There was a lawsuit in the 1990s where a lady sued her boss (she was a waitress). He led her to believe she was going to win a Toyota car if she won the most tips from customers or whatever, when he actually said "Toy Yoda" (as in a Yoda Star Wars action figure).

Here's another similiar story:
  • Radio Listener Sues DJ After He Promises She Has Won "100 Grand"

    Jun 25 2005
...Unfortunately He Was Only Prepared to Offer A Candy Bar
A Lexington, Kentucky DJ is being sued by a listener who thought she won $100,000 in a radio contest only to find out the DJ was merely prepared to award her a "100 Grand" candy bar.

According to the complainant, Norreasha Gill, DJ Slick, from WLTO-FM (Hot 92), announced the 10th caller would receive “100 Grand”. Gill “reasonably believed she would receive $100,000 if she were the 10th caller”, according to the lawsuit.

The suit goes on to say DJ Slick knew the prize was really not $100,000 and falsely represented the prize with the intention to “cheat, defraud, and play a malicious joke upon plaintiff”.

Gill says she was the 10th caller and DJ Slick told her she had won “100 Grand”. Gill was informed to show up at the Central Bank building the next day to receive her prize where she was then told it was simply a prank.

A WLTO-FM executive reiterated to Gill that the contest was a “joke” and that she would not be receiving the money.

Gill’s attorney, Lee Van Horn, filed the suit on Gill’s behalf and is seeking not only the $100,000 dollars but interest, punitive damages, her costs, and a trial by jury.

This is not the first time this particular radio stunt has been pulled. You can hear audio of the original instance here.

What do some people think? At MonkeyFilter.com where another account of this lawsuit was blogged, some chose to post comments:

“Good lord, I hope she wins. DJ Slick is lucky he is still alive.” - Zanshin

"Chalk this one up as yet another example of I can't take a joke so I'll sue. Sad, Sad, Sad." - squeak

“…I don't think she has a case in the court of law. She didnt LOSE anything- she thought she had gained something, but hadn't. She didnt have any sort of contract with the station or the DJ- its not a like a formal contest with printed rules…However, I'm sure she will triumph in the court of public opinion, where the station will fire the DJ and/or buy her off with some sort of prize...” - drjimmy11

“I think she deserves to win $100k. If he had left it at "our loyal listeners with a chance to Win 100 GRAND!!!! It's sitting in a bag to my left ready for someone to take off with just like the Runaway bride," then I would say, well....she probably can't take a joke. However, by adding that the tenth caller would be "100 GRAND RICHER!!!" No joke. That did two things. First, it seriously implied money, with the "richer" bit.” - Sandspider

WLTO-FM (Hot 92) is owned by Cumulus Media, Inc.

What a sleaze and a perv.

DJ FIRED FOLLOWING ON-AIR RACIAL AND SEXUAL REMARKS
  • TROI TORAIN, the co-host of a syndicated US radio show, has been sacked after making on-air racial and sexual comments about a rival DJ's wife and four-year-old daughter.

Torain, better known as Star on Power 105.1's STAR & BUCWILD MORNING SHOW, was fired by his employer Clear Channel following the remarks he made between last Wednesday (03MAY06) and Monday (08MAY06).

His comments, directed at local New York station HOT 97's DJ ENVY, made reference to both an alleged videotape of R KELLY urinating on an underage girl and DJ Envy's Asian/African-American wife.

Torain told listeners, "Yes, I disrespected your seed. If you didn't hear me, I said, I would like to do an R Kelly on your seed, on your little baby girl. I would like to tinkle on her."

Torain also offered to give $500 (£280) to any listener who informed him of the location of DJ Envy's daughter's school.

He said, "Oh yes, I'll, I'll come for your kids. I will come for your kids. I finally got the information on his slant-eyed, whore wife."

DJ Envy tells AllHipHop.com, "Any man that says he would like to do an R Kelly on a four-year-old, who claims he wants to tinkle on her and skeet on her face might be a paedophile.

"Instead of keeping his hatred focused solely on me, he threatened to molest my daughter. He's a coward who hides behind his microphone, who will stop at nothing to generate ratings."

Clear Channel's ROB WILLIAMS adds, "Power 105 finds recent remarks broadcast by Troi Torain of the Star And Bucwild Morning Show to be wholly unacceptable. He is no longer with Power 105.1 or Clear Channel Radio.

"We sincerely apologise to those who may have been offended by his remarks." Torain and DJ Envy have been conducting an on-air feud for the last few weeks.
Following the incidents, the rest of Torain's morning show team have reportedly been suspended.

The same team, including Torain, were sacked by Hot 97 in 2001 after playing the sound of a plane crashing and a woman screaming soon after R&B singer AALIYAH died.

New York DJ arrested for rape threats
  • May 13, 2006

NEW YORK, NY, United States (UPI) -- Former New York radio personality Troi 'Star' Torain was arrested Friday for making on-air threats to rape a rival`s 4-year-old daughter.

The district attorney`s office said Torain was arrested by the New York Police Department`s Hate Crimes Unit for endangering the welfare of a child, The New York Times reported.

Torain was fired from his morning show at WWPR-Power FM Wednesday for asking listeners to help him hunt down the 4-year-old daughter of WQHT-Hot 97 jock Rashawn 'DJ Envy' Casey so he could sexually molest her.

Torain`s attorney, Benjamin Brafman, told the Times his client`s remarks were 'inappropriate and 'offensive' but 'it was not criminal.'

....[In a statement put out by Brafman Thursday, Torain offered 'his sincere apologies to DJ Envy`s wife and child for the comments he made, which were unsuitable and inappropriate.'

The statement said Torain had no real intention harm the child or her mother, Gia Casey, who was pelted with anti-Asian racial slurs during Torain`s broadcasts.

When Don Imus (white guy) made a racially tinged comment or two on his radio show about some black female teen basketball players, people called for his head on a platter (and rightfully so, I suppose, if "nappy headed" is considered a racist slam).

Will we see the same outrage over a black man who calls a white girl by an obscene name, complete with the word "white" before the vulgar word ("little white (bleep)")?

Could you imagine if a white male DJ referred to a famous black teen as a "little black (bleep)" the anger that would erupt?

The PC double standards we have in this nation make me puke.

Foul Jamie Foxx pours it on poor Miley Cyrus
  • By Herald wire services
    Wednesday, April 15, 2009 - Updated 4h ago

Oscar-winning actor Jamie Foxx turned shock jock the other day when he spewed vitriol at tween sensation Miley Cyrus on his Sirius satellite radio show.

“The Foxxhole Sunday” host and his crew lashed out at Cyrus, referring to the 16-year-old as a “little white (bleep)” and advising her to “make a sex tape and grow up,” E! Online reports.

The actor/rapper’s outburst was fueled by a caller who brought up a recent story in which Cyrus pledged to “ruin” the band Radiohead after the notoriously shy rockers rejected a request to meet with the Disney superstar backstage at the Grammys .

“Who is Miley Cyrus?” Foxx, who has a teenage daughter of his own, asked. “The one with all the gums? She gotta get a gum transplant . . .(expletive deleted)”

He didn’t stop there. “Get like Britney Spears and do some heroin. Do like Lindsay Lohan and start seeing a lesbian and get some crack in your pipe. Catch chlamydia on a bicycle seat. That’s what I want.”

    Whoa.

The “Hannah Montana” star has not officially issued a response but she did post a Pollyannish entry on her Twitter page last night. “If you can’t say something nice don’t say anything at all,” she tweeted.

A rep for Foxx said a statement would be released soon but fans shouldn’t be taking the actor’s blowout too seriously. “I’m sure you’re aware,” the publicist told E! News, “that Jamie’s show is a comedy.”

Jamie Foxx has since gone on Leno and made a grovelling apology. What he said was rude and disgusting...the last thing we need is to watch another pop star go through a series of career endangering troubles.

Miley has handled this well so far...I don't know if she's responded to his apology yet.

EDIT / UPDATE

Billy Ray Cyrus Slams Jamie Foxx for Miley Rant - April 16, 2009

Excerpt:
  • In response, Cyrus told talk show host Bonnie Hunt: “It was hurtful, there wasn’t nothing funny about it, and quite frankly, I think if I said those things about his daughter he might not find it so comedic.”

Jamie Foxx has since gone on Leno and made a grovelling apology.  What he said was rude and disgusting...the last thing we need is to watch another pop star go through a series of career endangering troubles.

Miley has handled this well so far...I don't know if she's responded to his apology yet.

I saw on the Google News front page earlier today that Foxx had issued an apology.

I don't really buy his apology.

There are somethings one should not say even in the attempt to be funny.

He said he didn't mean to be "malicious." But humor and comedy can be malicious.

There's nothing funny about a grown man (he's 41 years old) saying the things he did about a 16 year old girl.

I can't think of any context or time where it would be okay to "joke" that a 16 year old girl should become a drug addict, make a sex tape, etc.

This is the kind of content that is on the cable Comedy channel on a regular basis.

I don't like stand up comics who use vulgar language, sex jokes, etc. It's trashy and sleazy, not cute or funny.

If a white comic had said this crap about a black pop singer -and had mentioned the color of her skin while doing so (as Foxx did about Cyrus)- heads would roll. The double standard is something else that annoys me about this.

Jamie Foxx apologizes to Miley Cyrus
  • Jamie Foxx has apologized to teen star Miley Cyrus for a radio routine in which he urged the 16-year-old to "make a sex tape and grow up."

When the incident was brought up on the "Tonight" show Tuesday, Foxx apologized and said: "I didn't mean it maliciously."

Foxx had started talking about Cyrus on his Sirius satellite radio show after someone brought up the singer's recent feud with Radiohead. Foxx said: "Who is Miley Cyrus? The one with all the gums? She needs to get a gum transplant!"

Foxx noted to Jay Leno that he was doing a routine, saying: "Sometimes as comedians, you know, we go a little too far."
Jamie Foxx Apologizes for Crude Miley Cyrus Rant
  • Jamie Foxx, has apologized to Miley Cyrus for launching a crude attack on the teen sensation on his Sirius satellite radio show, where he told her to "Make a sex tape and grow up!"

He issued the apology on on Tuesday's episode of The Tonight Show with Jay Leno, claiming he meant no harm.

"I have a radio show. We're really the black Howard Stern. We go at everybody. There was a situation with Miley Cyrus, and I just want to say, I apologize for what I said. I didn't mean it maliciously. You know I'm a comedian. You know my heart."

It's not clear when the comments were made. But the insults began flying after someone brought up the 16-year-old's recent feud with Radiohead after Cyrus wasn't allowed to hang out with the band after the Grammys.

Foxx, 41, is heard saying: "Who is Miley Cyrus? The one with all the gums? She need to get a gum transplant!"

He also says: "Make a sex tape and grow up!"

A woman is heard calling Cyrus the b-word.
Spineless Jamie Foxx Tries to Have It Both Ways
  • ....We recognize that there was probably an immense amount of pressure on Foxx from his PR team (and from Dreamworks) to use the occasion to apologize for the incident, which would presumably help stem the tide of the criticism that he was under and prevent sinking the already tenuous box-office prospects of The Soloist any further.

However, the way he went about it reeked of insincerity; rather than issue a direct and simple on-air apology, he couched his response with the excuse that he's a "comedian" and "the black Howard Stern," explaining along the way that "sometimes, as comedians, as we do, we go a little bit too far."

While that's certainly a defensible position, it raises the question of why Foxx even apologized in the first place.

If he really still considers himself a "comedian" (unless you count Stealth, he hasn't made a comedy since 2004's Breaking All the Rules) and thinks that poking fun at celebrities is essential to his livelihood, why lace his apology with bullsh*t lines like "this is sincere," when his facial expressions and body language clearly indicate that it isn't?

Just explain that you make fun of people all the time and be done with it. We recognize that the court of public opinion was demanding something more substantial than that, but we can't imagine that going about it in this way did anything other than prompt his core fan base to wonder if he "sold out" once and for all.
A reader left a comment on the above page saying that he watched the video and believed the apology was sincere. I have not watched the video, so I don't know.

Points raised by other readers on that page:
  • Foxx told a 16-year-old girl she should "catch chlamydia from a bike seat". I don't care how famous she is, that's disgusting.

By TheJacqueline on 04/15/2009 at 2:41pm
Doesn't Jamie Foxx have a daughter who's roughly the same age as Miley Cyrus? Aren't Jamie Foxx's teeth also of questionable size in relation to his gums? Is every junket for "The Soloist" going to be fraught with uncomfortable moments and passive-aggressive dismissals?
