the region to make the gaming experience for residents as enjoyable as possible.
- The Okataman Government places heavy value on national sovereignty and our regional sovereignty and shall act to advance these noble causes through whatever means are available to it.
- Okatama ’s government shall consist of the branches described below.
- The Governor's Assembly
- The Office of the Delegate
- The Director's Council (High Council)
- The Directorates
- The Directorate of Media Affairs
- The Directorate of Internal Affairs
- The Directorate of Foreign Affairs
- The Okatama Guard
- All members of Okatama are required to adhere the constitution and law of Okatama, which exist largely for the sake of security, moderation, making the region more enjoyable, and protecting regional interests. The law may not dictate how nations answer issues, what they believe, and how they vote in the World Assembly, though the government may encourage them to act in a certain way if appropriate.
Section Three - The Governor's Assembly
- The Governor's Assembly shall consist of any and all nations that fulfill the following criteria.
- The nations have applied for citizenship.
- Citizenship Admissions Process: nation must receive approval from the administrative team or the Director of the Assembly to receive citizenship. If the administrative team and the Director of the Assembly do not reply after 2 days, approval from the Delegate shall be acceptable.
- The nations have a nation in Okatama. One player may only have one nation with citizenship.
- The nations have pledged to act in Okatama’s best interests and to obey its laws.
- The nations have disclosed their other residences in foreign governments and/or gameplay organizations to the Delegate.
- The nations have citizenship in and/or obligations under the sovereignty of no more than ten foreign regional governments.
- This need not apply to nations that have their WA nation in Okatama.
- Nations that serve in the Okatama Guard shall also be granted this exception.
- The Governor's Assembly shall be the legislative body of Okatama and shall be tasked with creating the rules that the region is governed by. The consitution recognizes the legitimacy of all legislation passed by the Governor's Assembly provided it and the means by which it was passed are adherent to the protocols defined within it.
- The Governor's Assembly’s members shall serve as the voting members of this body.
- The Governor's Assembly shall have the authority and responsibility to elect officials who shall operate The Directorates of Okatama. The Governor's Assembly also elects the legal delegate.
- Proposals in the Governor's Assembly shall be defined in at least one of the categories described below and shall require the approval percentages described below to be confirmed as law. They must receive two approvals or declarations of support before the Director of the Assembly can bring them to vote.
- Constitutional Amendments
- Vote Requirement: 75%
- Definition: Changes to this document.
- Standard Laws
- Vote Requirement: 50% + 1
- Definition: Any legislation that doesn’t fit the other definitions provided under §3-A4 of this document.
- Declarations of War
- Vote Requirement: 50% + 1
- Definition: An official declaration of the formal cessation of relations between Okatama and the declaration’s targeted region and/or organization, if applicable. A declaration of hostilities between Okatama and the target parties in question.
- Treaties and Diplomatic Initiatives
- Vote Requirement: 50% + 1
- Definition: An official declaration of allegiance and certain mutual agreements between Okatama and involved organizations, regions, or other autonomous entities.
- Elections
- Vote Requirement: 50% + 1
- Definition: Mandating the appointment of an individual to either the position of Delegate, Director of the Interior Affairs, Director of Foreign Affairs, Director of Military Affairs, and Director of Media Affairs.
- Notes: Elections are held by citizens nominating whoever they want to have in office. Elections take place and whoever has the most votes of all the nominees wins. The winning candidate must accept their nomination at the end of the election period; if they reject it, the runner-up becomes the winning candidate. A nation must have two nominations to make it onto the ballot. Whoever has the most votes at the end of the election period wins.
- On Ties: Ties shall be broken by the Council voting amongst themselves. Whoever has the most votes wins the position in question.
- Amendments and/or Repeals
- Vote Requirement: The amount of approvals an amendment or repeal needs to pass is the same as the amount the legislation that the Assembly is attempting to repeal needed to pass originally.
- Definition: Rendering a piece of legislation in question null and void shall be considered and appeal, whereas altering existing legislation shall be considered an amendment.
- Votes shall take place over the course of two days. Motions to bring proposals to vote must be approved by at least two members of the Governor's Assembly.
- Proposals must be filed correctly before being brought to vote by the Governor's Assembly.
- Proposals must be classified under one of the categories described in §3-A5 of this document.
- Elections for a given position may take place every fifteen days at most. Okatama does not have set dates for elections for the positions that the Governor's Assembly elects, but rather it is the duty of the Governor's Assembly’s membership to determine if and when an official should be elected to an office.
- An official may only hold one elected office at a time.
- If a member of the Governor's Assembly proposes an election, they may not do so again until the vote has passed and until at least one other election has passed.
- If the Director of the Assembly is unable to perform his or her duties, the founder or the delegate may take over the duty of bringing proposals to vote in the mean time.
Section Four - The Delegacy
- The Delegate is an important organ of the executive branch of Okatama, but is not the "Head of State".
- The Delegate shall have the responsibility of ensuring that no foreign entities seize or manipulate who is the in-game delegate of Okatama.
- The Delegate shall have the responsibility of maintaining in-game aspects of Okatama; this shall include
- suppressing posts on the RMB,
- maintaining the World Factbook Entry,
- enforcing the law through ejections and banishments when legally mandated,
- constructing in-game embassies with allied regions,
- and maintaining the flag of the region.
- The Assembly has the right to restrict, loosen, and/or define the rules that the Delegate must abide by while carrying out the tasks listed above.
- Save for elections, the Delegate shall have the responsibility to sign legislation approved by the Governor's Assembly into law. The Delegate shall reserve the right to veto.
Section Five - The Directors and the High Council of Okatama
- There shall be at most five directors who make up the leadership of Okatama: they are collectively the region's Heads of State. The Directors shall be government officials who have authority over the fields they are elected to serve in. They also make up the High Council of Okatama, along with the Delegate and the founder. If no one is filling a council seat, it shall be left empty until a new member is elected to the spot.
Director of the Assembly
- The Director of the Assembly shall ensure that all legislation submitted to the embassy is adherent to the protocols outlined in this document.
- The Director of the Assembly shall bring proposals to vote.
- The Director of the Assembly shall ensure that voter fraud does not occur.
- The Director of the Assembly shall moderate the Governor's Assembly forum and ensure that decorum is maintained.
- The Director of the Assembly shall maintain the Collection of Laws and an archive of laws.
Director of the Military
- The Director of the Military shall recruit, train, and lead the Okatama Guard.
- The Director of the Military shall have the authority to construct or reconstruct the structure of the Guard at their discretion, and in their own vision.
- The Director of the Military shall approve applications for the Guard or delegate that responsibility to the Delegate or Officers.
- The Director of the Military shall have the authority to promote and appoint officers at their discretion.
- The Director of the Military shall be tasked with moderating the Okataman Guard forum and the two sub-forums within it.
Director of Media Affairs
- The Director of Media Affairs shall be tasked with leading the publication of the Okatama Press Service and other media ventures that they have authorized.
Director of Internal Affairs
- The Director of Internal Affairs shall be tasked with recruiting, moderating the Spam Sanctuary, General Discussion, and Roleplay forums, organizing and managing regional roleplay, and organizing cultural events and regional activities.
Director of External Affairs
- The Director of External Affairs shall be tasked with representing Okatama abroad, acting as the region's chief diplomat, moderating the External Affairs and embassy forums, approving ambassadorial applications, assigning ambassadors to regions, writing regional updates, and writing statements on behalf of the region with the rest of the council.
Justice
- The region shall always have a penal code. It cannot be repealed, it can only be altered.
- Any citizen may submit a report of a rules violation to any member of the Council, which shall hold organize a traditional trial of the nation in question.
- Trials may last no longer than a week. In a trial, both sides will have the opportunity to present their cases to the court and it is the duty of the entire Council to interpret the law and determine guilt or innocence, punishments if applicable, and so on.
- Members who are about to undergo trials may be given a "Probation" mask for security purposes that restricts their access to all forums that a normal
