Constitution of the Utilitist Republic of Utilitas

Constitution of the Utilitist Republic of Utilitas

The nations of Utilitas, in order to establish a regional government and provide for the maintenance of order inside the region, do pass the following Constitution as the highest law in the land.

Article I - The Utilitist Republic Of Utilitas

1. This Constitution recognizes the establishment of the Utilitist Republic of Utilitas, hereafter referred to as the Republic, as the rightful government of the region of Utilitas.
2. This Constitution recognizes the nation of Utilitas as the ultimate basis of all political authority as founder of the region.
3. Treason against the Republic shall be defined as aiding or abetting enemies of the Republic, conspiring to overthrow the government of the Republic, performing espionage or military actions against the Republic, or showing disloyalty to the Republic and its government. The maximum punishment for treason shall be an indefinite forum ban and banning from the region.

Article II - Citizenship

1. All citizens must have a nation in the region of Utilitas.
2. All citizens must fill out the citizenship application form and oath completely and truthfully.
3. The Justiar may reject citizenship for reasons including but not limited to being an enemy of the Republic, being a threat to regional security and falsifying a citizenship application.
4. Falsifying a citizenship application shall be defined as providing false information on a citizenship application. The maximum punishment for falsifying a citizenship application shall be an indefinite forum ban and banning from the region.

Article II - The State Council

1. All executive authority is hereby vested in the State Council of the Republic, hereafter referred to as the State Council. The State Council shall consist of the Justiar and the Capaxes.
2. The Justiar shall be the head of state and the head of government of the Republic.
3. The first Justiar shall be Utilitas.
4. The Justiar may issue Edicts of the Republic that shall hold the weight of law.
5. The Justiar shall choose his successor through an Edict. If the Justiar ceases to exist without designating a successor, the Tribunate shall choose the next Justiar.
6. The Justiar may temporarily ban citizens if there is sufficient evidence that they are a threat to regional security and may commit treason against the Republic.
7. The Justiar may issue a declaration of war against any region that acts against the interests of the Republic.
8. The Justiar may approve treaties with any region.
9. The Justiar may disband the Tribunate indefinitely in times of regional emergency, with the consent of a simple majority of the Tribunate. In this case, Edicts will be the only legitimate form of legislation until the re-establishment of the Tribunate.
10. The Justiar may only be removed if he is convicted of committing treason against the Republic.
11. The Justiar may appoint up to five Capaxes to carry out his program. He may remove and appoint Capaxes at his volition.
12. The Justiar may grant honours to citizens in recognition of distinguished service to the Republic as he sees fit.

Article III - The Tribunate

1. Legislative authority is hereby vested in the Tribunate of the Republic, hereafter referred to as the Tribunate.
2. The Tribunate shall consist of five Tribunes. The Justiar shall appoint three Tribunes and two Tribunes shall be elected by the general citizenry every month.
3. Any citizen of the Republic except for the Justiar may stand for Tribune.
4. The Justiar shall be responsible for opening and closing elections. Elections for Tribune shall be open for 24 hours. The top two vote-getters will take seats in the Tribunate. In the case of a tie, the tied candidates shall participate in a runoff election that shall be open for 24 hours. The winner(s) shall take a seat(s) in the Tribunate.
5. The first order of business for the Tribunate shall be to select the Lord Tribune. The Lord Tribune shall be chosen from among the Tribunate by a simple majority. The Lord Tribune shall moderate debates, keep track of votes, announce the results of votes, and move passed bills onto the Justiar for signature.
6. For a bill to be passed, the proposed bill must be submitted to the Tribunate by a Tribune. The Tribunate must then be given time to debate and amend the bill as it sees fit. A vote may start upon the seconding of a motion to vote. Any Tribune may motion for, or second a motion for, a vote. If the bill achieves a simple majority, it may be passed on to the Justiar for signature. If the bill does not achieve a simple majority, it may be returned to the floor for further debate. A vote must last at least 48 hours, or until every member of the Tribunate has voted.
7. Upon signature of the bill by the Justiar, the bill shall pass into law.
8. If the bill is vetoed by the Justiar, the Tribunate may override the veto with a 100% majority for the bill.
9. The Tribunate may strike down Edicts with a 100% majority against the Edict.
10. No bills of attainder, ex post facto legislation, or bills granting titles of nobility shall be passed by the Tribunate.

Article IV - The High Court

1. Judicial authority shall be vested in the High Court of the Republic, hereafter referred to as the High Court.
2. The High Court shall consist of the Lord Justice and the Justice.
3. The Lord Justice shall have original jurisdiction over all cases.
4. The Justice shall have appellate jurisdiction over all cases.
5. Members of the High Court shall be appointed by the Justiar. Members of the High Court shall serve until resignation or death.
6. The Lord Justice shall have the authority to review any laws or Edicts to ensure that they do not conflict with the Constitution of the Republic or the Zetaboards Terms of Use. Any legislation judged unconstitutional or in violation of the Zetaboards Terms of Use shall be considered null and void.
7. The Justiar may not serves on the High Court.
8. Tribunes may not serve on the High Court.

Article V - The Utilitas Liberation Force

1. The military of the Republic shall be the Utilitas Liberation Force, hereafter referred to as the ULF.
2. The commander-in-chief of the ULF shall be the Justiar.
3. The Justiar may organize the ULF and its structure as he sees fit.
4. The Justiar may participate in missions of defense or invasion.
5. All citizens must enlist in the ULF in times of war. Failure to obey this may result in loss of citizenship.
6. Any member of the ULF who participates in military actions against the interests of the Republic shall be expelled from the ULF and may be subject to further disciplinary action.

Article VI - Amendments & Ratification

1. This Constitution may be amended by an 80% supermajority of the Tribunate and the consent of the Justiar.
2. This Constitution shall pass into effect upon ratification by 66% of the citizenry or upon signature by the Justiar.
