The Pacifican Constitution
Preamble We the People of [insert region name], in Order to form a more perfect Union, establish Justice, insure domestic Tranquility, provide for the common defence, promote the general Welfare, and secure the Blessings of Liberty to ourselves and our Posterity, do ordain and establish this Constitution for [insert region name].
Chapter 1 :: Fundamental Rights and Freedoms Article 1 :: Equality before Law That is, every citizen shall have the same rights and obligations as stated in this constitution and other laws. Articel 2 :: Right to Vote That is, every citizen shall have the Right to Vote in a Election and Referendum. Article 3 :: Right to Petition That is, every citizen and organization may write a open letter to the government to state a problem or action that should be resolved or taken. Article 4 :: Freedom of Religion That is, every citizen is free to believe in anything he/she wants to believe in and those beliefs must be respected. However nobody may use his/her religion to force his/her ideals. Article 5 :: Freedom of Speech That is, every citizen may say what he/she thinks. Any censorship by government is absolutely forbidden, unless the region is under attack. article 6 :: Freedom of Association That is, every citizen is free to associate with groups to the choice of the individual, and for the groups to take action to promote their interests. Article 7 :: Freedom of Assembly That is, every citizen may demonstrate against a decision made by government or in our society.
Article 8 :: Right to Privacy That is, every citizen is protected against the power of the forum admins.
Article 9 :: Right to Liberty That is, every citizen is allowed to move freely within the borders of our region and our forums. Citizens lose this right when they do unlawful things. Article 10 :: Nulla poena sine praevia lege That is, every citizen that has been convicted cannot be convicted again for the same crime.
Chapter 2 :: Basic Principels of Government Article 1 :: Public Power Pacifican Democracy is founded on the free formation of opinion and on universal and equal suffrage. It shall be realised through a representative and parliamentary polity.
Article 2 :: Exercise of Public Power Public Power shall be exercised with respect for the equal worth of all and the liberty and dignity of the private person.
Article 3 :: The Senate The Senate is the foremost representative of the citizens.
Article 4 :: The Founder The Founder is, together with the WA Delegate, the protector of the [insert name]
Article 5 :: WA Delegate The WA Delegate is, together with the founder ,the protector of [insert name]. He/She will also have the responsibility of representing our nation in the World Assembly and to upkeep and maintain a updated World Factbook Entry.
Article 6 :: The Government The Government governs the Realm. It is accountable to the Senate.
Chapter 3 :: The Legislative Section 1 :: Organization of the Senate Article 1 :: Senator 1. Senators are appointed for a 2 month term 2. Senators are responsible to make laws 3. Senators are responsible to observe government 4. Senators may question ministers about their policies in special topics 5. There shall be 3 Senators in the Senate
Article 2 :: Speaker 1. The Speaker is a Senator with special tasks 2. The Speaker shall have the same responsibilities as stated in Article 1 3. The Speaker shall post a discussion topic, where citizens can discuss proposed legislation 4. The Speaker shall move laws, treaties and all others to the right forum 5. The Speaker shall inform Government and the Citizens about new changes in government
Article 3 :: Legislation Procedure 1. Any Senator may, at any given time, propose legislation 2. The Senator must post this in the proposals forum of the Senate Forum 3. All Senators have the posibility to talk about the legislation and propose changes 4. After 7 days, if the legislation has been talked about, it goes or directly to the at vote forum or will have to wait and go to the pending forum. 5. If more then 3 legislations is being voted on, all other legislation will be pending 6. Legislation will stay for a maximum of 5 days in the at vote forum 7. After those 5 days voting closes and legislation is passed it will be moved to the passed legislation forum 8. Legislation that did not pass will go to the failed legislation forum
Section 2 :: Work of the Senate Article 1 :: Responsibilities 1. The Senate shall be responsible to create laws and regulations 2. The Senate shall vote on laws, treaties, alliances, embassy requests and vote of no confidence 3. The Senate shall observe government 4. The Senate may question the president, WA delegate and any minister about their policies and work
Section 3 :: Right to Referendum Article 1 :: Influence of the Citizens 1. Any Citizen may propose legislation 2. 2 Government Officials (Executive or Legislative) must support the legislation 3. The proposed Legislation shall be posted in a special forum in the General Discussions 4. Citizens shall have a week to ask questions and show their support or not 5. Citizens shall have 3 days to vote on this legislation in a Referendum 6. If the legislation passes the Referendum it will move to the Senate for a last vote 7. Citizens Legislations must be voted on by the Senate within 1 week after the Referendum 8. The Legislation shall become law if a mayority of the Senate supports the legislation
Article 2 :: Power of the Senate 1. A Referendum shall be called out if a majority of the Senate believes that the citizens should decide 2. Citizens must be explained what the legislation does for them, the pro's and con's. 3. Citizens shall have 1 week to make up their minds 4. After that week citizens shall have 5 days to vote.
Chapter 4 :: The Executive Section 1 :: Composition of the Executive Article 1 :: Compostion 1. The Government shall be composed by 3 members: the President, WA Delegate and a Minister of Home Affairs 2. The President shall be the leader of the government and he/she shall be leader of our army 3. The WA Delegate shall be the minister of foreign affairs and shall be responsible of our foreign relations 4. The Minister of Home Affairs shall be responsible for recruitment, culture and citizenship applications 5. These Positions are elected for a term of 2 months during the General Elections (except Minister) Section 2 :: Functions Article 1 :: The President 1. The President shall be the leader of government and our army 2. He/She shall organize the government and delegate tasks to his assistants (WA Delegate and Minister) 3. He/She shall function in a manner according to this constitution (Chapter 2) 4. He/She shall be appointed by election during the General Elections
Article 2 :: The Founder 1. The Founder shall be responsible to remain active and protect our region against outside threats 2. The Founder shall remain unbaised because he has a special position 3. The Founder has the right to show his opinion and vote as long as he does not abuse his position. 4. The Founder shall be responsible to maintain and regularly update the World Factbook Entry 5. The Founder shall be responsible to create polls, sometimes by government
Article 3 :: WA Delegate 1. The WA Delegate shall be responsible for the ministry of foreign affairs. 2. The WA Delegate shall maintain relations with other regions 3. The WA Delegate may appoint Ambassadors who shall be sent to other regions to represent our region 4. The WA Delegate shall represent our region in the World Assembly and vote on proposals 5. The WA Delegate is elected for a 2 month term during the general elections
Article 4 :: The Minister of Home Affairs 1. The Minister shall be responsible for Recruitment, Welcoming and Informing (telegrams) the citizens. 2. The Minister is also responsible for activities both cultural and roleplay 3. The Minister shall be moderator of the roleplay forums 4. The Minister shall be responsible to organize the elections 5. The Minister is the only executive positions that is not elected but chosen directly by the president Section 3 :: Duties and Restrictions of the Executive Article 1 :: Duties and Responsibilities 1. The Executive shall be responsible for the day to day running of the government 2. The Executive shall be the only part of government that may propose treaties and alliances 3. The Executive shall remain active on a daily basis
Article 2 :: Restrictions 1. The Executive may not restrict the liberties of the cititzens 2. The Executive may not bypass the Senate 3. The Executive shall not lie before the Senate and Citizens
Chapter 5 :: The Judiciary Article 1 :: Composition 1. The Judiciary shall be composed of 1 Chief Justice 2. The Judiciary may be expanded with 2 Assistant Justices 3. The Chief Justice and 2 Assistant Justices shall be appointed by the President during the midterm elections 4. The Chief Justice and 2 Assistant Justices shall be appointed for 2 months
Article 2 :: Duties 1. The Chief Justice and Assistant Justices shall be objective, unbaised and treat everyone equal 2. The Chief Justice and Assistant Justices shall interpret common law 3. The Chief Justice and Assistant Justices shall review all cases
Chapter 6 :: Elections Article 1 :: General (Executive) Elections 1. General Elections shall elect the following positions: the President, WA Delegate, Minister (appointed by president) and 1 Senator 2. General Elections shall be held every even month 3. Campaigns for these positions shall be seperated by eachother by creating special campaign forums within the election forum
Article 2 :: Midterm (Legislative and Judiciary) Elections 1. Midterm Elections shall elect the following positions: 2 Senators, Chief Justice (appointed by President and Assistant Justices (appointed by president) 2. Midterm Elections shall be held every uneven month, in the middle of the presidents term 3. Campaigns for the Senate shall be held in a special forum only for senator campaigns.
Article 3 :: Conduct of Elections 1. Citizens can sign up for positions that will be up to vote during that election 20 days before the election date 2. The Minister of Home Affairs shall be responsible for the moderating the elections 3. Citizens are allowed to start campaigning immediatly after signing up, they may post a campaign topic in the special designated forums. 4. Everyone is allowed to ask questions and show support to a certain candidate 5. The polls shall be placed in the Election Forum 6. The polls shall be opened for 5 days 7. The results shall be examined by the Chief Justice and if he approves shall be enacted by this constitution.
Chapter 7 :: Citizenship Article 1 :: Rights of Citizenship 1. All Citizens shall have the rights as stated in this constitution 2. All Citizens shall follow all laws and rules passed by government
Article 2 :: Obtaining Citizenship 1. Citizenship shall be created to protect the forums from trolls and all others who want to harm our region 2. After registering registered will obtain Non-Citizen status, they can only view certain parts of the forum
3. The Customs and Information Office shall be the place to sign up for Citizenship 4. The Questionnaire can be changed by the senate 5. The President or Minister are the only people who may approve a Citizenship Application 6. The Admins may disapprove a Citizenship Application if they can find something wrong 7. The Admins shall change the people to the right mask
