Mr. TALBOT of Pennsylvania, for Mr. CALLAGHAN of Massachusetts, Mr. BREWER of Minnesota, Mrs. DE ROXAS of Texas, Mr. ROBERTS of Ohio, himself and others, and with thanks to former Congresswoman CLARKE of West Virginia, Mr. CABALLERA, introduces

A BILL

To improve the opportunities for adults and children whose first language is Spanish in the United States.


Section 1. Short Title.

This bill shall be referred to as the "Hispanic Community Opportunity Enhancement of Language Act".

Section 2. Findings.

1. According to 2010 findings by the U.S. Census, more than 37 million people call Spanish their first language.
2. According to 2010 findings by the U.S. Census, only half of those who speak Spanish in the U.S. as a first language also speak English "very well".
3. People with bilingual or further speaking abilities are more likely to get a job than those that speak one language.
4. In a predominantly English-speaking nation where businesses conduct interviews and transactions in English, the opportunity arises for jobs if English in known.
5. The majority of public signs such as road signs as well as news is delivered or displayed in English.

Section 3. Provisions

1. States shall set up English Learning Courses in counties where the percentage of population of Spanish speakers over the age of 5 meets or exceeds 7.5 percent.
2. States shall be required to develop learning standards to move on in level of difficulty of the English language.
3. Charges for a full year long course shall be no more than $250 per person.
4. The length of these courses shall last no less than 180 days per year.
5. States must enact these courses within two legislative sessions within their state following the Constitutional Enactment of this legislation.
6. All programs shall go into effect two years after the passage of this legislation.

Section 4. Cost

1. The Department of Education shall allocate $3,000,000,000 each year to this program.
2. States shall submit applications, developed by the Department of Education, requesting a specified amount of money for the payment of the program.
3. All allocated funds provided to each state shall be used only for this program and any funds shown to be used for other areas other than for the provisions of this legislation shall be paid back to the Federal Government plus interest of 30 percent for every dollar found to be used in the wrong.
4. Any money not used by a state or provided to a state shall be reverted to paying off the National Deficit.

Section 5. Enactment.

1. This bill shall be enacted sixty days following its Constitutional Passage.
