La Suprema Corte Real – Sección del Ley Primaria (Sala Primera) Palacio De Justicia Civil Distrito San Ivo, Fájarça Magistrates of the Suprema Corte Real (Royal Supreme Court) gather in their grandeur chamber, numbering in five, and stand in front of their seats, facing the laypersons who await what they have to say. The case today, Los Tradicionalistas Partido Eslañoles v El Gobierno De Eslaña, is one of high tension, filed right after HMRICM Queen Cataliña I dissolved both houses of the Cortes Eslañolas with knowledge of the planned attack on her being. A thud is made by the clerk of the court, before announcing the magistrates, thus beginning the start of the session. The suit, which was expected to have been dismissed in its infancy, is one that was originally poised to sue The Queen herself but did not come to pass due to laws preventing such a hostile and disloyal act. LTPE settled, instead, to sue the Crown’s Government, which is entirely legal, with the correct bases and burden of proof to show. “All rise for His Right Honourable Lordship, Chief Magistrate of the Royal Supreme Court Ambrosio Danilo Bonaventura, and the magistrates of this chamber, Their Honourable Lords & Lady-ships Xiamara Manicitio Qualcer, Donaldo Renacer Tobal, Sancha Remas de la Paz, and Leonardo Evo de la Caridad,” announces the clerk of the court. The people in attendance rise and bow their heads in respect for the magistrates, as the magistrates take their seats in a semi-circle fashion. The magistrates are in formal court attire, which being a gown of a sanguine-red colour, trimmed in white, along with a chain of the Order of Lady Justice, a special order designated for magistrates and lawyers recognized for exemplary work, and a hat of the same colour of the gown is worn by them. Chief Magistrate Bonaventura pounds his gavel twice to officially start the session for the day, signaling for everyone else to take their seats and await the start and will of the magistrates. When the chamber falls silent, so silent, in fact, one would think they could hear their own hear beating; he begins with the introduction for this day. “By The Grace of God and Her Most Royal and Imperial Catholic Majesty, Queen-Empress Cataliña I, this First Chamber of the Royal Supreme Court of Oeslan, Primary law Section, is now called to order on this day, the 21st of August. The case of Los Tradicionalistas Partido Eslañoles v El Gobierno de Eslaña is brought forth and opened to conclude this day. Before our ruling is given and ordered, the Court wishes to allow any testimony that may prove to be pertinent to this case and have an impact on the light of facts that have been argued for and against. Speak now, if one wishes so.” Scanning the room, the magistrates look to see if either the plaintiffs, defendants, or any of the attendees stand to identify that they have something to contribute, but, as expected at this point in a case, no one does, telling the Bonaventura to press on. “So be it; may the plaintiffs and defendants stand to hear our ruling,” he continues, “Pertaining to the matter at hand, the accusation by Los Tradicionalistas Partido Eslañoles, known by and as LTPE, that the Crown’s Government violated our nation’s supreme law of the land, Primary Law, breaching its tenants and overstepping its power. After months of trials and inquisitions, along with numerous pieces of evidence and the law(s) which stands, We, as Chief Magistrate of the Royal Supreme Court in its entirety, and the magistrates of this chamber for matters pertaining to Primary Law, unanimously in our power granted to us, this most solemn Court, by Her Most Royal & Imperial Catholic Majesty, Queen Cataliña I, find that the charge against the Government of Oeslan is valid and true, and is, in fact, violating the following tenants of Primary law: 3 LPE §48,5; 4 LPE §62,2; 4 LPE §68. Per 4 LPE §62, the Crown Minister is liable for the actions perpetuated by himself and the Government and is hereby censured from acting in a manner ignorant of regard to primary Law. We order the Government to cease and desist from this path and compel them to hold general elections by the end of this month, August 2015. If the Government shall not cooperate, they shall be held criminally liable, per 5 LPE §71, and detained until such a time a trial is set. This is the ruling of the Court. Let it be so.” He pounds the gavel once into the desk before him, legalizing the ruling of the court and proceeds to stand, alerting the rest of the chamber to rise almost in unison. As the other magistrates issue other minor mandates, the Chief Magistrate Bonaventura takes the original decision and judgment and places it into a small, hard, rectangular box, preparing it for transport. This is customary and must be done in order to present it to the reigning Monarch to review their decision and what was talked upon; but first, he has to take it to her. Throne Room Palacio Real de Eslaña Distrito Central, Fájarça Cataliña waits for the Chief Magistrate to make way to the palace from the Courts, sitting on one of two thrones in the room. Her throne being ever so elevated from the other next to her, it was all covered by a draped canopy of red. Behind the thrones was a bolted coat of arms of the Eslanish Monarchy, in all of its ornamentation, and leading up to it was a long carpet from the entrance into the hall. She knows what has happened at the Courts just over an hour ago. And truth be told, she is not pleased with the outcome of what has happened. And if it wasn’t for the fact that the Chief Magistrate had to have audience with her following rulings, she would have summoned him herself to explain himself. Just as she was about to get annoyed from waiting so long, one of her senior guards presents himself at the foot of the throne, kneeling before its steps and removing his hat. “Your Majesty, the Chief Magistrate has made way into the building and is awaiting entrance into this chamber. Shall I allow him passage?” “Of course; please do so immediately.” With that, the guard arises and quickly but politely makes way for the door that leads from the grand hall into this throne room. He opens the doors and down slightly from his waist as the Chief magistrate passes through the threshold into the presence of the Queen. Still in his magistrate attire & holding the box, he proceeds down the carpet that extends from the throne, making his way closer and closer to Cataliña. Before he could get directly in front of her to kneel, she begins to speak to him. “Would you care to explain yourself about this whole ordeal, Ambrosio?” He begins to rise from kneeling to face Catalina, however, was stopped by her guards, to whom she gestured to keep him kneeling. “We did not allow you to arise, dear Ambrosio. You may stay as you are.” He sighs as the guards back off; he knows now that something is deeply wrong with this situation he’s now embroiled in. And as intelligent and insightful as he may be, he doesn’t attribute that the actions of the Court he was charged with may have something to do with it. “We rescind our question and tell you this instead, be it known to you or not, you have violated Eslanish lèse-majesté laws today, and dare to demand what will happen in result of your “ruling?” Ha.” She stands from her throne and descends down right in front of the knelt Ambrosio, proceeding to remove the chain of the Order of Lady Justice and clasps it tightly, as what seems to be her slipping into a state of rage. “You knew that their intention was Us, to sue the Crown of this land! And yet you allow it and rule with them under the false pretense of suing the Government?! Ambrosio, We are not subject to the laws of the common and noble persons of Our realm, no matter what is said in Primary Law. It was Us who dissolved Our Cortes and yet, you saw it fit to shift blame and issue a direct order to your lawful Sovereign, for which, We will have none of.” “If I may, my Queen, we Magistrates operate with the tenets of nomocracy, stated in 5 LPE §70,2, insulated from the other parts of Government, for fairness, bringing those who oppose law to justice, no matter wh--” “And you see fit in this moment to lecture Us on how the Courts operate?! Do you not remember the first article, second section of the Law in question, hm? ‘Sovereignty belongs to the King, from where all power emanates, and grants it to the Oeslanish people? And let’s not forget, that you administer justice on behalf of the Crown, and We don’t condone any of this. And thus, you must be dea-” “You are not my voice of reason, Catalina! My insight has held this nation together since you were not even on this planet!” Catalina stops herself from responding, looking as if she was taken aback by his words. His lack of respect; his callousness and utter pride, where there should be humility. The only response that was reasonable and necessary came to mind without a moment to waste; she looks to the guards and again gestures, this time to a hall, saying to detain and take him away. And while he did begin to argue, push back, and spit insults at her, she regained her composure, giving a short wave before making for the main entrance of the hall. No one will tarnish nor compel the monarchy. No one. |
