Ok, boys who can't get over the sex thing... A doctor, during a pelvic exam, will insert a finger or two in the vagina and press upwards on the vaginal wall (or in lea's case, if I recall, a whole hand). This can also be a sex act. But what seperates them? Intent. This man lied to her about his intent. Now, if I were to find out sometime after the exam that the doctor only did it to put two fingers in my vagina and get off on it, am I to blame? Surely, I consented to him doing it...but not with a sexual purpose for him in mind. This woman, like any woman at the doctor, allowed for vaginal penetration with a medical intent. This is what she consented to. Not the sex act. Do I agree with her reasoning? Of course not - I think she's an idiot, the man isn't even a doctor, etc. However, it's a technicality I can easily see. And if we're going to add the same logic in the post above to everything, a common exam gone wrong would sound like this: Doctor: Your vagina is feeling really good, you know that? Patient: Um, doctor, why aren't you writing anything down on my chart? Doctor: Oh, the exam was finished 1/2 hour ago. Patient: Why...do you still have your fingers inside me then? Doctor: Because you consented. Doesn't matter what my intent was, you said it was ok. |

Point 1: It's crucial that he's an airline pilot in this case - and no reasonable person would submit to having their vagina probed by a stranger without any medical training. Point 2: It can reasonably be expected that a penis is NOT a medical tool. I see where you're going, Pest, but a penis is a penis and everyone knows what they are. She'd have to prove she did not understand the function of the penis or that she had no knowledge of sexual intercourse for this accusation to be considered valid. |

Therefore, it cannot be reasonably expected for this woman to not view a penis as a possible medical tool. And Plague? Going over the facts of this woman's argument is incredibly less convoluted than you claiming she was a prostitute. The fact that you can't see that frightens me. |
