I'm running for Minister of Justice because I believe that with this huge influx of refugees from the zombie outbreak, myself included among them, we need to lay down law and order fairly and effectively. I believe that I can do this. - I believe in fair trail, and one way I would hope to insure this is through having perhaps a permanent or randomly selected committee to act as a jury for certain breaches of the law/rules. - A strike system I think would also be effective for more petty breaches. - I would also like to perhaps have a deputy to fill in for times where I am not available or take my role if I'm faced with an issue in which I have a conflict of interest. I generally log in a few times a day and I can easily be contacted via this forum or the NationStates. My nation will be listed in my signature. Firm but Fair justice is what is needed. Two years ago I was part of a guild for an MMO (Star War: Knights of the Old Republic) before it starts. I was an officer assigned with keeping order within the rank and file. Also in an interim period of the guild I tried holding it together and making sure that operations didn't fall apart along with a few others of the guild. Otherwise in real life I was a student representative on my school board of trustees for two years and we were involved in disciplinary hearings of students and teachers. I won't say I've had much experience besides that otherwise. |

Are you a believer in principles of that which is not prohibited must not be punished? (If someone does something bad, but there is no rule against it, we should not punish them, even if we immediately write a rule to cover the situation.) Or are you a believer that there is an overlying duty of individuals to behave appropriately, and that the rules are warnings and guides on how to act this way? |

I believe that there is an overlying duty of individuals to behave appropriately, but if you breach a rule or law, then depending on the severity of the breach you may be given a warning or given a punishment. Anything in the grey areas (as your refer to "If someone does something bad, but there is no rule against it, we should not punish them, even if we immediately write a rule to cover the situation.") that will be a matter I would take to other figures of authority for their opinion and a permanent committee or randomly selected committee would discuss the actions that would be taken. I hope that answers your question, I understand it isn't a black or white answer. |

If I understand you correctly, you are saying that action should be taken against such an individual, but that that action is not within the authority of the judge to deliver? |

The action that would be taken would be decided by a committee which involves the Minister of Justice, the committee would decide whether a punishment would be suitable or not for the actions that were taken and the committee would also decide on whether their should be an amendment to the laws regarding the actions that were taken that were brought into question by the committee. If a clear decision can not be decided in the committee, the Minister will make the final call. I can respect the argument that 'there was no rule so didn't think it would be a problem' but I also believe that people can use common sense. Example: If our rules don't mention anything about not being allowed to post pornographic material or sexually harass other members (Issues I dealt with in the past) then I believe that the actions shouldn't be completely excused because those are common sense and their would be no logical excuse to have committed those actions. |

I believe the newer law, although I wouldn't let their be a contradiction with in the laws and make sure that they are up to date and reviewed. But in an exceptional situation: If there was a new law which no one had be punished under and an old law which people had been punished under, I would more then likely lean to the old law to be fair regarding people who had been tried in the past. But, I would have to take every matter as a case by case situation and look at the severity of the breach and the difference between the old and new laws and the motives for the creation and their history. |

Another idea I was thinking about was perhaps allowing polls to be created on certain issues regarding justice and punishment, I'm a strong believer in people having a say and able to present their opinion. Although the Minister of Justice is still allowed to make his own choice, it would be a good method for the minister to know the general views of the other nations and I highly doubt that the minister would go against a highly popular decision so democracy would still have it's role. How would you answer to someone claiming not to be bound by the constitution of the region, since they have not joined the forum and are charged with a breach of it by virtue of something they posted on the Regional Message Board? |

That is a good question. I would also ask the question on whether it is compulsory of region members to be bound by the constitution. Personally, I believe they should, but I am aware it is not easy to get everyone to sign up to the forums. If I was faced with that situation though, I would approach the other minsters and discuss an appropriate course of action to handle it, since if someone is claiming to not be bound by the constitution, it effects other ministers, not just the Minister of Justice. Perhaps it could also become a role of the Minister of Immigration to inform new members about the constitution, that way we can throw back the argument "We sent you the constitution and you were asked to read it, if you had issues with it you should've informed us or departed the region". |
