What to do to get her out? We have 2 months security but we will need that as protectia against any damage/missing itmes and utility bills. We rented to her only because she was living in the flat above until the owner told her to leave so he could renovate it and sell it. The owner gave her an excellent reference. We want her out anyway, her lease is up november 30, because we want to sell the flat and it is difficult with a sitting tenant. The problem is that here in the 3rd world there are draconian laws protecting tenants(enacted by Franco and mostly still on the books) We thought of cutting the electric, water, and internet. Now she says she paid and it will show on our account tomorrow since today is a holiday here in the 3rd world. We are planning to have her out by November 30 anyway and looking at the planets we see that we could have ca-ca until November 18, then all ok. Thanks Tybee. |

Being a landlord is no fun, is it. I sold off the 2 rental units I had many years ago after 6 years of nothing but misery and unnecessary expense caused by idiots who had great references. I finally wised up with my parent's home and hired a management company to handle everything. |

She finally paid today but not the 50 euros extra penalty charge she owes for the late payment. The rental yields are high here but only because it is high risk for the owner! We pray that we can just sell it soon and at least get a somewhat ok price, though this is in no way certain. The local government is extremely corrupt(can you say "banana republic"?) and makes it very risky for owners to rent property. They will stick you with a 9000 euros fine without proof of 'wrongdoing'. (Our lawyer said it can take as long as a year to evict someone) Edited by Erna, Oct 13 2015, 02:24 AM.

Send her a statement of account showing the late fee as owing, and leave it at that. If she pays, fine. If she doesn't deduct the fee from her deposit after she vacates and you'll have that statement for documentation if she whines. |

Can you ask her to leave before then? Or evict her? Or did she wind up paying the rent that was due, and sign up to lease from you until November 30th? |
