Legal Terms and Definitions of the Court

Actus Reus - Guilty Act - Proved beyond a reasonable doubt in combination with the mens rea, "guilty mind".

Mens rea - Guilty Mind - Criminal liability. Must be proved in conjunction with Actus Reus.

Accedas ad curiam - You may approach the court.

Actio ex delicto - Cause of action. (Reason for lawsuit)

Alibi - Elsewhere.

Aliunde - From another source; from outside.

Altercatio - Forensic argumentation; cross-examination.

Ambigendi locus - Room for doubt.

Amicus curiae - Friend of the court (Impartial spokesperson)

Bancus Communium Placitorum - Court of Common Pleas.

Bona fide - In good faith, genuine, legitimate.

Bona fiscalia - Public property.

Capias ad audiendum - Writ ordering appearance in court.

Capias ad satisfaciendum - Writ ordering satisfaction of an order.

Certiorari - To be informed by an appellate review court.

Ceteris paribus - Other things being equal. (All else being equal)

Communi consensu - By common consent.

Consensus omnium - Agreement of all members.

Contra bonos mores - Contrary to good morals.

Corpus delicti - The body of a crime. (The substance or fundamental facts of a crime)

Custos - Guardian

De facto - Something that is automatically accepted. (for instance, English is the De Facto Language of the USA, but not official, or de jure)

De jure - By law. According to law.

De lunatico inquiriendo - A writ to inquire into the insanity of a person.

Delictum - Offence.

Dies juridicus - A day on which the court is in session.

Dies non juridicus - A day on which the court is not in session.

Doli incapax - Incapable of crime.

Dubitante - Doubting the correctness of the decision.

Ei incumbit probatio qui dicit non qui negat - The proof lies upon the one who affirms, not the one who denies.

Ex iniuria ius non oritur - Right can not grow out of injustice.

Ex post facto - After the fact, or Retrospectively.

Fieri facias - Writ authorizing execution of a judgment.

Ignorantia juris non excusat - Ignorance of the law does not excuse

Ignorantia legis neminem excusat - Ignorance of the law excuses no one

In terrorem - As a warning; in order to terrify others.

Ipso facto - By that very fact.

Justitia omnibus - Justice for all.

Lex talionis - The law of retaliation.

Locum tenens - A deputy.

Mala fide - In bad faith. (Something which is done fraudulently)

Mutatis mutandis - With those things changed which needed to be changed. (With the appropriate changes)

Ne bis in idem - Not twice the same. (A person cannot be sentenced twice for the same crime)

Non compos mentis - Not in possession of one's senses.

Onus probandi - The burden of proof.

Par delictum - Equal fault.

Per minas - By means of menaces or threats.

Per quod - By reason of which.

Prima facie - On the face of it.

Prima impressionis - On first impression.

Pro bono publico (Pro bono.) - For the public good. (Said of a lawyer's work that is not charged for)

Pro hac vice - For this occasion.

Pro rata - Proportionally; for a proportion.

Pro tanto - So far; to that extent.

Pro tempore - For the time being.

Publici juris - Of public right.

Quaeitur - The question is raised.

Quaere - Consider whether it is correct.

Quid pro quo - Consideration; something for something.

Re - In the matter of.

Res gestae - The thing done.

Res nulis - Nobody's property.

Res - Matter, affair, thing, circumstance.

Sciens - Knowingly.

Secus - The legal position is different, it is otherwise.

Stet - Do not delete, let it stand.

Sub modo - Within limits.

Sub nomine - Under the name of.

Sub silentio - In silence.

Suggestio falsi - The suggestion of something which is untrue.

Suppressio veri - The suppression of the truth.

Talis qualis - Such as it is.

Uberrima fides - Good faith.

Uno flatu - At the same moment, with one breath.

Verbatim - Word by word, exactly.

Vice versa - The other way around.

Volens - Willing.
