A BILL

To amend the Higher Education Act of 1965 to increase the maximum Pell grant from $3,125 to $7,000 over 3 fiscal years.

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,

Section I. Short Title.

(1) This shall be called the Pell Grant Expansion Act of 2013.

Section II. Pell Grant Increase

Section 401 of the Higher Education Act of 1965 (20 U.S.C. 1070a) is amended--
(1) in paragraph (2)(A)(v) of subsection (b), by striking `$5,800' and inserting `$7,000';
(2) in paragraph (7) of such subsection, by striking `the appropriate Appropriation Act for this subpart for such year' and inserting `subsection (g)';
(3) by striking paragraph (3) of such subsection and redesignating paragraphs (4) through (8) of such subsection as paragraphs (3) through (7), respectively;
(4) by striking subsections (g) and (h) and inserting the following:
`(g) AVAILABILITY OF FUNDS- (1) Each fiscal year, there shall be available to the Secretary of Education from funds not otherwise appropriated, funds to be obligated for the payment of grants under this part in the amounts determined under this section, not to exceed (from such funds not otherwise appropriated)--
`(A) $13,300,000,000 in fiscal year 2014; and
`(B) $18,800,000,000 in fiscal year 2015; and
`(C) $23,600,000,000 in fiscal year 2016.
`(2) If the amount made available under paragraph (1) in a fiscal year is not sufficient to pay all grants under this subpart in the amounts determined under this section, the Secretary may make such reductions in awards as may be necessary, by either a fixed or variable percentage reduction or by a fixed dollar reduction.'; and
(5) by redesignating subsection (i) as subsection (h).

SECTION III. EXPANDED ELIGIBILITY FOR PELL GRANTS

Section 401(f) of the Higher Education Act of 1965 (20 U.S.C. 1070a(f)) is amended by adding at the end the following new paragraph:
`(4)(A) Notwithstanding paragraph (1) or any other provision of this section, the expected family contribution of each student described in subparagraph (B) shall be deemed to be zero for the period during which each such student is eligible to receive a Federal Pell Grant under subsection (c).
`(B) Subparagraph (A) shall apply to any student at an institution of higher education--
`(i) whose parent or guardian--
`(I) make at or below $99,999 per year

Section IV. Enactment Clause.

(1) This shall be effective upon Constitutional passage.

Section V. Plain English Summary

Bill expands the Pell Grant program to provide a maximum yearly dispersal of $7,000. Also expand eligibility. This increase shall last over the next three fiscal years.
