Woman ‘tricked into sex’ by penis cream treatment

A Syrian-born airline pilot allegedly tricked a schoolteacher from Haverfordwest into having sex with him by pretending he had to administer ointment on the end of his penis, a jury heard yesterday (Tuesday).

Fadi Sbano, 38, even pretended to know a gynaecologist who advised him on how often to have intercourse with her and whether to thrust "slowly or quickly". And, on the "doctor's advice", he kept a clock on the bedside table to time the sessions.

The teacher put up with the treatment for nine months before telling her doctor.

Huw Rees, prosecuting, told Swansea crown court: "The allegations here are of rape by deception."

Mr Rees said the pair met while Sbano was based at Gatwick and the teacher was working nearby.

In November, 2000, she discovered a rash of white spots and feared that typhoid, which she contracted on holiday some years before, had returned.

Sbano claimed he was in talks with a gynaecologist who was anxious for a certain cream to be applied, the prosecutor said.

"He (Sbano) suggested he would apply the cream to his penis and apply it inside her.

Mr Rees said the woman found the sessions "Clinical, not at all erotic". She consented only because she believed it was a proper treatment.

"When the insertions took place, and depending on the instructions of his friend, he would thrust slowly or quickly for anything from one to ten minutes,"

Her doctor told her to find out the identity of Sbano's gynaecologist friend but he "became evasive and never gave his name" beyond the word "Ibby".

"It began to dawn on her that he had devised this treatment in order to have sex with her on his terms."

Mr Rees said "Ibby" was traced but said he knew nothing about the treatment.

Sbano was arrested at Heathrow while attending a pilots' training facility.

He claimed the woman had invented the entire story about the "treatment".

Sbano, from Harrow, London, denies nine charges of rape and 11 or obtaining money by deception.

The trial continues.

Okay, gotta agree with Swords on this one. That's just incredibly stupid. Apparently, she had a doctor, and yet she did it. For nine months before saying, "Doc? Would this be normal?" I could go on and on. Also, 1 - 10 minutes. I laugh at you, Fadi. :lol:

I have been thinking about this for a while and I'm still trying to concoct a workable version of this lie. I just can't fathom how you'd convince someone that the appropriate method of application was a throbbing cock. I'd definitely go for 'white spots spreading to the rear' as a stage 2.

If I was on the jury I couldn't convict him of rape. It's much more likely she's using this to strike at him. Farcical really. Then again, she is Welsh - so who knows?

She was incredibly stupid, but is there such a thing as "rape by deception"? Sure, the guy was scum, but could it really be characterized as rape? She apparently consented, though she was operating from misinformation. I wouldn't think that would be rape, though it certainly hits the ick level where one wants the guy to be punished in some way.

Unless it can be proven that she is seriously mentally deficient, I don't think she has a case. He's an airline pilot, for a start. What reasonable adult would think that a pilot with cream on his dick is going to 'make her better'? I wonder what the cream was - cheese spread or something - or whether the special cream came out of his application tube.

There's theft by deception so why not rape. I know a guy who got charged with that because he created a fake university parking pass. The burden will be on the government to show beyond a reasonable doubt that but for the deception, she would not have consented to the sex. Regardless though, anyone that stupid probably deserves to be raped. I'm just sayin.

Well, I don't think "theft by deception" is really comparable to "rape by deception". "Theft by deception" would be fraud, where someone is not getting what they bargained for. If one were to apply the same reasoning for "rape by deception", then the woman got exactly what she bargained for, that is penetration and internal application of a cream.

By the same token, if it's "rape by deception", then wouldn't she be guilty of prostitution, where the payment came not in the form of cash but rather a quantity of cream applied?

No. In order to back up that argument, we'd also have to claim any woman trying to have a baby would be guilty of "prostitution" by receiving sperm as well as sexual intercourse.

I would consider this "rape by deception" if, in fact, the cream applied to the penis and inserted did not actually clear up her infection - and the cream never was intended to clear up her infection.

In terms of application, I agree it was her at the end of the day that consented to that form of treatment. He didn't claim to be a doctor - he simply said this is what he was told (a lie, but not a crime) and she said sure.

Trying to put a man in jail because you're stupid is an asshole thing to do.

If that were a condition of consenting to sex, then why wouldn't it be? With the advent of sperm banks, we could even assign a monetary value to the deposit.
