Mr. Hernandez, Mr. Reese and Mr. Starnes, for themselves and others in the House propose the following legislation.

A BILL

To provide full and adequate funding for classrooms throughout America.

SECTION I. SHORT TITLE

This legislation shall be known as the American Education Funding Act.

SECTION II. FINDINGS

1) When Congress passed the 21st Century Education Act, they inadvertently curtailed education funding for schools throughout the United States
2) It is in the public interest to make certain public school classrooms throughout America are fully funded
3) Congress has a responsibility to ensure that education funding meets previously authorized goals set forth by Congress and representatives from multiple Presidential Administrations

SECTION III. LEGISLATIVE PROVISIONS

1) All funding previously authorized to maintain compliance under the No Child Left Behind Act and the Race to the Top program is reallocated in a block grant to be made available to the Department of Education for distribution to local school districts, with an amount of money allocated to each state, the District of Columbia, the Commonwealth of Puerto Rico and all other American territories whose school systems are under the purview of the Department of Education to be determined on the gross percentage of their students in public school versus the national total number of public school students.

2) Any school district which receives funding must meet the following guidelines:
1. The School District shall demonstrate that such funding shall be used for actual classroom instruction
2. The School District shall present a plan in consultation with state authorities in which the school operates which demonstrates how the money will be utilized to increase student achievement in one or more of the following areas:
* Math
* Science
* Reading Comprehension

3. The School District shall make priority funding available to schools listed as “at risk” using definitions agreed upon by the Department of Education following passage of this legislation

4. The School District's request for funding shall not exceed their percentage of students compared the total of students for their respective state, commonwealth or foreign possession.

3) Any funding unused at the end of a given Fiscal Year shall be returned to the Treasury and shall be used to pay down the national debt.

SECTION IV. ENACTMENT

This legislation shall be deemed enacted 90 days following Constitutional passage.
