A Bill to Provide for the criminal law of Capitalists, and for other purposes. 1. No Penalty Without a Law (1) No person shall be guilty of an offence unless criminal liability shall have been established before the act was committed. 2. Determination of the Penalty (1) The penalty for an offence shall be determined by the law in force at the time that the act was committed. (2) If the criminal law is amended during the commission of the offence, the more lenient provisions shall apply. (3) If the criminal law is amended during a trial for an offence, the law at the time that the offence was committed shall apply. 3. Application (1) The provisions of this Act shall apply to the region of Capitalists and all her possessions, including any forums maintained by the same. 4. Offences Committed Abroad Against Domestic Interests (1) The criminal law of Capitalists shall apply, regardless of the law applicable in the locality in which the offence was committed, to the following offences committed abroad:
5. Time of the Offence (1) An offence is deemed to have occurred at the time in which the principal or secondary participants acted. The time at which the result occurs is irrelevant. 6. Place of the Offence (1) An offence is deemed to have occurred in all places in which the offender acted, or in the case of an attempt, all places in which the offence was intended to have occurred. 7. Attempt (1) A person attempts to commit an offence if he takes steps which will lead to the immediate completion of the offence envisioned by him. (2) Any attempt to commit an offence entails criminal liability. (3) The attempt may be punished more leniently than the offence. (4) The attempt may not be punished with less than one-third of the minimum punishment of the offence. 8. Principal and Secondary Actors (1) Any person who commits an offence shall be liable as a principal. (2) Any person who intentionally induces another to intentionally commit an offence shall be liable as a principal. (3) Any person who intentionally assists another in the intentional commission of an offence shall be liable as an aider. (4) The sentence of an aider shall be proportionate to the sentence of the principal. (5) All minimum and maximum sentences in this Act shall apply to a person sentenced as a principal. 9. Conspiracy (1) Any person who attempts to induce others to commit an offence, or to abet in the commission of an offence, shall be liable to the same degree as an attempted offence. (2) Any person who accepts to offer of another to commit an offence, or to abet in the commission of an offence, shall be liable to the same extent of conspiracy as under section 9(1) of this Act. 10. Self-defence and Excessive Self-defence (1) Self defence is any defensive action that is necessary to avert an imminent unlawful attack on oneself, another, or the region of Capitalists. (2) Any person who commits an act in self-defence does not act unlawfully. (3) Any person who exceeds the limits of self-defence out of confusion, fear or terror does not act unlawfully. 11. Parliamentary Privilege (1) Members of the Legislature shall be at all times immune from criminal liability because of a vote they cast, or a statement they make within the Council, or any of its committees. This section shall not apply to intentional defamation. 12. Bans (1) There are two classes of ban; the regional ban and the forum ban. Any person for whom the courts have ordered a regional ban shall be automatically subject to a forum ban for the same duration, unless otherwise ordered by the court. (2) The period and class of a ban must be explicitly stated in the judgement of the court. (3) Any person who is serving a ban shall have access to a private forum through which he may request legal assistance, or challenge a ruling of the court. An administrator may limit access to all other forms of communication for the duration of the punishment. 13. Loss of Civic Rights (1) The court may order that a citizen lose the ability to vote, to hold public office, or both. (2) The loss of ability to hold public office automatically entails the loss of the right to vote for the same duration of time, unless otherwise specified. (3) Any regional or forum ban automatically entails the loss of ability to hold public office and to vote for the duration of the ban, unless otherwise specified. 14. Entry into Force of Punishments (1) All punishments are considered to enter force at the point at which an administrator implements, in part or in whole, the order of the court. 15. The Principles of Sentencing (1) When sentencing, the court must weigh the circumstances in favour of and against the offender. In particular consideration must be given to the motives and aims of the offender, the harm caused by the crime, the extent to which the harm was foreseen or caused by the offender, and the offender's prior history. 16. Presidential Pardon and Commutation of Sentence (1) The President may pardon any person convicted of a crime. (2) A pardon shall absolve the offender of guilt for the crime which was pardoned. (3) The pardon may commute the sentence, in whole or in part, of any person convicted of a crime. (4) A commutation shall not erase the offender's criminal record, nor his guilt for the crime. 17. One Act Violating Multiple Laws (1) If the same act violates multiple laws, or the same law more than once, then only one sentence shall be imposed. (2) If more than one law has been violated by the same act, then only one sentence may be given. The sentence must be the most harsh that the law allows. 18. Multiple Acts Violating Multiple Laws (1) If multiple acts violate multiple laws which require multiple punishments, or the same law more than once, an aggregate sentence shall be imposed. (2) If one of the sentences for the individual offences is an indefinite ban, then an aggregate sentence of an indefinite ban shall be imposed. In all other cases the aggregate is calculated through increasing the most severe penalty. (3) The aggregate may be less than the sum of the individual sentences, though it may not be less than two-thirds of the same sum. 19. High Treason (1) Any person who, through force or threat of force, attempts to undermine the continued existence of the region of Capitalists, or of its lawfully established constitutional order is guilty of high treason. (2) The penalty for high treason shall not be less than four months forum and regional ban and a permanent disqualification from holding public office. 20. Treason and Treasonous Actions (1) Any person who causes a state secret to come to the attention of an unauthorised person, or of the general public, and thereby causes the danger of serious harm to the region of Capitalists is guilty of treason. (2) Any person who causes a state secret to come to the attention of a foreign power, and thereby causes danger of serious harm to the region of Capitalists is guilty of aggravated treason. (3) Any person who obtains a state secret for the purposes of disclosing it is guilty of treasonous espionage. (4) The penalty of treason or treasonous actions shall not be less than a one month forum ban, and disqualification from holding public office for three months. 21. Reckless Recruiting (1) Any person who sends unauthorised recruitment messages on behalf of Capitalists, or who recklessly sends recruitment messages whilst another person is recruiting is guilty of reckless recruiting. (2) The penalty for reckless recruiting shall not exceed a two week forum ban, and shall not be less than a three day forum probation. 22. Unlawful Interference with the Armed Forces (1) Any person who illegitimately exerts an influence on the armed forces in order to undermine their readiness to fulfil their legitimate orders, or who directs the armed forces against the region of Capitalists is guilty of unlawful interference with the armed forces. (2) The penalty for unlawful interference with the armed forces shall not be less than one month forum and regional ban, disqualification from holding public office for two months, and indefinite disqualification from being a member of the armed forces of Capitalists. (3) Any person who, on the territory or possessions of Capitalists, attempts to recruit members of the same into the service of foreign armed forces without authorisation from the Government of Capitalists is guilty of illegal recruiting on behalf of foreign powers. (4) The penalty for illegal recruiting on behalf of foreign powers shall not be less than an indefinite ban on private communications on the forums of Capitalists, and permanent disqualification from being a member of the armed forces of Capitalists. 23. Blackmailing Officers of Government (1) Any person who, by force or threat of force, unlawfully coerces any officer of the Government of Capitalists to not exercise their functions, or exercise them in a particular manner, is guilty of blackmailing an officer of the Government. (2) The penalty for blackmailing an officer of the government shall not exceed five months forum and regional ban, and shall not be less than one month forum and regional ban. 24. Electoral Offences (1) Any person who prevents or disturbs an election, or the determination of its results, is guilty of disrupting the electoral process. (2) The penalty for disrupting the electoral process shall not exceed two months forum and regional ban, and shall not be less than a four month disqualification from voting and holding public office. (3) Any person who votes without being entitled to, or otherwise causes an incorrect result, or falsifies the results of an election is guilty of falsification of election results. (4) The penalty for falsification of election results shall not exceed three months forum and regional ban, and shall not be less than two weeks forum and regional ban, and six month disqualification from voting and holding public office. 25. Incitement to Crime (1) Any person who, in public or in private, incites another to commit an offence is guilty of incitement to crime. (2) The penalty for incitement to crime shall not exceed two months forum and regional ban, and shall not be less than one week forum ban. 26. Sabotage (1) Any person who, through deliberate or negligent actions, causes a serious danger of harm to the region of Capitalists, is guilty of sabotage. (2) The penalty for sabotage shall not exceed two months forum and regional ban, and shall not be less than a five day ban. 27. Arrogation of Public Office (1) Any person who unlawfully engages in the exercise of a public office, or the functions associated with such an office, or who unlawfully presents himself as holding such an office, is guilty of arrogation of public office. (2) The penalty for arrogation of public office shall not exceed one month forum and regional ban, and shall not be less than a one month disqualification from voting and holding public office. 28. Violation of a Court Order (1) Any person who deliberately fails to comply with a legitimately made court order is guilty of violation of a court order. (2) Section 28(1) of this Act shall not apply in cases where an appeal against the order is lodged in a timely fashion with the proper authority. (3) The penalty for violation of a court order shall not exceed a two week forum ban, and shall not be less than a one day forum ban. 29. Perjury (1) Any person who knowingly gives false testimony before a court of Capitalists, or any other authority competent to examine witnesses under oath, is guilty of perjury. (2) The penalty for perjury shall not exceed a one week forum ban, and shall not be less than a one month disqualification from holding public office, and a two day forum ban. 30. False Accusation (1) Any person who intentionally falsely accuses another of a crime, with the aim of bringing about or continuing official measures against that person is guilty of false accusation. (2) The penalty for false accusation shall not exceed a two week forum ban and a two month disqualification from holding public office, and shall not be less than a five day forum ban, and one month disqualification from holding public office. 31. Intentionally Prosecuting Innocent Persons (1) Any public official who intentionally and knowingly prosecutes an innocent person in a court of Capitalists is guilty of intentionally prosecuting innocent persons. (2) The penalty for intentionally prosecuting innocent persons shall not exceed a three week forum ban, and a three month disqualification from holding public office, and shall not be less than a two week forum ban, and a two month disqualification from voting and holding public office. 32. Perverting of the Course of Justice (1) Any public official who, in conducting or deciding a legal matter, perverts the course of justice for benefit of, or detriment to, a party shall be guilty of perverting the course of justice. (2) The penalty for perverting the course of justice shall not exceed a one month forum ban and three month disqualification from holding public office, and shall not be less than a one week forum ban, and a one month disqualification from holding public office. 33. Defamation and Intentional Defamation (1) Any person who asserts or disseminates a fact related to another person in any medium whatsoever, which may defame him or negatively affect public opinion about him is, unless this fact can be proven to be true, guilty of defamation. (2) The penalty for defamation shall not exceed a one week forum ban. (3) Any person who intentionally and knowingly asserts or disseminates an untrue fact related to another person in any medium whatsoever, which may defame him or negatively affect public opinion about him is guilty of intentional defamation. (4) The penalty for intentional defamation shall not exceed a three week forum ban. 34. Harassment (1) Any person who sends or otherwise communicates malicious messages in the region of Capitalists, with the intent of causing the recipient distress or harm, is guilty of harassment. (2) The penalty for harassment shall not exceed a one month forum ban, and shall not be less than a one day forum ban. 35. Short Title and Commencement (1) This Act may be cited as the "Criminal Justice Act". (2) This Act shall enter into force on the day on which the President approves it. |
