My ideas for the Legislature

Quote:

The legislative branch of the Federation shall be styled as the Federal Assembly(FA) and shall be comprised of all Representatives.

The FA is tasked with discussing and voting on laws and amendments to the Federal Charter and electing a head of the FA styled as the Speaker of the Assembly(SA)

The SA has the task of overseeing the discussions of the FA.

S/he also has the task of setting Assembly Procedure(AP). This is to insure that all laws and amendments passed are written in the same style, that all discussions are kept respectful and that voting doesn't last too long or is too short.

S/he must try and remain neautral in Assembly discussions.

S/he is allowed to vote on all Assembly votes. S/he must open all Assembly votes. If a vote is passed s/he must sign the document into law with the Federal Assembly seal and include their signature(forum name) on the passed document, which will then be passed on to the High Council to be signed.

Questions? Additions?

I like that, the only thing I would bring up for discussion is possibly making the SA neutral (no vote), with the exception of a tie. I've done it in some other formats before where the person in charge doesn't have a vote but it still works relatively well. It helps to make the SAs job a little less stressful and makes it more difficult for them to take an undo amount of control over the assembly.

I don't feel too strongly one way or the other honestly I just thought I would throw it out for discussion.

If at any time there the position is vacant, it shall be filled before any further action by the FA takes place. If the current SA is absent for more than a week, the position will be considered vacant.

In the case of a vacancy, the Delegate will temporarily assume the position of SA and organize the vote for SA. The Delegate may bar a representative from the election with sufficient and public reasoning; their decision may be appealed in the Federal Court.

My additions are in italics. I added these clauses to facilitate the process, in case the Speaker of the Assembly goes absent, to make sure the Federal Assembly does not devolve into procedural paralysis.

Should we have a mechanism that allows for a SA pro tempore in the case the the SA knows ahead of time that s/he will be unavailable for any amount of time up to a week? They would only step into the role of the SA tells them they will be gone and could also run the legislature through the elections of a new SA if the seat was deemed vacant, instead of the delegate.

The SA pro tempore provides another way to ensure that the legislature doesn't grind to a halt just because the SA goes on vacation for a few days.

I didn't consider planned absences. Thanks for the catch.

The Speaker of the Assembly should announce their intention in advance (a week?), maybe there can be a Secretarial position of the Assembly that would be charged with recording all laws. When the Speaker of the Assembly goes absent (whether announced or sudden), the Secretary would take power temporarily. If the period is unannounced, then the Secretary opens a vote for SA; the Secretary himself cannot run in this election because he is managing it. If announced, then the Secretary just manages the Federal Assembly until the SA returns. If both are absent for some unforeseen reason, then the Delegate assumes SA and organizes a vote for both SA and Secretary.

I like that, that looks good.

How long does the SA have to be gone before we consider them absent? If its too short or vague and we have a trigger happy Secretary we may run into problems but if we have a clear amount of time there would always be something to support the Secretary's actions.
