Constitution of The Perdivian Federation

Preamble
We the member states of The Perdivian Federation understanding that we must have a constitution to lay out the rules, regulations, and positions in our region, hereby agree to the terms of this document in order to better uphold the ideas of democracy and liberty, and in order to ensure the prosperity of our region.

Article V
Citizenship


Section 1: Process
To become a citizen of the The Perdivian Federation a nation must go through the following process; move their nation to the region, register on the Regional Forums, sign this constitution, reside in the region for 3 days.

Section 2: Granting
After following the above process then a nation aspiring to be a citizen may be granted citizenship by the Secretary of Immigration.

Section 3: Exception
All initial signatories of this document will immediately become citizens, without having to follow this process.

Article II
Regional Executive


Section 1: President
The President shall be the leader of the Executive, responsible for the administration of the region and the execution of all executive power; also responsible for representing the region in the World Assembly.

Section 2: Vice President
The Vice President/Deputy Delegate shall be responsible for assisting the president in their duties, and assuming the roles of the president in the event of their death resignation, or absence.

Section 3: Domestic Affairs
The Secretary of Domestic Affairs shall be responsible for maintaining activity in the region by creating new roleplays, activities, and contest for member states to participate in; also responsible for all intraregional communication.

Section 4: Foreign Affairs
The Secretary of Foreign Affairs shall be responsible for Interregional affairs, including but no limited to, maintaining embassies, establishing interregional organizations and activities, and keeping up with the activities of known raider nations.

Section 5: Immigration
The Secretary of Immigration shall be responsible for recruiting new member states, and making sure that all new members are well informed about the region and its entities.

Section 6: Defense
The Secretary of Defense shall be responsible for maintaining the defense and safety of the region, this shall be done by leading the Regional Defense Force, making sure all member states are well informed of the Regional Readiness Level, and monitoring the movements of known raider regions, in conjuction eith the Secretary of Foreign Affairs.

Article III
Regional Legislature


Section 1: Regional Assembly
The Regional Assembly of The Perdivian Federation n shall be the legislature of the region. The Regional Assembly shall have the responsibility of passing binding international law. They shall also be responsible for the following: condemning a nation for a particular action, call for an investigation in certain actions/nations/organizations.

All regional citizens shall be members of the Regional Assembly. The Regional Assembly shall meet on an as needed basis.

Section 2: Secretary General
The Secretary General shall be the presiding official of the Regional Assembly; and shall have the duties to keep order in the assembly, suspend a member from the Assembly, open and close sessions of the assembly, call emergency sessions of the assembly.The Secretary General shall be elected by the Regional Assembly every six (6) months.


Article IV
Supreme Court


Section 1: Composition
The Supreme Court shall be comprised of a Chief Justice and two associate Justices.

Section 2: Decisions & Responsibilities
All decisions made by the Court must be upheld by all involved parties. The court shall be responsible for interpreting all parts of the constitution that a member state finds unclear.

Article V
Elections

Section 1: Term Limits
The Executive shall serve a term of three (3) months, this term can only be interrupted by the officials resignation, unannounced relocation, or death. The Supreme Court shall serve a term of six (6) months.

Section 2: Guidelines
The winner of an election can only be declared after a majority of the region has voted, or after the voting has gone on for 48 hours. Only regional citizens shall have the right to run for election, but anyone residing in the region may vote. Executive Officials shall only be able to serve three consecutive terms, this rule can be waived on a one term basis by the Supreme Court.

Section 3: Standards & Removal of Officers
The Executive and Supreme Court are to be held to a high standard as the representatives of the region. The Executive and Supreme Court shall be held to the following; Shall not accept bribes, shall not break the regional law, shall not lie to the region, shall not misuse their powers, shall not have affiliation with raiders, shall not mistreat regional citizens. If any member of the Executive or Supreme Court breaks one of these rules they may be voted out by a 2/3 majority of the General Assembly.

Article VI
Rules & Regulations


Section 1: Rules
All members residing in the region must abode by the following rules: no Spamming, No Metagaming or Godmodding, No Flaming or Trolling, Abide by all NS Rules, Abide by all government decisions, only one puppet per nation.

Section 2: Consequences
Anyone who breaks one of those rules shall be tried by the Supreme Court and given one of the following consequences: 1 Day Suspension, 3 Day Suspension, 5 Day Suspension, Ejection, Ban & Ejection. A suspension shall mean that a nation may remain in the region but cannot participate in regional activities, included but not limited to, the RMB, and the forums.

Constitutional Proposal
Article I ) Supranational Sovereignty

The Perdivian Federation Government is the supreme governing body of the region whose sovereign powers are accorded by all the sovereign member states of the Perdivian Federation who are subject to its laws and policies. It shall also maintain peace, security, and stability.


Article II ) Sovereign Rights

The Perdivian Federation shall respect the inherent rights of each member state, which include, but not limited to, the following: right to exist, right to self defense, right to free association, right to express opinion, right to self determination, right to due process and fair trial, right to participate in the World Assembly, right to enter into treaties and agreements, right to exercise sovereignty and independence, and right to exercise due powers by the Founder.


Article III ) The Secretary General

The Secretary General is the Founder of the Perdivian Federation which shall be responsible in governing the Secretariat which in turn shall be in charge with the administration of the Perdivian Federation Government and its institutions and must be responsible in the checks and balances among the branches of government of the Perdivian Federation.

The Secretary General, as the Founder of the Perdivian Federation, is the sole executor of administrative powers over the Perdivian Federation and may create administrative roles, if necessary; and has the power to ban and eject any member state, which can be overturned by the Court of Justice, provided that there is a minimum endorsement from fifteen member states, as certified by the head of the Court of Justice, or there is a minimum endorsement from ten member states and an endorsement from the Delegate.


Article IV ) The Delegate

The Delegate is the sole envoy of the Perdivian Federation to the World Assembly which acts as an institution of the Government itself elected via the most number of endorsements of all the member states of the World Alliance that are member states of the World Assembly; and is responsible in promoting the interests of the Perdivian Federation to the World Assembly.They are also the Premier of the region.

The Delegate may appoint a Deputy Delegate provided that the latter has two endorsements from other member states of the World Assembly whose responsibility involves advisory and assisting functions to the Delegate and, in case of temporary absence, may take over the obligations of the Delegate but without the possibility of being elected as Delegate.


Article V ) The Parliament

The Parliament is the sole legislature of the Perdivian Federation composed of 5-20 elected seats distributed via proportional representation whose terms of office are three months and where proposals must be approved by simple majority, within three days, to become a law. It must be headed by the Speaker, elected by the Parliament itself, which is also the tie breaker and successor to the President of the Council, in case of resignation.

The Parliament, as elector of the Council, may hold a vote of no confidence anytime, in which if supported by the majority of the member states of the Parliament, will result in the immediate dissolution of the Council in question and an election of a new Council.

The Speaker cannot serve as President at the same time and for successive terms.


Article VI ) The Council

The Council is the sole executive organ of the Perdivian Federation composed of seven member states elected by the Parliament, from the Parliament itself, co-terminus with that Parliament subject to the confidence of that Parliament, whose member states will remain as member states of that Parliament as well. The Council can exercise any executive power at will unless otherwise prescribed by law and must be headed by the President elected by the body.

The President cannot serve as Speaker at the same time and for successive terms.


Article VII ) The Court of Justice

The Court of Justice is the sole judiciary and law interpreter of the Perdivian Federation composed of three elected member states whose terms are unlimited and whose actions must be approved by the majority of all the members of the body where one of which is the Chief Justice and two others must be referred as the Associate Justices. The Justices must have no positions in any other branches of the Perdivian Federation Government.

The Justices may be dismissed by any member state petitioning the Secretary General calling for a dismissal referendum provided that the petitioning state is supported by four other member states. If met, a dismissal referendum must be administered by the Secretary General which a simple majority will decide the verdict provided that a minimum of ten member states have participated on the dismissal referendum which must only last for three days.

Any member state dismissed from the Court will never be eligible in the Court.

Any vacancy in the Court of Justice must be filled in via an election.


Article VIII ) Parliamentary Elections

Elections for the Parliament must be held during the last week of the final month in office of the outgoing Parliament and the succeeding elected Parliament must take office on the first day of the succeeding month. There must be a ballot, crafted by a ballot developer authorized by the Secretary General, that must include options to select a political party and independent candidates where all candidate member states achieving five percent of the vote are automatically entitled to a seat in Parliament.

Elections must be administered by the Secretary General.


Article IX ) Constitutional Revisions

Any amendment or revision to the current constitution must undergo a constitutional convention, which shall be administered by the Secretary General, in which its adoption shall be subject to a constitutional referendum with seventy five percent approval of all the present member states on that constitutional convention.

Nevertheless, any member state has the right to petition an endorsement call for a convention to the Secretary General which shall be obliged to announce such request to achieve at least ten percent of all the member states supporting such convention.


Article X) Transitory Provisions

Upon adoption of this new Constitution, the preceding constitution is deemed null and void and all existing international (regional) laws must remain in force, unless otherwise repealed or amended accordingly. All references and inherent authorization granted by the aforementioned laws to the Security Council shall be transferred to the new Council, except on legislative functions, that shall be transferred to the new Parliament, and on judicial functions, that shall be transferred to the new Court of Justice, respectively

As for the regional legislature, just to keep things simple, this region should be a direct democracy. Basically, no parliament or assembly, just the citizens who vote. This can be simpler as well as less time-consuming. This is what I believe the "regional legislature" article should state:

To propose legislation or "bills" to the assembly, one must be: a "Proposalist", or one granted special rights by the President to propose bills; OR a regional executive, who may propose legislation based on their department of operations.
