PREAMBLE TO THE CONSTITUTION OF THE LEAGUE OF TIDES We the Member Nations of the League of Tides, standing as a united alliance of Free and Democratic Nations, loyal in our commitment to the Tenets of Tides and our duty to Liberty, do hereby ordain and establish this Constitution for the League of Tides. ARTICLE I - THE LEGISLATIVE BRANCH Section 1: The House of Tides All legislative Powers shall be vested in the House of Tides, consisting of a body of Congress. 1a. Congress shall be composed of Member Nations chosen on the 1st day of each month by Election of their fellow Member Nations. 1b. No Member of Congress shall be elected during any active Order of Probation ratified by the Sentinel or otherwise in defiance of a direct Order from the Court of Tides. 1c. All vacancies for seats in Congress, which occur more than 14 days prior to the next regular Election, shall be filled by way of Special Election and announced publically in no longer than 48 hours of the vacancy. Special Elections must occur with no less than 7 days remaining until the regular Election is held. Seats may be kept vacant if Special Elections cannot be held for any reason. 1d. Regional population shall determine the number of seats in Congress. No less than one and no more than nine seats of Congress shall be created. (1-4 Member Nations = 1 Seat); (5-10 MN= 2 Seats); (11-40 MN = 3 Seats); (41-50 MN = 4 Seats); (51-80 MN = 5 Seats); (81-90 MN = 6 Seats); (91-139 MN = 7 Seats); (141-150 MN = 8 Seats); (151+ MN = 9). 1e. Members of Congress shall elect for themselves, a Speaker of the House by simple majority. Section 2: Powers of Congress 2a. The Speaker of the House shall establish all meetings and legislative sessions of Congress and present PASSED legislation for APRROVAL to the Court of Tides. 2b. Any Member of Congress, including the Speaker, may introduce legislation for deliberation in the House of Tides. 2c. Any member of Congress may sponsor Administrative Legislation submitted by the Prime Minister for deliberation in the House of Tides. 2d. All members of Congress are granted the power to vote PASS or REJECT on any legislation deliberated in the House the Tides. 2e. Congress may draft an Order of Impeachment for any member of the Ministry of Tides with 75% or more support of all sitting members to Eject that member from the Ministry. PASSED Orders are given to the Court of Tides by the Speaker of the House for APPROVAL. 2f. Congress may draft an Order of Restrain for any member of Congress in an act of Censure with 75% support of all sitting members to suppress that member’s power to vote for the remainder of their term. PASSED Orders are given to the Court of Tides by the Speaker of the House for APPROVAL. Orders of Restrain that are issued for the Speaker of the House shall include the name of the Member Nation to-be-elected as a replacement Speaker and shall be presented to the Court of Tides by the Speaker-elect. Section 3: Limitations of Congress 3a. Any legislation of Congress that amends the powers, limitations or terms granted in this Constitution for any branch of the Government of the League of Tides will not take effect until the beginning the next regular cycle of elections and/or appointments. 3b. All legislation of Congress shall uphold the Foundational Liberties granted and protected by the Tenets of Tides and this Constitution and shall not amend any original Tenets. 3c. No member of Congress may hold any position in any other part of the Government of the League of Tides simultaneously during a congressional term. Section 4: Confirmations 4a. Congress shall hold hearings to CONFIRM or DENY all Cabinet Ministers appointed by the Prime Minister; their decision is final and shall be based on the nominated Member Nation’s record of Civil Rights and Political Freedoms. Congress may also openly ask questions of the nominated Member Nation and consider the nominee’s answer/s to best determine the result of the Confirmation hearing. 4b. Congress shall CONFIRM or DENY all Justices of the Court of Tides appointed by the Sentinel, their decision is final and shall be based on the nominated Member Nation’s record of Civil Rights and Political Freedoms. Congress may also openly ask questions of the nominated Member Nation and consider the nominee’s answer/s to best determine the result of the Confirmation hearing. ARTICLE II: The JUDICIARY BRANCH Section 1: The Court of Tides All judicial Powers shall be vested in one supreme Court, consisting of Justices charged with upholding and protecting Constitutional Law and Liberty. 1a. The Court of Tides shall be composed of Justices made up of Member Nations with the greatest understanding of this Constitution as determined and Appointed by the Sentinel on the 15th day of December, February, April, June, August, and October of each year. One seat shall always be reserved for the Sentinel in the case of breaking tie-rulings. 1b. All Justices of the Court shall be confirmed by the House of Tides. 1c. No Justice shall be elected during any active Order of Probation ratified by the Sentinel or otherwise in defiance of a direct Order from the Court of Tides. 1d. All vacant seats in the Court of Tides shall be filled by way of Appointment by the Sentinel and Confirmation of the House of Tides in no longer than 14 days after the vacancy. 1e.All vacancies occurring in the Court more than 14 days prior to the next regular appointment shall be filled by Special Appointment from the Sentinel and Confirmation of the House. No appointment may occur less than 7 days before regular appointment periods. Seats may be kept vacant when Special Appointments are restricted or at the discretion of the Sentinel. 1f. The longest consecutive serving member of the Court shall be named Chief Justice. Section 2: Powers and Orders of the Court 2a. The Chief Justice shall establish all judicial sessions of the Court and present APPROVED Legislation and Orders to the Sentinel for ratification. 2b. All Justices are granted the power to vote APPROVE or STRIKE on any PASSED Legislation or Administrative Orders by simple majority as presented by the Speaker of the House or Prime Minister respectively. 2c. The Court may issue Orders of Probation to any Member Nation deemed unfit or otherwise not upholding Liberty as presented by the Prime Minister. 2d. The Court may issue Orders of Impeachment as presented by the Speaker of the House. 3e. The Court may issue Orders of Restrain as presented by the Speaker of the House. 3f. The Court may hear Appeals of Orders of Probation, Impeachment or Restrain at their own discretion. Section 3: Limitations of the Court 3a. The Court shall not initiate legislation. 3b. The Court shall uphold the Foundational Liberties granted and protected by the Tenets of Tides and this Constitution and shall not APPROVE amendments to any original Tenets. 3c. Justices of the Court may not hold any position in any other part of the Government of the League of Tides simultaneously during a judicial term. Section 4: Sentinel Line of Succession 4a. In the event of the Resignation or Death, the Chief Justice of the Court of Tides shall assume the duties, executive powers and responsibilities pursuant to Article 3, Section 6. 4b. In the event of a Sabbatical of the Sentinel, the Chief Justice of the Court of Tides shall assume the duties, executive powers and responsibilities pursuant to Article 3, Section 6. ARTICLE III: HEAD OF STATE Section 1: The Sentinel All Executive Powers, Guardianships and Ambassadorial duties of the League of Tides shall be vested in a Sentinel. 1a. The Sentinel shall be embodied by the Founder of the League of Tides. 2b. The Sentinel cannot be removed or replaced through Legislation or Order. Section 2: Powers & Duties 2a. The Sentinel shall be responsible for exercising all Executive Powers, including Bans, Ejections, BanJections and regional password protection as it is approved by the Court of Tides. 2b. The Sentinel shall be responsible for ratifying all Approved legislation and Orders from the Court of Tides. 2c. The Sentinel is charged with the guardianship of all regional property, official documents and approved legislation and orders. 2d. The Sentinel shall lead and advocate on issues of Foreign Affairs for the League of Tides, including Embassy approvals and Treaties. 2e. The Sentinel shall hold a permanent seat in the Court of Tides. Section 3: Limitations 3a. The Sentinel shall not Veto any Legislation or Orders approved by the Court of Tides. 3b. The Sentinel shall not introduce legislation. 3c. The Sentinel shall not be granted a vote in the Court of Tides unless a decision has ended with a tie-ruling. 3d. The Sentinel shall not hold positions in any other branch of the Government. Section 4: Executive Orders 4a. The Sentinel shall issue and implement Executive Orders to exercise all Executive Powers and governmental authorities when other branches of government are inactive or otherwise unable to perform their duties. 4b. The Sentinel shall honor and defer to rulings made by the Court of Tides when the proper judicial authority/s become active or upon approval of new Administrative Orders provided by the Ministry of Tides, when the proper Ministry authority becomes active. 4c. All Executive Orders shall expire in 48 hours if no intervention is made by the Ministry or Court of Tides. Section 5: Judicial Appointments 5a. The Sentinel shall appoint all Justices of the Court of Tides to be Confirmed by the House of Tides. 5b. The Sentinel shall withdraw any Appointments of Justices at any time with sole discretion. 5c. The Sentinel shall make Special Appointments of Justices to complete the present terms of vacant seats in the Court to be Confirmed by the House of Tides. Section 6: Resignation, Death or Sabbatical 6a. Upon Resignation or Death, the Executive Powers of the Sentinel shall be bestowed to the elected WA Delegate unless or until the Sentinel is resurrected. 6b. Upon Resignation or Death, the Guardianships and Ambassadorial duties of the Sentinel shall be bestowed to the Chief Justice of the Court of Tides unless or until the Sentinel is resurrected. 6c. Upon Sabbatical, the Executive Powers, Guardianships and Ambassadorial duties of the Sentinel may be temporarily bestowed to the either the WA Delegate and/or Chief Justice at the Sentinel’s discretion. ARTICLE IV: THE ADMINISTRATION Section 1: The Ministry of Tides All Powers of Policy shall be vested in the Ministry of Tides, consisting of a Prime Minister and his Cabinet to conduct an Administration. 1a. The Ministry of Tides shall be composed of a Member Nation chosen on the 15th day of each month by Election of their fellow Member Nations for the position of Prime Minister. 1b. No Prime Minister shall be elected during any active Order of Probation ratified by the Sentinel or otherwise in defiance of a direct Order from the Court of Tides. 1c. All vacancies for the position of Prime Minister shall be filled in accordance with a Ministerial line of succession. 1d. An Appointed Cabinet of Ministers will Advise and carry out the responsibilities of the Administration. 1e. No Minister of the Cabinet shall be Appointed during any active Order of Probation ratified by the Sentinel or otherwise in defiance of a direct Order from the Court of Tides. 1f. All Ministers of the Cabinet shall be confirmed by the House of Tides. 1g. All vacancies of the Cabinet shall be filled by Appointment from the Prime Minister and Confirmation of the House. Section 2: The Powers and Offices of the Ministry 2a. The Prime Minister shall establish and carry out all domestic Policy and Administration for the Ministry of Tides. 2b. The Prime Minister shall draft Administrative Orders to the Court of Tides. 2c. The Prime Minister shall present all Administrative Legislation to the House of Tides. 2d. The Prime Minister shall appoint a Cabinet of Ministers to lead various departments of the Ministry of Tides and may withdraw these appointments at any time. 2d1. The powers and duties of the Ministry of Tides, pursuant to the Department of Justice, shall be vested in an Attorney General. 2d2. The powers and duties of the Ministry of Tides, pursuant to the Department of Defense, shall be vested in a Minister of Defense. 2d3. The powers and duties of the Ministry of Tides, pursuant to the Department of Immigration, shall be vested in a Minister of Immigration. 2d4. The powers and duties of the Ministry of Tides, pursuant to the Department of the Treasury, shall be vested in a Minister of Finance. 2d5. The powers and duties of the Ministry of Tides, pursuant to the Department of Intelligence, shall be vested in a Minister of Intelligence Section 3: The Limitations of the Ministry 3a. The Prime Minister and his Cabinet shall not establish any Policy or Order in contrast to the Foundational Liberties granted and protected by the Tenets of Tides or this Constitution. 3b. The Prime Minister and his Cabinet shall not hold any position in any other part of the Government of the League of Tides simultaneously during a Ministerial term. 3c. No Minister of the Cabinet shall initiate legislation. 3d. No Minister of the Cabinet shall serve past the term of the Appointing Prime Minister without subsequent Appointment and Confirmation. Section 4: Administrative Legislation Partnership 4a. The Prime Minister may submit Administrative Legislation to the House of Tides for deliberation and Passage to the Court of Tides with the Sponsorship of ONE member of Congress. Section 5: Ministerial Line of Succession 5a. Upon Resignation, Death or Removal, the position of Prime Minister and all duties, powers and responsibilities therein, shall be assumed by the Cabinet Ministers in the following order: Attorney General, Minister of Defense, Minister of Intelligence, Minister of Immigration and Minister of Finance. 5b. Vacant Cabinet positions shall be passed over to the next occupied Cabinet position in line of Ministerial succession. 5c. Occupied Cabinet positions with Ministers unwilling to serve as Prime Minister, shall be passed over to the next occupied Cabinet position in line of Ministerial succession with a Minister willing to serve. , 5d. In the event of an empty Cabinet or Cabinet of Ministers unwilling to serve upon the Resignation, Death or Removal of the Prime Minister, a Special Election shall be had for a new Prime Minister to complete that present term. 5e. Congress shall update the Ministerial line of succession to reflect all Cabinet Ministers named in Article IV, Section 2 of this Constitution. ARTICLE V: MEMBER NATIONS Section 1: Qualifications of Liberty All Member Nations of the League of Tides must display and adhere to minimum Qualifications of Liberty to join and remain a Member. 1a. All Member Nations must maintain at least “Some” or above Civil Rights for their Home Nation. 1b. All Member Nations must maintain at least “Some” or above Political Freedoms for their Home Nation. 1c. All Member Nations must maintain a democratic and Dictator-less government in their Home Nation. Section 2: Probations and Ejections 2a. Member Nations shall be served with an Order of Probation if not maintaining Qualifications of Liberty in their Home Nation. 2b. Member Nations shall be served with an Order of Ejection if Qualifications of Liberty are abandoned or rejected in their Home Nation. Section 3: Member Rights 3a. All Member Nations of the League of Tides shall enjoy complete Freedom of Speech and Opinion with Protection from harassment and/or attack. 3b. All Member Nations shall enjoy a Democracy with free and fair elections, checks and balances and shared governance. 3c. All Member Nations are guaranteed LIBERTY, FREEDOM and JUSTICE without the possibility of human intervention. ARTICLE VI: Oaths Section 1: Oath of Liberty 1a. All Member Nations that join the League of Tides after the first Ratification date of this Constitution shall telegram to the Sentinel or publically post on the Regional Message Board the following Oath of Liberty: “I do solemnly swear (or affirm), on behalf of myself and my Nation, that I will faithfully maintain, defend and pursue Freedom and Liberty and pledge my Alliance to the League of Tides and all its Member Nations.” Section 2: Oath of Office 2a. All Elected or Appointed Member Nations in the Government of the League of Tidies after the first Ratification date of this Constitution shall telegram to the Sentinel or publically post on the Regional Message Board the following Oath of Office: “I do solemnly swear (or affirm) that I will faithfully execute the Office of ___________ for the ___________, and will to the best of my ability, preserve, protect and defend Liberty in the name of the League of Tides.” ARTICLE VII: WORLD ASSEMBLY DELEGATION Section 1: WA Membership and Endorsements 1a. World Assembly membership shall not be required of any Member Nation. 1b. Member Nations with World Assembly membership shall cast their votes freely. 1c. All votes cast by the WA Delegate in the General Assembly and/or Security Council shall be done with respect to the principals of the Constitution and the Tenets of Tides. 1d. The WA Delegate shall present all proposed resolutions to General Assembly and/or Security Council on behalf of the League of Tides after receiving Approval from the Court and Ratification from the Sentinel. 1e. All Executive Powers performed by the WA Delegate shall adhere to the Laws, Constitution and Tenets of the League of Tides. ARTICLE VIII: RATIFICATION & ORIGINAL SIGNATORIES The Ratification of this Constitution and the Tenets of Tides is hereby Established by the Monarch (Sentinel) of the League of Tides as Approved by the Court and Passage by the House on the 1st Day of December 2011. ~ Constitutional Monarchy of Tides, Monarch (Sentinel) ~ The Free Land of Lardonia, Chief Justice ~ Federal Republic of Democratic Marshlands, Speaker of the House SEE ALSO: Tenets and Amendments |
